Chapter I: Purpose and Definitions

Purpose of the Law§

1.

The purpose of this Law is to regulate the existence of fire and rescue services in the State, for the purpose of saving human life and property, enhancing fire safety, extinguishing fires and preventing fires.

Definitions§

2.

In this Law –

"hazardous materials incident" – as defined in the Hazardous Materials Law, 5753-1993 (in this Law – the Hazardous Materials Law);

"fire and rescue incident" – a fire and any other dangerous situation dealt with by the Fire and Rescue Authority in accordance with its functions;

"fire and rescue safety means" – means installed in assets, permanently or temporarily, and intended, inter alia, for any of the following:

(1)prevention of fires and their spread;
(2)extinguishing fires, reducing their damage and facilitating fire-extinguishing operations;
(3)evacuation and rescue of trapped persons and facilitation of evacuation and rescue operations;
(4)saving human life and property;
(5)means of communication;
(6)any need required for carrying out fire-extinguishing and rescue operations;

"administrative affairs court" – as defined in section 3 of the Administrative Affairs Courts Law, 5760-2000;

"owner of an asset", in relation to real property – a person registered in the real property registers as owner, or a person entitled to be so registered as owner and who lawfully holds the real property, as well as a long-term lessee; however, if the real property is Israel Lands in which a long-term lessee has a right therein or in respect thereof – the long-term lessee alone;

"fire and rescue directives" – directives issued by the Commissioner under section 10(a)(1);

"Authority directives" – fire and rescue directives and fire and rescue orders;

"economic impact", in relation to a professional guideline or the promulgation of Regulations – the cost of implementation to all parties required to carry out the guideline or the Regulations, as the case may be, exceeding NIS 30,000,000 in a given year;

"significant economic impact", in relation to a professional guideline – the cost of implementation to all parties required to carry out the guideline, exceeding NIS 70,000,000 in a given year;

"the Regulatory Advisory Committee" – the regulatory committee established under section 126a;

"National Parks Law" – National Parks, Nature Reserves, National Sites and Commemoration Sites Law, 5758-1998;

"Collective Agreements Law" – Collective Agreements Law, 5717-1957;

"Budget Foundations Law" – Budget Foundations Law, 5745-1985;

"Computers Law" – Computers Law, 5755-1995;

"Water Law" – Water Law, 5719-1959;

"Penal Law" – Penal Law, 5737-1977;

"Business Licensing Law" – Business Licensing Law, 5728-1968;

"State Service Law (Pensions)" – State Service Law (Pensions) [Consolidated Version], 5730-1970;

"State Service Law (Appointments)" – State Service Law (Appointments), 5719-1959;

"State Service Law (Discipline)" – State Service Law (Discipline), 5723-1963;

"Fire Services Law" – Fire Services Law, 5719-1959;

"Planning and Building Law" – Planning and Building Law, 5725-1965;

"the day of establishment of the Authority" – six months from the day of publication of this Law;

"firefighter" – as defined in section 13(a);

"Israel Water and Sewerage Authority Council" – the Government Authority Council established under section 124o of the Water Law;

"holder of an asset" – excluding a person whose right to hold the asset does not exceed a period of 30 days and excluding a person residing in a hotel;

"the defence establishment" – as defined in section 82;

"district commander" – a person appointed to be district commander in the Fire and Rescue Authority, or to discharge the functions of a district commander in the Fire and Rescue Authority;

"Israel Lands" – as defined in Basic Law: Israel Lands;

"person serving in civilian-security service" – a person serving in the Fire and Rescue Authority in civilian-security service as defined in the National Civilian Service Law, 5774-2014;

"volunteer" – a person appointed to be a volunteer under section 17(c) as an assistant in the Fire and Rescue Authority, whose volunteering has been approved in accordance with the provisions of this Law;

"volunteer in national service or community volunteering" – a person serving in the Fire and Rescue Authority in national service or community volunteering as defined in the Civil Service Law, 5777-2017;

"assets" – real property and public transport vehicles;

"the Commissioner" – the Fire and Rescue Commissioner, appointed under this Law;

"Authority employees" – firefighters and employees alike, unless otherwise stated;

"fire and rescue orders" – orders issued by the Commissioner under section 10(a)(2);

"Police Ordinance" – Police Ordinance [New Version], 5731-1971;

"fire and rescue officer" – as defined in section 13(b);

"senior fire and rescue officer" – a fire and rescue officer whose rank is Deputy Superintendent and above;

"the Authority", "the Fire and Rescue Authority" – the National Fire and Rescue Authority established by this Law;

"the Nature and National Parks Protection Authority" – as defined in the National Parks Law;

"Israel Land Authority" – as defined in the Israel Land Authority Law, 5720-1960;

"area approved in a plan as a national park or nature reserve" – an area in respect of which a plan as defined in the Planning and Building Law has been approved, designating it as a national park or nature reserve;

"area declared as a national park or nature reserve" – an area declared as a national park or nature reserve under section 22(a) of the National Parks Law;

"the Minister" – the Minister of Public Security.

Chapter II: The National Fire and Rescue Authority

Section A: The Authority and Its Functions

Establishment of a National Fire and Rescue Authority§
3.
(a)The National Fire and Rescue Authority is hereby established within the Ministry of Public Security.
(b)The Fire and Rescue Authority is a national State authority.
(c)The Minister shall determine the emblem of the Fire and Rescue Authority.
Functions of the Fire and Rescue Authority§
4.
(a)The following are the functions of the Fire and Rescue Authority –
(1)to act to extinguish fires, prevent their spread and save human life and property from fires;
(2)to act to prevent fires under this Law;
(3)to act to rescue and save trapped persons;
(4)to act in a hazardous materials incident under this Law;
(5)to fulfil a function imposed upon it as an auxiliary organisation or as a rescue body in accordance with the provisions of any law;
(6)to perform additional operations for the purpose of saving life and property, for the performance of which equipment held by the Authority is required.
(b)The Authority, for the purpose of fulfilling its functions –
(1)shall train and exercise firefighters, volunteers and persons serving in civic-security service;
(2)shall train employees and firefighters to deal with hazardous materials incidents;
(3)shall establish, train and operate firefighter units;
(4)shall establish and maintain installations and equipment;
(5)shall conduct investigations into fires and their causes;
(6)shall develop knowledge and establish professional standards;
(6a)shall promote the regulation of provisions relating to fire and rescue safety;
(7)shall prepare plans for the advancement and development of the Authority;
(8)shall conduct joint exercises with other rescue bodies;
(9)shall carry out public information and instruction activities in the field of fire safety;
(10)shall encourage research and development in its fields of activity;
(11)shall cooperate with fire and rescue authorities outside the State, including for the purpose of mutual assistance in the provision of fire and rescue services, as the Minister shall direct;
(12)shall perform additional operations as required for the fulfilment of its functions.

Section B: Fire and Rescue Commissioner

Fire and Rescue Commissioner§
5.
(a)The Minister, with the approval of the Government, shall appoint a Fire and Rescue Commissioner who shall be the supreme command echelon in the Fire and Rescue Authority; the Commissioner shall be a State employee and shall be deemed a firefighter for the purposes of this Law.
(b)The Commissioner is responsible for the management of the Authority and for the performance of its functions under this Law.
(c)The term of office of the Commissioner shall be five years.
Conditions of Eligibility§
6.

A person is eligible to be appointed as Commissioner if all of the following conditions are fulfilled:

(1)the person has managerial or command experience in a body with a scope of activity commensurate with the scope of activity of the Authority;
(2)the person holds an academic degree;
(3)the person has not been convicted of an offence which, by reason of its nature, gravity or circumstances, renders the person unfit to be appointed as Commissioner;
(4)the person meets additional eligibility conditions as may have been prescribed for this purpose under the State Service (Appointments) Law.
Termination of the Commissioner's Term of Office§
7.
(a)The Commissioner shall cease to hold office before the end of the term of office upon the occurrence of one of the following:
(1)the Commissioner resigned by delivering a letter of resignation to the Minister;
(2)the Commissioner was removed from office or dismissed under the State Service (Discipline) Law;
(3)the Minister, after consulting with the Attorney General and the Civil Service Commissioner, decided to cancel the appointment after one of the following was proven to the Minister's satisfaction:
(a)the Commissioner is not properly fulfilling the Commissioner's functions;
(b)the Commissioner is permanently prevented, or prevented for a period exceeding six months, from fulfilling the Commissioner's functions;
(c)the Commissioner was convicted of an offence which, by reason of its nature, gravity or circumstances, renders the Commissioner unfit to serve as Commissioner;
(d)the Commissioner was suspended from office in accordance with the provisions of the State Service (Discipline) Law for a period exceeding six months.
(b)If the Commissioner delivered a letter of resignation as referred to in subsection (a)(1), the term of office shall expire upon the lapse of 30 days from the day of delivery of the letter of resignation, unless the Minister agreed to an earlier date.
Powers of the Commissioner and Delegation of Powers§
8.
(a)The Commissioner is vested with all the powers conferred upon firefighters.
(b)The Commissioner may delegate powers under this Law to a senior fire and rescue officer, except the power to issue Authority directives under section 10, and the power to order the establishment of firefighting teams under sections 31 and 32.
Action Contesting the Appointment of the Commissioner, Termination of Office or Suspension§
9.

An action brought to contest the exercise of powers in relation to the appointment of the Commissioner, the termination of the Commissioner's office or the Commissioner's suspension shall not be regarded as an action arising from an employer-employee relationship for the purposes of section 24 of the Labour Court Law, 5729-1969.

Section C: Powers of the Commissioner

Authority Directives§
10.
(a)The Commissioner is empowered to issue Authority directives, in relation to the functioning of the Fire and Rescue Authority, ensuring its proper operation and in any matter under this Law in respect of which it has been prescribed that the Commissioner is empowered to issue Authority directives, as set out below:
(1)fire and rescue directives that shall establish rules and principles in relation to the Fire and Rescue Authority – with the approval of the Minister;
(2)fire and rescue orders that shall establish the details of matters in respect of which fire and rescue directives have been established, or additional details in the field of fire and rescue.
(b)Where there is a conflict between a fire and rescue directive and a fire and rescue order – the fire and rescue directive prevails.
(c)For the purposes of this Law, Authority directives shall be regarded as laws.
(d)Authority directives do not require publication in Reshumot (Official Gazette) and shall be published on the website of the Fire and Rescue Authority.
(e)If the Attorney General determines, after consulting with the Commissioner or a person authorised by the Commissioner for that purpose, that an Authority directive is of relevance or importance to the public, it shall also be required to be published in Reshumot (Official Gazette).
Structure of the Authority and Fire Stations§
11.
(a)Subject to provisions under sections 12 and 13, the Commissioner shall issue Authority directives concerning the structure of the Authority, the units of the Authority and their deployment in districts, the functions of the various units and the functions of the command echelon responsible for those units.
(b)The Authority shall have fire stations in such number, at such locations and with such areas of operation as the Commissioner shall direct, with the consent of the Minister.
(c)The Fire and Rescue Authority bears the duty and responsibility to ensure its level of competence and that of the Authority's employees by means of appropriate training, exercises and equipment in accordance with the missions of its units; the Commissioner shall determine, in Authority directives, the competence required of the Authority and of the Authority's employees for the fulfilment of its functions, the deployment of the operational array, the required response times to a fire and rescue incident and the composition and size of firefighting teams.

Chapter III: Firefighters, Employees and Volunteers

Section A: Firefighters and Employees

Application of the State Service (Appointments) Law and the State Service (Discipline) Law§
12.
(a)The Fire and Rescue Authority shall have firefighters and employees within the approved establishment of the Authority.
(b)
(1)Authority employees shall be State employees and the provisions of the State Service (Appointments) Law, as well as the provisions of this Law, shall apply to them;
(2)Authority employees shall act in accordance with the Commissioner's directives and under the Commissioner's supervision.
(c)Notwithstanding the provisions of any law, the Minister, after consulting with the Civil Service Commissioner, with the consent of the Minister of Finance and with the approval of the National Security Committee of the Knesset, may prescribe provisions different from those applicable in the State service, in relation to the organisation and management of personnel in the Authority, in whole or in part, including in relation to the admission and appointment of firefighters to the Authority, including Regulations prescribing a different law from that prescribed in the State Service (Appointments) Law.
(d)Regulations under subsection (c) may also prescribe provisions in relation to the competence of Authority employees and periodic rules and tests for such employees.
(e)The provisions of the State Service (Discipline) Law shall apply to Authority employees, insofar as not otherwise prescribed in this Law, as well as provisions under the Fire Services Law for as long as they remain in force in accordance with the provisions of section 147(c).
Firefighters and Fire and Rescue Officers§
13.
(a)A firefighter is a person who has completed a basic firefighters' course and serves in a post listed in the First Schedule.
(b)A fire and rescue officer is an Authority employee who has received appropriate training therefor, as determined by the Commissioner in fire and rescue orders, and whom the Commissioner has authorised as a fire and rescue officer.
(c)The Commissioner may appoint to serve in a post listed in the First Schedule a fire and rescue officer who is a firefighter, or who has received appropriate training therefor as determined by the Commissioner in fire and rescue orders, and such person shall be deemed a firefighter.
(d)The Minister, after consulting with the Civil Service Commissioner, may prescribe, by Order, additional posts in the Authority in the field of fire prevention and fire investigation, to the holder of the post listed therein shall apply the provisions of this Law applicable to firefighters under this Law, in whole or in part, and with such modifications as the Minister shall prescribe.
(e)The Minister, with the consent of the Civil Service Commissioner and with the approval of the National Security Committee of the Knesset, may, by Order, amend the First Schedule.
(f)The Minister, with the consent of the Civil Service Commissioner, may prescribe provisions in relation to the ranks of firefighters and fire and rescue officers.
The Firefighter on Duty§
14.

Notwithstanding the provisions of any law, a firefighter, while in Israel, shall be regarded, for all purposes under this Law, as being available for duty, and may at any time be directed to report and fulfil duties anywhere in accordance with the Commissioner's directives.

Uniforms and Identification Badges§
15.
(a)While performing duties, a firefighter shall be dressed in uniform in accordance with the Authority directives, shall wear a visible identification badge bearing the firefighter's first name and surname, and shall carry the firefighter's appointment certificate as a firefighter.
(b)A firefighter exercising powers under this Law in relation to a person shall present the firefighter's appointment certificate immediately upon the demand of that person.
(c)A firefighter shall provide identifying details upon the request of any person in any matter connected with being a firefighter.
(d)The obligations under subsections (a) to (c) shall not apply in circumstances in which there is a risk of harm to human life or property.
(e)Once the circumstances that prevented the fulfilment of the obligations under this section, as referred to in subsection (d), have passed, the firefighter shall comply with the said provisions as soon as possible.
Decorations§
16.

The Decorations in the Israel Police and Prison Service Law, 5732-1972, shall also apply to firefighters and volunteers, with the following modifications: wherever that Law reads "the Inspector General" it shall read "the Commissioner"; wherever it reads "police officer" it shall read "firefighter" or "volunteer", as the case may be; wherever it reads "standing orders" it shall read "Authority directives"; and wherever it reads "the Police" it shall read "the National Fire and Rescue Authority"; however, for the purposes of section 11a of that Law, wherever it reads "police officer" it shall read "Authority employee".
