Chapter XII: Repeals and Savings Provisions

Repeal of Fire-Fighting Services Law§

146.

The Fire-Fighting Services Law, 5719-1959 – is repealed on the day of establishment of the Authority.

Transitional Provisions Regarding Regulations§

147.
(a)Regulations made under the Fire-Fighting Services Law as worded on the eve of the publication of this Law, as listed below, shall remain in force until new Regulations are made under this Law in respect of the matters regulated therein, unless they are revoked or amended earlier by the Minister:
(1)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Museums), 5747-1986;
(2)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in a Commercial Building), 5732-1971;
(3)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Hospitals), 5732-1972;
(4)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Residential Buildings), 5732-1972;
(5)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Schools), 5732-1972;
(6)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Entertainment Venues), 5730-1969;
(7)Fire-Fighting Services Regulations (Fire Extinguishing Equipment in Houses of Worship), 5732-1972;

(b)Regulations made under the Fire-Fighting Services Law as worded on the eve of the publication of this Law, as listed below, shall remain in force until the day of establishment of the Authority, unless they are revoked or amended earlier by the Minister:
(1)Fire-Fighting Services Regulations (Ranks and Establishment of Firefighter Units), 5736-1976, except for regulations 2 and 3 of the said Regulations;
(2)Fire-Fighting Services Regulations (Arrangements and Conditions for Mutual Assistance), 5722-1962;
(3)Fire-Fighting Services Regulations (Investigation of a Fire and Its Causes), 5732-1972;
(4)Fire-Fighting Services Regulations (Fire Extinguishing Equipment), 5725-1964;
(5)Fire-Fighting Services Regulations (Powers of the Commander of Fire-Fighting Services), 5739-1978;
(6)Fire-Fighting Services Regulations (Powers of the Chief Fire Inspector), 5732-1972;
(7)Fire-Fighting Services Regulations (Joint Operations), 5721-1960.
(c)Regulations and directives established under the Fire-Fighting Services Law as worded on the eve of the publication of this Law, as listed below, shall remain in force for as long as they have not been revoked by the Minister:
(1)Fire-Fighting Services Regulations (Discipline), 5740-1980;
(2)Fire-Fighting Services Directives (Discipline), 5741-1980.
(d)Subject to the provisions of subsection (c)(2), procedures established by a Chief Fire Commander under the Fire-Fighting Services Law shall remain in force until procedures are established by the Commissioner under this Law.
(e)A power vested in a fire-fighting authority under the Regulations listed in subsections (a) and (c) is vested in the Fire and Rescue Authority, and the Commissioner shall determine the holder of the power; a notice of such determination shall be published in Reshumot (Official Gazette).
(f)Where the Regulations listed in subsection (b) are repealed by virtue of their replacement by provisions under this Law, the Minister shall publish a notice thereof in Reshumot (Official Gazette).

Replacement of Provisions of the Third Schedule by Regulations§

148.
(a)In this section, "the determining date" – the 23rd of Tammuz 5787 (1 July 2027).
(b)By the determining date, the Minister shall make Regulations under this Law or under the Business Licensing Law, as the case may be, which shall replace the provisions listed in the Third Schedule; for the purposes of provisions as aforesaid that relate to planning and construction, the Minister of the Interior shall, by the determining date, make Regulations pursuant to the Minister's authority under sections 158a(b) and (c) and 265 of the Planning and Building Law.
(c)The Minister, with the consent of the Minister of Finance and with the approval of the National Security Committee of the Knesset, may, by Order, defer the determining date for additional periods, provided that the total of all extension periods shall not exceed one year.
(d)If the Minister or the Minister of the Interior, as the case may be, has not made Regulations as referred to in subsection (b) by the determining date or by the date set pursuant to subsection (c), and Commissioner directives under section 126h(a)(3) replacing the provisions listed in the Third Schedule have not been established by the said date, the said provisions shall lapse, unless they were revoked earlier.

Report to the Knesset§

149.

The Minister and the Minister of the Interior shall each report to the National Security Committee of the Knesset on the progress of making the Regulations under section 148(b), no later than 1 January and 1 July of each year until the determining date, and the Committee shall hold a discussion on the reports.

Ruling of the Prime Minister§

150.

Where an Order has been issued to defer the determining date as referred to in section 148(c), and the Prime Minister is satisfied that the making of the Regulations under section 148 has not been completed by the 1st of Cheshvan 5788 (1 November 2027) and that it does not appear that it will be completed by the end of the date set in the said Order, the Prime Minister shall rule on the manner of making the Regulations, after consultation with the Minister or with the Minister of the Interior, as the case may be.

Additional Conditions§

151.
(a)Until the provisions listed in the Third Schedule are replaced by Regulations to be made by the Minister as referred to in section 148(b) or by Commissioner directives to be established under section 126h(a)(3) in respect of businesses requiring a licence, a business requiring a licence that on the 24th of Av 5781 (2 August 2021) held a valid approval from the approval-granting authority for the purposes of section 1(a)(7) of the Business Licensing Law, and that will not carry out a change of designation or use within the meaning of the Planning and Building Law that has a significant impact on fire safety in the business, shall not be required to implement additional conditions beyond those required of it when the said approval was received.
(b)Notwithstanding the provisions of subsection (a) –
(1)a national authorised body as defined in section 7(e) of the Business Licensing Law may direct a particular business as referred to in subsection (a) to comply with additional conditions due to a significant risk discovered in the business; such a direction shall be delivered to the business owner together with the reasons for its determination;
(2)the Commissioner may determine that implementation of additional conditions as aforesaid is required in relation to categories of businesses, for special reasons, and after notifying the advisory committee on regulation thereof.
