Section B: Overcrowding

Overcrowding§
21.
(a)A factory, while work is being carried on therein, shall not be overcrowded to an extent likely to cause harm to the health of the workers therein.
(b)The other provisions of this Section shall not derogate from the generality of the provision of subsection (a).
Presumption of Overcrowding§
22.

A factory shall be deemed to be overcrowded to the extent mentioned in section 21 if the number of persons employed at one time in a workroom is such that the air space per worker in that room is less than eleven cubic metres, and in a factory or part thereof that did not exist on the date of commencement of the Work Safety Ordinance (Amendment) Law, 5734-1974 – less than eleven and a half cubic metres.

Exemption§
23.

If the Chief Inspector is satisfied that, by reason of the special circumstances in which work is carried on in a workroom, it is not appropriate or necessary to apply the provisions of section 22 to that room, he may by certificate exempt that room therefrom subject to the conditions set out in that certificate.

Regulations regarding Overcrowding§
24.

The Minister may by Regulations prescribe an increase in the air space per worker to be provided under section 22; such Regulations may be made for a class or description of factory or part of a factory or for a process.

Limitation on Calculation§
25.

In calculating the air space for the purposes of this Section, no account shall be taken of any space more than 4.25 metres above the floor, and in a factory or part thereof that did not exist on the date of commencement of the Work Safety Ordinance (Amendment) Law, 5734-1974 – more than three metres above the floor, and if there is a gallery in a room, the gallery shall be treated as if it were a separate room.

Display of Notice§
26.

At the request of the regional inspector, a notice of the number of persons who may be employed in a workroom in accordance with the provisions of this Section shall be displayed in that workroom.

Section C: Ventilation, Lighting and Heat

Ventilation§
27.

Effective and suitable measures shall be taken to secure and maintain, by the circulation of fresh air, adequate ventilation in every workroom, and to render harmless, so far as is practicable, all fumes, dust and other impurities generated in the course of any process or work carried on in the factory that may be injurious to health.

Lighting§
28.

Effective measures shall be taken to secure and maintain sufficient and suitable lighting, whether natural or artificial, in every part of a factory in which persons work or pass.

Windows§
29.

Glazed windows and skylights used for lighting a workroom shall, so far as is practicable, be kept clean on both the inner and outer surfaces and free from obstruction to the admission of light, but this provision shall not prevent their being whitewashed or shaded for protection against heat or glare.

Temperature§
30.

Effective measures shall be taken to secure and maintain a reasonable temperature in every workroom, but no method shall be used which causes the emission into the air of the room of fumes of such a nature and quantity as to be likely to injure or cause discomfort to the workers in the room.

Temperature for Sedentary Work§
31.

In a workroom in which work is carried on for a substantial part of the time in a seated posture and does not involve substantial physical effort, a temperature of less than 16 degrees Celsius, after the first hour, shall not be deemed a reasonable temperature while persons are working, and at the request of the regional inspector a thermometer shall be provided and maintained in a suitable position therein.

Regulations regarding Ventilation, Lighting and Temperature§
32.
(a)The Minister may by Regulations prescribe a standard –
(1)for adequate ventilation for factories;
(2)for adequate lighting for factories or for a process;
(3)for a reasonable temperature for factories, and the standard may, inter alia, vary the provisions of section 31 with respect to temperature, prohibit any method of heating if in his opinion the method is likely to injure workers, and require the provision and maintenance of thermometers at places and in positions to be prescribed.
(b)Regulations for factories under this section may be general or applicable to a particular class or description of factories or parts thereof.
(c)Regulations under this section that are designated for factories whose principal activity is the production, filling, storage, conveyance, transport or marketing of gas shall be made after consultation with the Minister of Energy and Infrastructure.

Section D: Floor Drainage

Floor Drainage§
33.

Where a process causes the floor to become so wet that liquids can be drained off, effective measures shall be taken and maintained to drain them off.

Section E: Sanitary Conveniences

Sanitary Conveniences§
34.
(a)Sufficient and suitable sanitary conveniences shall be provided for the workers in a factory, maintained and kept in a clean state, and effective measures shall be taken to light them.
(b)If men and women are employed or are to be employed in a factory, separate conveniences shall be provided for each sex, unless only members of one family residing there are employed.

35.

The Minister may by Regulations prescribe what constitutes suitable and sufficient sanitary conveniences for factories or for a class or description of factories.

Section F: Medical Supervision

Regulations regarding Medical Supervision§
36.
(a)The Minister may by Regulations require the maintenance of reasonable arrangements to be specified therein for the medical supervision of workers or of a class of workers in a factory or in a particular class or description of factories, if it appears to him that any one of the following conditions is fulfilled:
(1)cases of illness have occurred or there is a reasonable apprehension that they will occur, which are attributable to the work, materials or process in the factory;
(2)by reason of a change in the process or in the materials used therein, a risk of harm to the health of workers engaged in that process is likely to arise;
(3)by reason of the introduction of a new process or the introduction of a new substance for use in a particular process, a risk of harm to the health of workers engaged in those processes is likely to arise.
(b)Regulations under this section shall not require medical treatment beyond first aid or preventive treatment.

Chapter III: Safety

Section A: Machinery in General

Parts Requiring Fencing§
37.

Each of the following parts shall be securely fenced:

(1)in electric motors, electric generators and rotary converters – every part thereof and every flywheel directly connected thereto;
(2)in every prime mover other than prime movers mentioned in paragraph (1) – every moving part thereof and every flywheel directly connected thereto, whether the prime mover or flywheel is situated in an engine room or not;
(3)in a transmission – every part thereof;
(4)in machinery other than a prime mover or transmission – every dangerous part thereof;
(5)in a lathe – every part of a bar stock projecting beyond the head of the lathe;
(6)in a water wheel or water-driven turbine – the head race and the tail race;
(7)in any engine, plant or other equipment mentioned in paragraphs (1) to (6) that are products of the factory, whether intended for sale or intended for use in the factory, when operated for the purpose of adjustment, running-in, testing or display – every part thereof that requires fencing in accordance with paragraphs (1) to (6), as the case may be,

unless it is a part mentioned in paragraphs (1), (3), (4), (5) or (7) and it is so positioned or constructed as to be as safe to every person working on the premises as if it were securely fenced.

Access to Machinery when not Fenced§
38.
(a)When determining, for the purposes of section 37, whether a part that requires fencing is so positioned or constructed as to be as safe to every person working on the premises as if it were securely fenced, no account shall be taken of a competent person carrying out an operation on machinery in motion, or an operation on a transmission in motion, subject to the following conditions:
(1)he is wearing a one-piece overall that fits closely to the body, is in good repair, is fastened by a means that leaves no loose or flying ends and has no external pockets other than one hip pocket; this condition shall not apply to a machine tool setter or other skilled mechanic employed in setting a machine whose function it is to set it;
(2)every ladder used in carrying out the operation is securely fixed, securely lashed or firmly held by another person.
(b)In this section –

"competent person" – a person who has attained the age of eighteen years and in whom both of the following conditions are fulfilled:

(1)he has been appointed by the occupier of the factory, by a written appointment appended to the factory register, to carry out operations on machinery in motion and operations on a transmission in motion, all or some of them, as specified in the instrument of appointment, and has received from the occupier a copy of the instrument of appointment signed by hand;
(2)he has been adequately trained for the work involved in every operation he is authorised by his appointment to carry out and is aware of the dangers connected with machinery in motion and with a transmission in motion arising from such an operation;

"operation on machinery in motion" – the examination of a part of machinery, or lubrication or adjustment found to be immediately necessary in the course of the examination, which must be carried out while the part is in motion;

"operation on a transmission in motion" – lubrication of a transmission used in a continuous process, or the mounting or transfer of a transmission belt on such a transmission, if the Chief Inspector has certified in a certificate issued to the factory that he is satisfied that, by reason of the continuity of the process, stopping the transmission is likely to cause serious harm to the carrying out of the process, and the operation is performed by the method and in the circumstances specified in that certificate and in accordance with the conditions set out therein.

Automatic Safety Devices§
39.

A dangerous part of machinery as mentioned in section 37(4) in respect of which, by reason of the nature of the operation, safety cannot be achieved by means of a fixed guard, shall be deemed to satisfy the requirements of section 37 if a device is provided that automatically prevents the operator from coming into contact with that part.

Regulations regarding Other Safety Devices§
40.
(a)If the Minister is satisfied that for machinery of a particular type there is obtainable a safety device of a particular type or description suitable for use with that machinery and which prevents the exposure of a dangerous part thereof while in motion, or which stops the machinery immediately in case of danger, he may by Regulations require that a device of that description be provided for use with machinery of the type specified in the Regulations.
(b)In proceedings for a contravention of a provision under this section it shall be a sufficient defence if it is proved that another device, at least equally effective, was in use with the machinery in respect of which the contravention occurred.
Additional Safety Arrangements in connection with Transmission§
41.
(a)In every room or place in which work is carried on, efficient devices shall be provided and maintained by which power can be promptly cut off from the transmission in that room or place.
(b)A suitable striking gear or other effective mechanical device shall be provided and maintained and used for moving belts between pulleys that are part of a transmission from fast to loose or vice versa, and it shall be so constructed, placed and maintained as to prevent the belt from creeping back on to the fast pulley.
(c)A driving belt, when not in use, shall not rest or ride upon a revolving shaft that is part of a transmission.
Exemption§
42.

Where the Minister is satisfied that, owing to special circumstances, it is unnecessary or impracticable to comply with a requirement of section 41, he may direct that that requirement shall not apply in those circumstances.

Regulations regarding the fencing of materials in machinery§
43.

The Minister may, in respect of a particular machine or a particular process for which a machine is used, make Regulations requiring the fencing of materials or articles that are dangerous while in motion in the machine.

Construction and maintenance of fencing§
44.

Every fence or other safety device installed in accordance with the preceding provisions of this Section shall be of substantial construction, shall be constantly maintained and shall be kept in position for as long as the parts requiring fencing or another safety device are in motion or in use, except where it is necessary for them to be exposed for examination, or for lubrication or adjustment found to be immediately necessary during the examination, and all the requirements of section 38 have been complied with.

Section B: Construction of Machinery and Trade Therein

Protection of certain parts§
45.

In a machine intended to be driven by mechanical power –

(1)every set-screw, bolt or key of any revolving shaft, spindle, wheel or pinion shall be sunk, encased or otherwise effectively guarded so as to prevent danger;
(2)every train of toothed or friction gearing which does not require frequent adjustment while in motion shall be completely encased, unless it is so placed as to be as safe as if it were completely encased.
Trade in machinery and equipment§
46.

A machine intended to be driven by mechanical power that does not comply with the requirements of section 45 shall not be sold by any person or hired for use in a factory in Israel, and no person acting as agent of a seller or hirer shall cause or bring about its sale or hiring for use in a factory in Israel.

Regulations regarding trade in machinery and equipment§
47.

The Minister may extend the provisions of section 46 to machines, installations or equipment that do not comply with requirements of this Ordinance or of a regulation made thereunder, all as he shall specify in Regulations; Regulations under this section may relate to machines, installations or equipment in a specified process.

Limitation on application§
48.

The provisions of this Section shall not apply to a machine the construction of which was commenced before the 27th day of Shevat 5706 (29 January 1946), and Regulations under section 47 shall not apply to machines, installations or equipment the construction of which was commenced before the making of those Regulations.

Section C: Safety of Access and Passage

Access to a place of work§
49.

Safe means of access to every place at which a person is at any time required to work shall be provided and maintained so far as is reasonably practicable; without prejudice to the generality of this provision –

(1)adequate gangways shall be provided and maintained in workrooms;
(2)the gangways in workrooms and other gangways and staircases in the building shall be free from obstruction by materials, articles, equipment or tools;
(3)the place at which the worker performs his work shall be provided and maintained in a safe condition.
Protection against falling§
50.

Where a person is required to work at a place from which he is liable to fall more than two metres, and the place does not afford a safe foothold and, where necessary, a safe handhold, means for his safety shall be provided, so far as is reasonably practicable, by fencing or otherwise.

Containers for dangerous liquids§
51.
(a)Every fixed tank, pit, sump or structure whose rim is less than one metre above the adjacent ground or platform level and which contains a corrosive or poisonous liquid shall be securely covered or securely fenced to at least that height; and if by reason of the nature of the process it is impracticable to do so, everything practicable shall be done, by covering, fencing or other means, to prevent a person from falling into the tank, pit, sump or structure.
(b)The Chief Inspector may by certificate exempt any tank, pit, sump or structure from the requirements of this section if he is satisfied that in relation thereto those requirements are unnecessary or inappropriate.
Traversing part of an automatic machine§
52.

Where a traversing part of an automatic machine, or any material carried thereon, moves within a space through which a person is liable to pass in the course of his work or in other circumstances, it shall not be permitted for that part or material to reach, in its outward or inward movement, a point less than fifty centimetres from a fixed structure that is not part of the machine.

Automatic spinning machine§
53.

In relation to a spinning machine with an automatic carriage, every practicable measure shall be taken, by instructions to the person in charge of the machine and otherwise, to ensure that no worker is present in the space between the traversing part of the machine and a fixed part of the machine towards which the traversing part moves on its inward run, unless the machine has been stopped with the traversing part on its outward run.
