Basic Law: The State Comptroller

חוק-יסוד: מבקר המדינה

Nature

State audit is vested in the State Comptroller.

State Audit

(a)The State Comptroller shall audit the economy, assets, finances, obligations and administration of the State, of government ministries, of every enterprise, institution or corporation of the State, of local authorities, and of other bodies or institutions placed by law under the audit of the State Comptroller.

(b)The State Comptroller shall examine the legality of actions, integrity, sound administration, efficiency and economy of the audited bodies, and any other matter the Comptroller considers necessary.

Duty to Furnish Information

A body subject to the audit of the State Comptroller shall furnish to the Comptroller, without delay and upon demand, information, documents, explanations and any other material that the Comptroller considers necessary for the purposes of the audit.

Public Complaints

The State Comptroller shall investigate complaints from the public against bodies and persons as shall be prescribed by law or under it; in this capacity the State Comptroller shall hold the title "Commissioner for Complaints from the Public".

Additional Functions

The State Comptroller shall perform additional functions as shall be prescribed by law.

Accountability to the Knesset

In the performance of his functions the State Comptroller shall be accountable to the Knesset alone and shall not be dependent on the Government.

Election and Term of Office [Amendment: 1998]

(a)The State Comptroller shall be elected by the Knesset by secret ballot; the procedures for election shall be prescribed by law.

(b)The term of office of the State Comptroller shall be seven years.

(c)The State Comptroller shall serve for one term of office only.

Eligibility [Amendment: 1998]

Every Israeli citizen who is a resident of Israel is eligible to be a candidate for the office of State Comptroller; a law may prescribe additional eligibility requirements.

Oath of Allegiance

The elected State Comptroller shall declare and sign before the Knesset the following oath of allegiance:

"I pledge to bear allegiance to the State of Israel and its laws and to faithfully perform my duties as State Comptroller."

Budget

10.

The budget of the Office of the State Comptroller shall be determined upon the proposal of the State Comptroller by the Finance Committee of the Knesset, and shall be published together with the State budget.

Salary and Benefits

11.

The salary of the State Comptroller and other payments to be made to him during or after his term of office, or to his survivors after his death, shall be prescribed by law or by a resolution of the Knesset or of a committee thereof empowered by the Knesset for that purpose.

Relations with the Knesset and Submission of Reports

12.

(a)The State Comptroller shall maintain contact with the Knesset, as shall be prescribed by law.

(b)The State Comptroller shall submit to the Knesset reports and opinions in the area of his functions and shall publish them publicly, all in the manner and subject to the limitations prescribed by law.

Removal from Office [Amendment: 2005]

13.

The State Comptroller shall not be removed from office except in one of the following cases:

(1)For reasons of health he is permanently incapacitated from performing his duties — on the day the Knesset resolved accordingly, by a resolution adopted by at least a majority of its members, following a procedure to be prescribed by law;

(2)On account of conduct unbecoming his position as State Comptroller — on the day the Knesset resolved accordingly, by a resolution adopted by at least three-quarters of its members, following a procedure to be prescribed by law.

Acting Comptroller

14.

If the State Comptroller is incapacitated from performing his duties, an acting Comptroller shall be appointed in the manner and for the period to be prescribed by law.

ביקורת המדינה נתונה בידי מבקר המדינה.

(א) מבקר המדינה יקיים ביקורת על המשק, הנכסים, הכספים, ההתחייבויות והמינהל של המדינה, של משרדי הממשלה, של כל מפעל, מוסד או תאגיד של המדינה, של הרשויות המקומיות ושל גופים או מוסדות אחרים שהועמדו על פי חוק לביקורתו של מבקר המדינה. (ב) מבקר המדינה יבחן את חוקיות הפעולות, טוהר המידות, הניהול התקין, היעילות והחסכון של הגופים המבוקרים, וכל ענין אחר שיראה בו צורך.

גוף העומד לביקורתו של מבקר המדינה ימציא למבקר ללא דיחוי, לפי דרישתו, ידיעות, מסמכים, הסברים, וכל חומר אחר שלדעת המבקר דרושים לו לצרכי הביקורת.

מבקר המדינה יברר תלונות מאת הציבור על גופים ואנשים כפי שייקבע בחוק או לפיו; בתפקידו זה יכהן מבקר המדינה בתואר "נציב תלונות הציבור".

מבקר המדינה ימלא תפקידים נוספים כפי שייקבע בחוק.

במילוי תפקידיו יהיה מבקר המדינה אחראי בפני הכנסת בלבד ולא יהיה תלוי בממשלה.

(א) מבקר המדינה ייבחר בידי הכנסת בהצבעה חשאית; סדרי הבחירה ייקבעו בחוק. (ב) תקופת כהונתו של מבקר המדינה תהיה שבע שנים. (ג) מבקר המדינה יכהן תקופת כהונה אחת בלבד.

כל אזרח ישראלי שהוא תושב ישראל כשיר להיות מועמד לכהונת מבקר המדינה; חוק יכול שיקבע תנאי כשירות נוספים.

מבקר המדינה הנבחר יצהיר ויחתום לפני הכנסת הצהרת אמונים זו: "אני מתחייב לשמור אמונים למדינת ישראל ולחוקיה ולמלא באמונה את תפקידי כמבקר המדינה."

תקציב משרד מבקר המדינה ייקבע לפי הצעת מבקר המדינה בידי ועדת הכספים של הכנסת, ויפורסם ביחד עם תקציב המדינה.

משכורתו של מבקר המדינה ותשלומים אחרים שישולמו לו בתקופת כהונתו או לאחריה, או לשאיריו לאחר מותו, ייקבעו בחוק או בהחלטה של הכנסת או של ועדה מוועדותיה שהכנסת הסמיכה לכך.

(א) מבקר המדינה יקיים קשר עם הכנסת, כפי שייקבע בחוק. (ב) מבקר המדינה יגיש לכנסת דינים וחשבונות וחוות דעת בתחום תפקידיו ויפרסם אותם ברבים, והכל בדרך ובסייגים שייקבעו בחוק.

מבקר המדינה לא יועבר מכהונתו אלא באחד מאלה: (1) מטעמי בריאות נבצר ממנו, דרך קבע, למלא את תפקידו – ביום שבו החליטה הכנסת על כך, בהחלטה שהתקבלה ברוב חבריה לפחות, לאחר הליך שייקבע בחוק; (2) מחמת התנהגות שאינה הולמת את מעמדו כמבקר המדינה – ביום שבו החליטה הכנסת על כך, בהחלטה שהתקבלה ברוב של שלושה רבעים מחבריה לפחות, לאחר הליך שייקבע בחוק.

נבצר ממבקר המדינה למלא תפקידיו, ימונה ממלא מקום המבקר באופן ולתקופה כפי שייקבע בחוק.
