Conditions for granting an operating permit§

1.
(a)The control centre at the disposal of the applicant or with which the applicant has contracted, as referred to in section 16f(a)(3), satisfies all of the following:
(1)it is capable of maintaining, at all times, two-way telephone communication with the Israel Police, Magen David Adom and the National Fire and Rescue Authority and of acting in accordance with their instructions; communication with the Israel Police shall be by means of a dedicated telephone number;
(2)it is capable of maintaining communication, at all times, with the body coordinating traffic management and control in every area in which the applicant intends to conduct an experimental operation of an autonomous vehicle, if such a body exists;
(3)it contains a computing system capable of issuing instructions to an autonomous vehicle, including an instruction for a complete stop;
(4)with regard to cyber protection, the provisions of subsection (h) have been complied with in the autonomous vehicle that it intends to operate, in the control centre and in the communication between the control centre and the vehicle in respect of which an application for registration as an autonomous vehicle has been submitted;
(5)it is capable of conducting continuous cyber monitoring, at all times, of the autonomous vehicles it operates, connected to a cyber event monitoring, command and control centre (SOC – Security Operating Center) operated by the Ministry of Transport and Road Safety;
(6)its employees possess knowledge in the fields of vehicle systems, computer systems, communication systems and cyber protection enabling them to carry out the functions of a control centre pursuant to this Ordinance, to the satisfaction of the National Traffic Superintendent; the number of such employees shall be as required for the performance of these functions having regard to the number of autonomous vehicles to be operated by the applicant.
(b)A computing system capable of collecting and retaining the information that the permit holder is required to collect and retain pursuant to section 3 is at the disposal of the applicant.
(c)The applicant has presented documentation and documents to the satisfaction of the National Traffic Superintendent, detailing the technological means at its disposal and the professional knowledge, training and education of the employees it employs and the manner of calculating the number and types of employees required, all as required for the purpose of complying with the requirements of subsection (a).
(d)The applicant is capable of identifying a cyber attack and reporting it pursuant to section 3 to the National Traffic Superintendent.
(e)The applicant is capable of operating a service centre for passengers of the autonomous vehicle that can be contacted during the journey and also before or after it.
(f)The applicant shall submit an operational plan in the manner directed by the National Traffic Superintendent, which shall include, inter alia, the following, and such additional particulars as the Superintendent may direct:
(1)the number of autonomous vehicles to be operated by the applicant, and if the applicant intends to change that number during the permit period – the applicant shall detail the anticipated dates of changes known to it at the time of submitting the application and the number of autonomous vehicles it will operate following each change;
(2)particulars of the autonomous vehicles to be operated, including the standards requirements they meet, the manner of connecting the autonomous driving system to the autonomous vehicle, the performance of the autonomous driving system, the operational domain of the autonomous vehicle, the safety concept and the cyber protection measures installed in the vehicle;
(3)particulars of the systems for collection and retention of data by the autonomous vehicle and data protection;
(4)a detailed description of possible failure modes of the autonomous driving system it operates that may cause a serious safety incident or a breach of a provision pursuant to this Ordinance with regard to road behaviour, a document it has prepared for the assessment of the risk posed by such situations and the measures to be taken to manage them;
(5)a detailed description of the means installed in the autonomous vehicle ensuring that it will comply with the instructions of any person lawfully authorised to give instructions to a road user, and the autonomous vehicle's responses to the movement of a security vehicle in its vicinity; in this paragraph, "security vehicle" – as defined in the Traffic Regulations;
(6)a detailed description of the means installed in the vehicle for the purpose of ensuring the safety of passengers in the autonomous vehicle and for enabling them to make contact with the control centre, behavioural instructions for passengers in an emergency, and the manner of informing passengers of the existence of those means and of their use;
(7)particulars of a passenger service centre for passengers of the autonomous vehicle and the manner of informing passengers of its existence and of the means for contacting it.
(g)The applicant has demonstrated that it is capable of ensuring all of the following:
(1)regular updating of the computerised systems of the autonomous vehicle, including software updates;
(2)maintenance and security of the autonomous vehicle and its systems by means of a garage holding a licence to operate a garage pursuant to the Vehicle Industry Services and Occupations Licensing Law, 5776-2016, provided that the computing systems of such a garage shall not diminish the cyber protection of the autonomous vehicle pursuant to subsection (h).
(h)The applicant has furnished to the National Traffic Superintendent one or more of the following documents, as the Superintendent may direct, and their content has satisfied the Superintendent with regard to cyber protection of the control centre, the autonomous vehicle and its systems and the communication between them:
(1)documents detailing the cyber protection management system of the vehicle, the autonomous driving system, the means of secured two-way communication between the control centre and the autonomous vehicle, and their suitability for providing a cyber protection response against the threat mapping carried out by the National Traffic Superintendent, in accordance with individual risk management, subject to the provisions of this Schedule;
(2)results of theoretical tests and practical tests in the technical and procedural aspects, in order to demonstrate the implementation of the protection requirements for the systems as directed by the National Traffic Superintendent and to discover breaches in the protection of those systems notwithstanding the implementation of the defined requirements, including vulnerability assessment tests and penetration tests;
(3)high-level design documents for all the computing equipment and electronic equipment of the system and its components required for conducting tests as referred to in paragraph (2), including all implemented cyber controls;
(4)threat analysis documents;
(5)risk management documents;
(6)a detailed description of compensating solutions for possible breaches in the protection of the vehicle, the autonomous driving system, the control centre systems and the communication between all of these.

Conditions for granting a vehicle licence for an autonomous vehicle§

2.
(a)The applicant has demonstrated the capability of the driving system installed in it to be an autonomous driving system by means of documentation from the system's manufacturer as the licensing authority shall require of it.
(b)The applicant has demonstrated, by means of an inspection report on the autonomous vehicle by a laboratory approved by the licensing authority and a practical driving test on the road by a driving examiner, the capability of the autonomous vehicle to satisfy all of the following:
(1)to comply with the provisions of the Traffic Regulations applicable to an autonomous vehicle, including instructions given by a traffic sign, by a police officer or by a person lawfully authorised to give instructions to a road user regarding their conduct on the road, including with regard to the provisions of regulations 22 and 23 of the Traffic Regulations, as if the autonomous vehicle were a road user;
(2)to avoid causing a road accident likely to cause harm to a person or to property that is foreseeable and can reasonably be prevented;
(3)to integrate into traffic in a manner that does not impair its flow;
(4)to identify the boundary of the operational domain;
(5)to transition to a minimal risk condition in any case where the autonomous driving system is unable to continue driving the vehicle, including bringing the vehicle to a stop, while establishing secured automatic communication with the control centre;
(6)while in a minimal risk condition, to transmit to the control centre data required by it for the purpose of issuing instructions regarding the manner of continuing to drive or refraining from driving, and to drive the autonomous vehicle in accordance with the instructions of the control centre, unless those instructions would endanger road users.
(c)The autonomous vehicle has the capability to record data regarding its operation, as required pursuant to the Ordinance and this Schedule, and to retain it.
(d)With regard to cyber protection, the vehicle meets the cyber protection requirements set out in European Union regulation UNECE wp29 or in international standard ISO/SAE 21434, or the provisions of section 1(h) have been complied with in it and in the communication equipment between it and the control centre.

Duties of the holder of an operating permit§

3.
(a)To operate a computing system and means for retaining information located in Israel, or in another country approved by the National Traffic Superintendent and subject to the conditions of the approval, which carry out documentation, in Hebrew or in English, of the operation of each autonomous vehicle included in the operating permit and retain it, including –
(1)the times of the commencement and cessation of the operation of each autonomous vehicle, the giving of an instruction to change the mode of operation of the vehicle or the transition of a vehicle to a minimal risk condition, whether on the initiative of the autonomous driving system or on the initiative of the control centre;
(2)documentation of road accident data in which the autonomous vehicle was involved, collected by the autonomous vehicle's sensors and cameras and the retention thereof, including a period of time before and after the accident, as the National Traffic Superintendent may direct;
(3)documentation of failure events in the operation of an autonomous vehicle that caused or were likely to cause a serious safety incident or a breach of a provision pursuant to this Ordinance with regard to road behaviour;
(4)documentation of events in which the autonomous vehicle transitioned to a minimal risk condition;
(5)actions taken on behalf of the holder of the operating permit to address malfunctions in the operation of an autonomous vehicle, including identification of the autonomous vehicle that was treated as aforesaid, the date of their performance, the place at which they were performed, the nature of the malfunctions addressed and the manner in which they were addressed.
(b)To update the regional traffic management centre, if one exists, and the public transport management centre in the area included in the operating permit or its vicinity, if an autonomous vehicle it operates was involved in an incident likely to have a material effect on the flow of traffic in that area.
(c)To implement an Automotive Cyber Security Management System (CSMS) and defensive control applications, which shall meet the requirements that the National Traffic Superintendent has directed it to comply with.
(d)To establish a procedure for handling cyber incidents in real time (Incident response).
(e)To report to the National Traffic Superintendent on a cyber attack within six hours of its discovery, and if the said attack was likely to create a risk to human life – immediately.
(f)To comply, in real time, by means of the control centre, with the instructions of a police officer relating to the journey of the autonomous vehicle given in accordance with the officer's lawful powers.
(g)To submit to the National Traffic Superintendent, by digital means, the following reports:
(1)a periodic report, once every three months, within two weeks of their conclusion, which shall include, inter alia, the particulars detailed below, as well as any other item of information that the National Traffic Superintendent has directed, provided that it shall not include information enabling the identification of passengers in the autonomous vehicle or any other person:
(a)the number of passengers in the autonomous vehicles it operates and its breakdown by time of journey, the occupancy rate of each vehicle, and any other quantitative breakdown requested by the National Traffic Superintendent; for this purpose, "occupancy rate" – the total passenger-hours travelled in the autonomous vehicle it operated in a given period, divided by the total hours of travel of the said vehicles in that same period;
(b)the total mileage of the autonomous vehicles it operates, the average mileage per vehicle, and a breakdown of frequent pick-up and drop-off points;
(c)the total number of passengers registered with the holder of the operating permit for the purpose of the possibility of travelling in the autonomous vehicle;
(d)a list of serious safety incidents that occurred and breaches of the Traffic Regulations with regard to road behaviour, and their dates;
(e)a detailed description of exceptional incidents that occurred during journeys involving passengers in an autonomous vehicle, and the manner of handling those incidents;
(2)an initial summary report regarding the entire period of the operating permit, three months before the expiry of the operating permit period, and a final summary report within three months of the expiry of the operating permit period; the summary reports shall be submitted whether or not the operating permit has been renewed for an additional period, and shall include the particulars detailed below, with regard to the entire period of operation:
(a)a summary of the data referred to in paragraph (1), for the entire period of validity of the permit, and an analysis of trends of change therein during that period;
(b)the average and median travel distance, the average and median travel duration, and an analysis of trends of change therein, with regard to the period of validity of the operating permit;
(c)additional information that the National Traffic Superintendent may direct following receipt of the initial summary report.
(h)Notwithstanding the provisions of subsection (g), the National Traffic Superintendent may, by a reasoned decision in writing, exempt the holder of an operating permit from the reporting obligation in respect of one or more of the particulars listed in that subsection, for a period or permanently, if the Superintendent considers that there is a technological impediment to collecting that particular for the purpose of the report.

Safety incident§

4.
(a)A report on a safety incident shall be transmitted by digital means and shall include the vehicle's movement characteristics, such as direction and speed, deficiencies or malfunctions in the operation of each of the autonomous vehicle's systems, details of the software version that was installed in the autonomous vehicle and any other information that the National Traffic Superintendent has directed in advance or with regard to a specific safety incident.
(b)If the safety incident involved a cyber attack or if it gives rise to a suspicion of such an attack, the holder of the operating permit shall indicate this in the report referred to in subsection (a).
