Chapter IX: Miscellaneous

78.§

(Repealed — תיקון מס' 44, 1997)

Exemption from Application or Application with Adaptations in Respect of a Vehicle with Conditional Autonomy§

78a.
(a)In this section –

"experiment", in respect of a vehicle with conditional autonomy – the use of new technology or a new use of existing technology, in the operation of a vehicle with conditional autonomy, for the purpose of examining the manner of its functioning on a road;

"vehicle with conditional autonomy" – a motor vehicle in which a hardware and software system is installed that is capable, independently, of performing some of the operations required for driving the vehicle.

(b)The Minister may, in order to enable the operation of a vehicle with conditional autonomy for the purpose of an experiment, in the presence of a holder of a driving licence sitting in the driver's seat or in any other seat in the vehicle from which all driving operations can be performed, prescribe in Regulations that a provision among the provisions under this Ordinance, in whole or in part, applicable in respect of a motor vehicle, the owner of such a vehicle or the driving thereof, shall not apply in respect of such a vehicle, or that it shall apply with adaptations as the Minister shall prescribe, and the Minister may make the exemption from application or the adaptations conditional on conditions or prescribe provisions that shall apply in place of the provision in respect of which such an exemption has been granted.
(c)The National Traffic Superintendent may, after consulting with the head of the Traffic Division of the Israel Police, if the National Traffic Superintendent finds that it is required for the purpose of carrying out an experiment with a vehicle with conditional autonomy by a particular experiment conductor, instruct the experiment conductor that in respect of such a vehicle, the experiment conductor or the operation of such a vehicle, a provision among the provisions listed in the Fifteenth Schedule shall also not apply, in addition to the provisions prescribed in Regulations pursuant to paragraph (1), or that a provision listed in the Fifteenth Schedule shall apply with adaptations as the National Traffic Superintendent shall prescribe, and the National Traffic Superintendent may make the exemption from application or the adaptations conditional on conditions or prescribe provisions that shall apply in place of the provision in respect of which such an exemption has been granted.
(d)Notice of the grant of an exemption as referred to in subsection (c) shall be provided to the head of the Traffic Division of the Israel Police.
(e)The provisions of section 16p shall apply, mutatis mutandis, to instructions that the National Traffic Superintendent shall give pursuant to subsection (c).

Share of Local Authority in Fees§

79.

The Minister and the Minister of Finance may allocate to the councils of municipalities and of local councils a share of the fees paid for a vehicle licence; the rate of the share shall be determined by the Ministers by Order, and it is permissible to provide in the Order that the allocated amounts, in whole or in part, shall serve for the implementation of this Ordinance or for the improvement of traffic conditions.

Agreement with Neighbouring Governments§

80.

The Minister may enter into an agreement with the government of any neighbouring country regarding the registration of public and commercial vehicles registered in that country and brought into Israel for a specified period, and may in such an agreement direct that the fees prescribed under this Ordinance be increased or reduced or that an exemption or reduction from all or part of them be granted.

Application to State Service§

81.

This Ordinance shall apply to vehicles and to persons in the service of the State, unless there is an express provision to the contrary.

Disclosure of Information from a Database§

82.

The licensing authority may disclose to the bodies listed in the Fifth Schedule particulars of information from a database as defined in the Privacy Protection Law, 5741-1981, managed by it, as detailed in the Fifth Schedule.

Disclosure of Information Regarding Road Accidents§

83.
(a)
(1)Where a road accident has occurred in which a person was killed or seriously injured, the Police shall make available to the Director of the National Road Safety Authority or to the Director's representative, within 24 hours from the time the Police first became aware of the occurrence of the accident, the particulars of information as detailed in the Sixth Schedule, to the extent that such information is in the Police's possession at that time; the Police shall complete the making available of the information within 24 hours from the time the additional information came into the Police's possession;
(2)The Minister, with the consent of the Minister for Public Security, may, by Order, amend the Sixth Schedule.
(b)The Director of the National Road Safety Authority shall not use information received as aforesaid except for the purpose of performing the Director's functions, but the Director may disclose such information to an inquiry and investigation committee appointed pursuant to section 76a.

Supplement to Fee for the Israeli Broadcasting Corporation (Amendment No. 39) 5756-1996 (Amendment No. 57) 5763-2003 (Amendment No. 112) 5774-2014 Notice 5786-2026§

84.
(a)A vehicle licence fee for a motor vehicle, excluding a three-wheeled motorcycle and a motorcycle with a sidecar or with a trailer or without them, or its renewal, the amount of which is prescribed in Regulations under this Ordinance (hereinafter – licence fee), shall be increased, commencing on the 12th of Nisan 5756 (1 April 1996), by an amount of NIS 135 (hereinafter – the additional amount).
(b)Each additional amount shall be collected on behalf of the Israeli Broadcasting Corporation and transferred to it.
(c)The additional amount shall be reduced, on 1 April of each year commencing in 2004, by 5%, and shall be updated on that same date in accordance with the rate of change in the Consumer Price Index published by the Central Bureau of Statistics that was known on 1 January of that year, compared with that which was known on 1 January of the preceding year, and shall be rounded to the nearest new shekel.
(c1)Notwithstanding the provisions of the opening passage of subsection (c) and without derogating from the updating provision set out in the closing passage of that subsection –
(1)during the period from the 25th of Adar Bet 5768 (1 April 2008) until the 25th of Adar Bet 5771 (31 March 2011), the additional amount shall not be reduced;
(1a)on 1 April of each of the years 2013 to 2018, the additional amount shall be increased by nine new shekels; the addition to the additional amount pursuant to this paragraph shall also be updated in accordance with the provisions of the closing passage of subsection (c);
(2)(Repealed);
(3)(Repealed).
(c2)(Repealed).
(d)The Director General of the Ministry of Transport shall publish in Reshumot (Official Gazette) a notice of the additional amount, as updated pursuant to subsections (c) and (c1).

Third Schedule (section 12a)

The traffic offences listed below, including traffic offences that constitute traffic violations:

(1)An offence under sections 10, 43, 44 or 65 of this Ordinance.
(2)An offence under regulation 22 of the Traffic Regulations in respect of failure by a vehicle driver to comply with a traffic light and failure to yield the right of way, an offence under regulations 26(2), 47, 54 or 57 of those Regulations, and an offence under regulation 144 of those Regulations in respect of failure to report a road accident or failure to render assistance to a road accident victim.
(3)An offence under this Ordinance or the Regulations thereunder that caused a road accident in which a person was injured.
(4)An offence for which the court sentenced the person who committed it to an actual disqualification from holding a driving licence for a period of three months or more.
