Tisha B'Av§

1.

Tisha B'Av is a day of mourning for the Jewish people for the destruction of the Temple.

Commencement and Conclusion of the Day of Mourning§

The day of mourning commences at sunset and concludes at nightfall on the following day; where Tisha B'Av falls on the Sabbath, the day of mourning shall be observed on the following Sunday.

Prohibition of Public Entertainment§

3.
(a)Notwithstanding the provisions of any law, a local authority shall be empowered to enact a by-law prohibiting the holding of public entertainment on the day of mourning, or the opening of eating establishments on the eve of the day of mourning, from the commencement of the mourning until sunrise on the following day.
(b)For the purposes of this section —

"public entertainment" — as defined in the Business Licensing Law, 5728-1968, in section 3(b);

"eating establishments" — including coffee houses, restaurants, tea houses, taverns, canteens and other similar institutions, as the case may be, within the meaning of paragraph (20) of section 249 of the Municipal Corporations Ordinance.

Application of the Prohibition§

4.

A local authority may impose a prohibition as referred to in section 3 on its entire area of jurisdiction or on a specific part thereof, provided that it shall apply to the entire population in that area or in that part thereof.

Implementation§

5.

A local authority may authorise inspectors for the purpose of implementing the provisions of this Law.

Penalties§

6.

The penalty of a person who contravenes a by-law enacted under this Law shall be the same as the penalty of a person who contravenes a by-law enacted under the Municipal Corporations Ordinance or under the Local Councils Ordinance, as the case may be.

Competent Court§

7.

The Local Affairs Court is competent to hear offences under this Law.

Transitional Provision§

8.

A by-law dealing with prohibitions applying on Tisha B'Av, enacted by a local authority before the commencement of this Law, which would have been lawfully made had this Law been in force at that time, shall be deemed, from the date of commencement of this Law, to have been enacted under it.

Amendment of the Municipal Corporations Ordinance – No. 64§

9.

In the Municipal Corporations Ordinance, in section 249, in paragraph (21), after "which in religious tradition" there shall come "and with respect to Tisha B'Av", and at the end thereof there shall come "Tisha B'Av" — within the meaning of the Prohibition of Opening Places of Entertainment on Tisha B'Av (Special Authorisation) Law, 5758-1997.
