Chapter I: Purposes of the Law and Their Implementation

Purposes§

1.

The purposes of this Law are to mark the memory of Maran Rabbi Ovadia Yosef zt"l, the most senior Sephardi rabbi of his generation, who served as the Sephardi Chief Rabbi (Rishon LeZion), to transmit to future generations his vision, heritage and contribution to the unity of Israel, and to bring about the education of coming generations in the spirit of his work and rulings, which champion the attribute of loving-kindness.

Implementation of the Purposes§

2.

The purposes of this Law shall be implemented by way of holding Maran Rabbi Ovadia Yosef Day, conducting educational-values activities, awarding scholarships and providing support to public institutions that act to fulfil the purposes of this Law, all in accordance with its provisions.

Chapter II: The Public Council

Public Council§

3.
(a)The Minister for Religious Services (in this Law – the Minister) shall appoint a public council for the commemoration of the memory of Maran Rabbi Ovadia Yosef (in this Law – the Public Council); the following are the members of the Council:
(1)four members who are State employees and who shall serve as representatives of the Government, among them an employee of the Ministry of Education to be selected with the consent of the Minister of Education, an employee of the Ministry of Culture and Sport to be selected with the consent of the Minister of Culture and Sport, an employee of the Ministry for Religious Services and one additional State employee to be selected by the Minister, provided that if the additional State employee is not an employee of the Ministry for Religious Services, that person shall be selected after consultation with the Minister responsible for that ministry;
(2)a representative of the Chief Rabbinate of Israel within the meaning of the Chief Rabbinate of Israel Law, 5740-1980, to be selected from among the employees of the Chief Rabbinate of Israel or from among the members of the Council of the Chief Rabbinate of Israel within the meaning of that Law, all after consultation with the Council of the Chief Rabbinate of Israel;
(3)four public representatives who are neither State employees nor employees of a local authority, who possess significant knowledge, expertise, experience or education in connection with the work, heritage or commemoration of Maran Rabbi Ovadia Yosef;
(4)two representatives of the Jerusalem Municipality on the recommendation of the Mayor, the authority to appoint whom shall commence after the establishment of the Commemoration Centre pursuant to Section 15.
(b)The Minister, with the approval of the Public Council, shall appoint the chairperson of the Council from among the members of the Public Council; the Public Council, with the approval of the Minister, shall appoint the deputy chairperson from among its members.
(c)At least four of the members of the Council listed in subsection (a)(1) to (3) shall be women; at least one of the members of the Council listed in subsection (a)(4) shall be a woman.

Functions of the Public Council§

4.

The functions of the Public Council are:

(1)to advise the Minister on all matters relating to the implementation and execution of this Law and to monitor the execution of the Law;
(2)to recommend to the Minister policy and objectives with respect to the activity under this Law;
(3)to advise the Minister with respect to the determination of criteria for the support of public institutions as referred to in section 3a of the Budget Foundations Law, 5745-1985 (in this Law – the Budget Foundations Law), for the purpose of advancing the purposes of this Law; support criteria under this paragraph shall be determined having regard to general support criteria for the commemoration of Chief Rabbis of Israel, if any exist, provided that the support criteria shall not permit the duplication of support to a public institution.

Application of Laws§

5.

Members of the Public Council who are not State employees shall, in their actions as members of the Council, be treated as State employees for the purposes of the following enactments and in respect of their actions on the Council:

(1)Public Service (Gifts) Law, 5740-1980;
(2)Knesset Elections Law [Consolidated Version], 5729-1969;
(3)State Service (Restriction of Party Activity and Collection of Funds) Law, 5719-1959 – the provisions applicable to all State employees;
(4)Public Service (Restrictions after Retirement) Law, 5729-1969;
(5)Penal Law, 5737-1977 – the provisions relating to public employees.

Procedures of the Council§

6.
(a)The Public Council shall convene at least twice a year, and also at the request of at least half of its members.
(b)The chairperson of the Public Council shall conduct its meetings; the chairperson shall convene the meetings of the Public Council and shall determine their dates, locations and agendas, having regard, inter alia, to the proposals of the Minister and the members of the Public Council.
(c)The Public Council shall determine its own procedures to the extent that they have not been determined pursuant to this Law.
(d)The quorum at meetings of the Council is a majority of its members, including the chairperson of the Council; decisions of the Council shall be adopted by a majority of votes of the members of the Council participating in the vote; in the event of a tie, the chairperson of the Council shall have the casting vote.
(e)In the absence of the chairperson of the Council, the permanent deputy chairperson shall take the chairperson's place for all purposes under this Law.

Remuneration and Reimbursement of Expenses§

7.

Members of the Public Council shall not be entitled to remuneration for their membership of the Council, but a member of the Public Council who is not a State employee, an employee of a budgeted body or an employee of a supported body shall be entitled to payment from the Ministry for Religious Services for participation in meetings of the Council in accordance with the directives of the Accountant General of the Ministry of Finance applicable to public committees; in this Section, "State employee", "employee of a budgeted body" and "employee of a supported body" have the meanings assigned to them in section 32 of the Budget Foundations Law.

Term of Office, Expiry of Office and Removal from Office§

8.
(a)The term of office of a member of the Public Council shall be four years, and the member may be reappointed for additional terms of office.
(b)Notwithstanding the provisions of subsection (a), with respect to a member of the Public Council appointed pursuant to section 3(a)(3) or (4), the member may be reappointed for one additional term of office, and after a break of four years may be reappointed for one further term of office only; however, the Minister may appoint at most two members of the Council appointed pursuant to section 3(a)(3) for additional terms of office, each not exceeding four years, without a break between them, if the Minister is satisfied that this is justified in light of their expertise and unique contribution to the Public Council and to the fulfilment of the purposes of this Law, provided that a member of the Council as aforesaid shall not serve for more than four terms of office.
(c)A person who has been convicted of a criminal offence or a disciplinary offence which, by reason of its nature, gravity or circumstances, renders that person unfit to serve as a member of the Council shall not be appointed as a member of the Public Council; with respect to a criminal offence, provided that criminal information in respect of which the expungement period within the meaning of section 21 of the Criminal Information and Rehabilitation of Offenders Law, 5779-2019 has elapsed at the date of appointment shall not be taken into account.
(d)A member of the Public Council shall cease to hold office before the expiry of the member's term of office upon the occurrence of any of the following:
(1)the member resigned by delivering a letter of resignation to the Minister;
(2)the member ceased to be an employee of the Government ministry or a representative of the body that the member represents on the Public Council, and if the member is a public representative – the member was appointed as a State employee or as an employee or council member of a body represented on the Public Council.
(e)If any of the circumstances set out below obtains with respect to a member of the Public Council, the Minister shall remove the member from office before the expiry of the term of office and as soon as possible after the occurrence of the circumstance, by written notice:
(1)the member was convicted of a criminal offence or a disciplinary offence which, by reason of its nature, gravity or circumstances, renders the member unfit to serve as a member of the Public Council as referred to in the provisions of subsection (c);
(2)a condition required for the member's service as a member of the Public Council has ceased to be satisfied;
(3)the member is permanently incapacitated from fulfilling the member's duties.
(f)The Minister, after consulting the chairperson of the Public Council, may remove a member of the Public Council from office before the expiry of the member's term of office upon the occurrence of any of the following:
(1)the member was absent without reasonable cause from three consecutive meetings of the Public Council;
(2)an indictment or a complaint has been filed against the member in respect of an offence as referred to in subsection (c) and a final judgment in the member's matter has not yet been given.
(g)The Minister shall not terminate the office of a member of the Public Council pursuant to subsections (e) or (f) unless the member has been given an opportunity to present arguments in that regard.
(h)Where a member of the Public Council has ceased to hold office pursuant to the provisions of this Section, the Minister shall act to appoint another member in the member's place as soon as possible.

Conflict of Interests§

9.
(a)In this Section –

"family member" – spouse, parent, grandparent, son or daughter and their spouses, brother or sister and their children, brother-in-law or sister-in-law, uncle or aunt and their children, father-in-law or mother-in-law, grandchild, including a relative as aforesaid who is a step-relative;

"interested party" – as defined in the Securities Law, 5728-1968;

"handling" – including making a decision, raising a matter for discussion, being present at a discussion, participating in a discussion or in a vote, or dealing with a matter outside a discussion;

"conflict of interests", of a member of the Public Council – a conflict of interests between the fulfilment of the member's duties on the Council and a personal interest or another role, of the member or of the member's associate;

"associate", of a member of the Public Council – any of the following:

(1)a family member of the member of the Public Council;
(2)a person in whose financial position the member of the Public Council has an interest;
(3)a corporation in which the member of the Public Council, a family member of the member, or a person as referred to in paragraph (2) is an interested party;
(4)a body in which the member of the Public Council, a family member of the member, or a person as referred to in paragraph (2) is a manager or responsible employee.
(b)A person shall not be appointed as a member of the Public Council and shall not serve as such a member if, by reason of the membership, the person would regularly find themselves in a situation of conflict of interests that would prevent the person from fulfilling the main part of the member's duties on the Public Council.
(c)A member of the Public Council shall not handle, in the framework of the member's duties, a matter the handling of which would cause the member to be in a situation of conflict of interests.
(d)If a member of the Public Council becomes aware that the member may find themselves in a situation of conflict of interests as referred to in subsections (b) or (c), the member shall notify the chairperson of the Public Council as soon as possible; if the said member of the Public Council is the chairperson, the member shall notify the Minister.
(e)Notwithstanding the provisions of this Section, a member of the Public Council appointed pursuant to section 3(a)(4) may take into account also the interests of the body that the member represents, insofar as they are connected to the functions of the Public Council, and the member shall not be regarded as being in a situation of conflict of interests by reason of that alone.

Validity of Actions§

10.

The existence of the Public Council, its powers and the validity of its decisions and actions shall not be affected by the termination of the office of a member of the Public Council or by reason of a defect in the appointment or the continuation of the term of office of a member of the Public Council, provided that a majority of its members are serving.

Chapter III: Maran Rabbi Ovadia Yosef Day

Maran Rabbi Ovadia Yosef Day§

11.
(a)Once a year, on the 3rd of Cheshvan, the day of the passing of Maran Rabbi Ovadia Yosef, Maran Rabbi Ovadia Yosef Day shall be held; if the 3rd of Cheshvan falls on a Saturday, Maran Rabbi Ovadia Yosef Day shall be held on the following Sunday.
(b)The Ministry for Religious Services shall hold, on Maran Rabbi Ovadia Yosef Day or on a date close thereto, a study conference in his memory, at which topics from his world of thought and in the spirit of his vision shall be discussed.
(c)The Knesset shall hold a special debate to mark Maran Rabbi Ovadia Yosef Day on the date referred to in subsection (a) or on a date close thereto.

Chapter IV: Educational-Values Activities and Scholarships

Educational-Values Activities§

12.
(a)State institutions, other than educational institutions, shall hold educational-values activities to advance the purposes of this Law, including the holding of ceremonies, on Maran Rabbi Ovadia Yosef Day or in the week following it, as shall be determined by the Ministers concerned.
(b)In educational institutions, time shall be dedicated to study and to the holding of educational-values activities to advance the purposes of this Law, to the extent that the Minister of Education so decides.

Scholarships§

13.

The Ministry for Religious Services may allocate scholarships for the purpose of research on topics connected to the work and vision of Maran Rabbi Ovadia Yosef, in accordance with rules to be prescribed by the Minister, provided that no duplication of support shall be granted for the same activity or the same study hours.

Chapter V: Budget, Support and Establishment of a Commemoration Centre

Budget and Support§

14.
(a)The participation of the State Treasury in the operation of this Law, including the scholarship budget pursuant to Section 13 and the budget for support of public institutions pursuant to subsection (b), shall be determined in the annual budget law within the meaning of the Budget Foundations Law.
(b)The provision of support under this Law shall be made in accordance with criteria for the support of public institutions as referred to in section 4(3), to be determined by the Minister after consulting the Public Council, having regard to general support criteria for the commemoration of Chief Rabbis of Israel, if any exist, provided that the duplication of support to a public institution shall not be permitted.

Establishment of a Commemoration Centre§

15.
(a)Subject to the provisions of any law, the Jerusalem Municipality may establish within its territory a municipal corporation within the meaning of section 249a of the Municipalities Ordinance, which shall serve as a centre for the commemoration of the heritage and work of Maran Rabbi Ovadia Yosef; the Centre shall be open to the public and shall act to fulfil the purposes of this Law.
(b)The Centre shall be an audited body within the meaning of the State Comptroller Law, 5718-1958 [Consolidated Version].
(c)The establishment of the Centre, its maintenance and its ongoing activity shall be financed, inter alia, from donations and other revenues of the Centre.
