142.
(a)The following are liable to imprisonment of one year:

(2)a flight crew member who performed their function when there had been a change in their state of health that may impair their ability to perform their function, contrary to the provisions of section 6(a)(2);

(45)a person who operated in Israeli territory an aircraft that is not registered in the State of Israel or in a member state and is not an aircraft of a foreign state within the meaning of section 175, without the Director's approval or not in accordance with its conditions, contrary to the provisions of section 174(a);
(46)a person who operated in Israeli territory an aircraft of a foreign state within the meaning of section 175, without the approval of the competent authority as defined in that section or not in accordance with the conditions of the approval, contrary to the provisions of that section;

(b)The following are liable to imprisonment of three years:
(1)a person who performed an act requiring licensing under sections 2, 13, 17, 21, 26, 31, 35, 52, 87 or 88, without a licence, contrary to the provisions of those sections;
(2)a person who transmitted from an aviation aid installation, from an aircraft, from an aerodrome or from a landing site otherwise than for the purpose for which such transmission is intended, in a manner that may endanger flight safety, contrary to provisions under sections 33, 35 and 72;
(3)a person who caused damage to an aviation aid installation, or disturbed signals transmitted from such an installation, contrary to the provisions of section 36;
(4)a flight crew member whose licence was suspended or revoked and who made use of a licence of the same type granted by an authority competent to do so in a member state, contrary to the provisions of section 41;
(5)a person who handed over dangerous goods for carriage on an aircraft, received dangerous goods for such carriage or carried them, contrary to the provisions of section 74(a) and (b), breached an obligation applying to that person under section 74(c)(2) or carried dangerous goods on an aircraft whose carriage was prohibited under section 74(c)(4);
(6)a person who breached the duty of confidentiality imposed on them under section 125, contrary to the provisions of that section;
(6a)a person who operated a foreign aircraft in Israeli territory, in commercial operation, without a licence equivalent to an air operator licence or the operations specifications associated therewith, contrary to the provisions of section 173(a1)(5);
(6b)a person who operated a foreign aircraft carrying dangerous goods in Israeli territory, contrary to the conditions prescribed in the operations specifications associated with the licence equivalent to an air operator licence, contrary to the provisions of section 173(a1)(5); for this purpose, "dangerous goods" – dangerous goods to which Annex 18 to the Convention applies;
(7)(Repealed)
(c)The following are liable to imprisonment of five years:
(1)a person on an aircraft who interfered with a crew member in the performance of their function, participated in a brawl on the aircraft, rioted on it or committed an act that harms the aircraft or aviation equipment on it, contrary to the provisions of section 77(b), in a manner that may endanger the safety of the aircraft or of persons on it;
(2)a flight crew member, crew member, operator of a gliding craft who holds a training or commercial operation licence under section 87, or an operator of a gliding craft of a type whose operation requires a licence under section 88, who drank an intoxicating beverage while performing their function or performed their function while under the influence of alcohol, or after drinking an intoxicating beverage before the period of time prescribed by the Minister has elapsed, or when a dangerous drug or a metabolite of a dangerous drug is present in their body, contrary to the provisions of sections 8 or 89, as the case may be.
(d)
(1)A person who unlawfully influences or attempts to influence the Director of the Safety Investigation Authority, a deputy of the Director or an investigator appointed under section 115, in connection with the conduct of a safety investigation under Chapter VII, is liable to imprisonment of one year; however, supplying information to the Director of the Safety Investigation Authority, to a deputy of the Director or to an investigator as aforesaid, or drawing their attention to a matter connected with the conduct of the investigation, is not an offence under this paragraph;
(2)A person who does anything with intent to prevent or frustrate a safety investigation under Chapter VII, whether by neutralising the summoning of a witness, by concealing evidence or in any other way, is liable to imprisonment of one year.

Liability of an office holder in a corporation§

143.
(a)An office holder in a corporation is required to supervise and to do everything possible to prevent offences under section 142, other than offences of employees of the corporation under section 142(b)(6), by the corporation or by any of its employees; a person who contravenes this provision is liable to a fine as referred to in section 61(a)(2) of the Penal Law, 5737-1977; for the purposes of this section, "office holder" – an active manager in a corporation, a partner other than a limited partner, or another person holding a position in the corporation who is responsible on behalf of the corporation for the area in which the offence was committed.
(b)Where an offence under section 142, other than an offence of an employee of the corporation under section 142(b)(6), was committed by a corporation or by any of its employees, it shall be presumed that an office holder in the corporation has breached their duty under subsection (a), unless the office holder proves that they did everything possible to fulfil their duty.

Chapter X: Financial Sanction

Section A: Violations

Definitions – Section A of Chapter X§
144.

In this Section –

"own-use charter flight" – a flight in which the holder of an air operator licence charters the entire capacity of the aircraft for the charterer's own use;

"large aircraft" – an aircraft used for the carriage of passengers or goods whose maximum certificated take-off mass, according to the flight manual or another appropriate document within the meaning of section 63(b)(3), exceeds 5,700 kg, or a higher mass determined by the Minister, generally or for types of aircraft, to the extent so determined;

"medium aircraft" – an aircraft that is neither a large aircraft nor a small aircraft;

"small aircraft" – an aircraft whose maximum certificated take-off mass, according to the flight manual or another appropriate document within the meaning of section 63(b)(3), does not exceed 700 kg, or a higher mass determined by the Minister, generally or for types of aircraft, to the extent so determined;

"violator" – as defined in section 151;

"the base amount" – an amount as set out below, as the case may be:

(1)in respect of a flight crew member who is –
(a)a pilot of a large aircraft, an air traffic controller or a person authorised to instruct for the said functions – NIS 4,950;
(b)a person authorised to instruct for flight crew member functions and who is not a flight crew member as referred to in sub-paragraph (a) – NIS 2,480;
(c)a flight crew member who is not listed in sub-paragraphs (a) or (b) – NIS 1,240;
(2)in respect of a crew member on an Israeli aircraft who is not a flight crew member – NIS 1,240;
(3)in respect of a holder of a licence to operate a flight crew member school or a licence holder under Sections C to F of Chapter II, who provides training for flight crew member functions in accordance with a training programme approved by the Director under section 16 and who is authorised to instruct for flight crew member functions –
(a)in connection with a large aircraft – NIS 92,870;
(b)in connection with a medium aircraft – NIS 18,570;
(c)in connection with a small aircraft or in connection with the performance of maintenance operations requiring special equipment and knowledge as determined by the Minister under sections 3 and 24 – NIS 6,190;
(4)in respect of the holder of an air operator licence or the holder of a licence equivalent to an air operator licence granted by the state of the operator –
(a)who is authorised to operate aircraft for the carriage of passengers or cargo on an international flight that is not an own-use charter flight, and who operates aircraft in the following number:
(1)15 aircraft or more – NIS 123,830;
(2)fewer than 15 aircraft – NIS 92,870;
(b)who is authorised to operate aircraft in commercial operation other than operation as referred to in sub-paragraph (a) –
(1)in respect of a licence holder who operates at least one large aircraft, or at least seven medium aircraft – NIS 30,960;
(2)in respect of a licence holder who operates fewer than seven medium aircraft – NIS 15,480;
(c)who is authorised to operate small aircraft only – NIS 6,190;
(5)in respect of the holder of a maintenance organisation licence who is authorised to perform maintenance operations –
(a)on a large aircraft whose maximum certificated take-off mass is 200,000 kg or more – NIS 123,830;
(b)on a large aircraft whose maximum certificated take-off mass is 30,000 kg or more and does not exceed 200,000 kg – NIS 92,870;
(c)on a large aircraft whose maximum certificated take-off mass does not exceed 30,000 kg – NIS 30,960;
(d)on a medium aircraft or on an engine, propeller or aviation equipment of an aircraft that is not a small aircraft, or maintenance operations requiring special equipment and knowledge as determined by the Minister under section 24 – NIS 15,480;
(e)on a small aircraft, or on an engine, propeller or aviation equipment of such an aircraft – NIS 6,190;
(6)in respect of the holder of a licence to operate an ATC unit – NIS 123,830;
(7)in respect of the holder of a licence under Section F of Chapter II –
(a)to operate an aerodrome – NIS 123,830;
(b)to operate a landing site – NIS 12,380;
(8)in respect of the holder of a production licence who is authorised to produce –
(a)a large aircraft – NIS 123,830;
(b)a medium aircraft, or an engine or propeller of a large or medium aircraft – NIS 92,870;
(c)a small aircraft, or an engine or propeller of such an aircraft – NIS 30,960;
(d)aviation equipment, a part of an aircraft, or a part of an engine or propeller of an aircraft – NIS 6,190;
(9)in respect of an aerial operator in general operation or in commercial operation not requiring a licence as referred to in paragraph (4) –
(a)of a large aircraft – NIS 30,960;
(b)of a medium aircraft – NIS 6,190;
(c)of a small aircraft – NIS 1,240;
(10)in respect of an operator of a gliding craft who is –
(a)the holder of a licence to instruct in the operation of a gliding craft under section 87(a) or the holder of a licence to operate a gliding craft in commercial operation under section 87(b) – NIS 3,100;
(b)not listed in sub-paragraph (a) – NIS 1,240.
Provisions Regarding the Basic Amount§
145.
(a)The basic amount applicable to a violator, as specified in one of paragraphs (1) to (10) of the definition of "basic amount", shall be in accordance with the type of activity, licence or approval, as the case may be, within the framework of which the violation was committed, even if it is possible to classify it under more than one paragraph of the said definition.
(b)A violator who is the holder of a licence or approval as specified in paragraphs (1), (3), (4), (5), (7) or (8) of the definition of "basic amount", and who may be classified under more than one sub-paragraph of a paragraph as aforesaid, shall be subject to the higher basic amount among the amounts in the sub-paragraphs under which the violator may be classified.
(c)Notwithstanding the provisions of subsection (b), a violator who holds a flight crew member licence as referred to in paragraph (1)(b) of the definition of "basic amount" and also a licence as referred to in paragraph (1)(c) of that definition, and the violation was not committed in the course of performing the violator's function as an instructor, shall be subject to the basic amount referred to in the said paragraph (1)(c).
Financial Sanction in the Amount of Double the Basic Amount§
145a.

Where a person has performed an act requiring a licence under this Law without such a licence, as set out below, the Director may impose upon that person a financial sanction pursuant to the provisions of this Chapter, in an amount equal to double the basic amount applicable, pursuant to the definition of "basic amount" in section 144, to the holder of a licence of the same type, in respect of that act and in accordance with its characteristics:

(1)performed a function requiring a flight crew member licence without such a licence, contrary to the provisions of section 2;
(2)operated or managed a flight crew member school or conducted training for flight crew member positions therein without a licence therefor, contrary to the provisions of section 13;
(3)operated an aircraft in commercial operation requiring an aerial operating licence without such a licence, contrary to the provisions of section 17(a);
(4)operated or managed a maintenance organisation without a licence therefor, contrary to the provisions of section 21;
(5)operated or managed a unit providing ATC services without a licence therefor, contrary to the provisions of section 26;
(6)operated an aerodrome or landing site whose operation requires a licence, or permitted the take-off, landing or operation of aircraft thereat, without a licence therefor, contrary to the provisions of section 31;
(7)manufactured an aircraft as defined in section 49, a part of such aircraft or aeronautical equipment, requiring a manufacturing licence, without such a licence, contrary to the provisions of section 52;
(8)engaged in theoretical or practical training for the operation of gliding craft, or operated a gliding craft in commercial operation, without a licence therefor, contrary to the provisions of section 87;
(9)operated a foreign aircraft in Israeli territory in commercial operation requiring a licence from the operator's state equivalent to an aerial operating licence, without such an equivalent licence, contrary to the provisions of section 173(a1)(5).
Financial Sanction in the Amount of the Basic Amount§
146.

The Director may impose a financial sanction pursuant to the provisions of this Chapter in the amount of the basic amount, on each of the following:

(1)a flight crew member who performed a function that the flight crew member is not authorised to perform under the flight crew member's licence, contrary to the provisions of section 2;
(2)a flight crew member who performed the flight crew member's function without a valid medical certificate, contrary to the provisions of section 6(a)(1);
(3)a person who served as a crew member in the crew member's position on an Israeli aircraft operated in the territory of a member state, without approval from the competent authorities of that state, contrary to the provisions of section 10(b);
(4)the holder of a licence to operate a flight crew member school who violated a condition of the licence detailed in section 14(b) or (c)(1) to (5), or the holder of such a licence who conducted training for a flight crew member position not in accordance with the curriculum approved by the Director, contrary to the provisions of section 13;
(5)the holder of an aerial operating licence who violated a provision of the provisions set out in the operating specifications forming part of the licence, as detailed in section 18(b)(1) and (2), contrary to the provisions of section 17;
(6)the holder of a licence to operate a maintenance organisation who violated a condition of the licence detailed in section 22(b)(1) to (3), contrary to the provisions of section 21;
(7)a person who performed maintenance acts, contrary to the provisions of section 23(a);
(8)an aerial operator who received maintenance services for an aircraft or aeronautical equipment from a person not authorised to provide them pursuant to section 23(a), contrary to the provisions of section 23(b), except in circumstances as referred to in section 172(4)(a);
(9)the holder of a licence to operate an ATC unit who violated a condition of the licence detailed in section 27(b)(1) to (4), contrary to the provisions of section 26;
(10)the holder of a licence to operate an aerodrome or landing site who violated a condition of the licence detailed in section 32(b)(1) to (3), contrary to the provisions of section 31;
(11)a person who operated a flight aid installation not approved by the Director or by the Director of the Meteorological Service, with the consent of the Director, as the case may be, contrary to the provisions of section 35;
(12)the holder of a manufacturing licence who violated a condition of the licence detailed in section 53(c)(1) and (2), contrary to the provisions of section 52;
(13)an aerial operator who operated an aircraft without a valid airworthiness certificate in respect of it, contrary to the provisions of section 63(a);
(14)the holder of an aerial operating licence who transported dangerous goods on an aircraft not in accordance with the condition specified in the licence as referred to in section 74(a)(1), contrary to the provisions of that section;
(15)a person who operated an aircraft contrary to a Director's instruction issued to that person pursuant to section 79;
(16)the holder of a training licence to operate a gliding craft who conducted training for the operation of a gliding craft that the licence holder is not authorised to conduct under the licence, or who violated a condition of the licence, contrary to the provisions of section 87(a);
(17)the holder of a licence to operate a gliding craft in commercial operation who violated a condition of the licence, contrary to the provisions of section 87(b);
(18)the holder of a licence to operate a gliding craft of a type whose operation requires a licence pursuant to section 88, who violated a condition of the licence, contrary to the provisions of that section;
(19)an operator of a gliding craft upon whom the obligation to insure liability for bodily injury and property damage to a third party applies, in accordance with the provisions pursuant to section 91, who operated a gliding craft without such insurance, contrary to the provisions pursuant to that section;
(20)the holder of a licence under this Law upon whom the obligation to insure liability for bodily injury and property damage applies in accordance with the provisions pursuant to section 168(a)(6), who acted within the framework of the licence without such insurance, contrary to the provisions pursuant to that section;
(21)an aerial operator upon whom the obligation to insure liability for bodily injury and property damage applies in accordance with the provisions pursuant to section 168(a)(6), who operated an aircraft without such insurance, contrary to the provisions pursuant to that section;
(21a)a person who operated a foreign aircraft in Israeli territory without a valid certificate in respect of the aircraft equivalent to an airworthiness certificate, contrary to the provisions of section 173(a1)(3);
(21b)a person who operated a foreign aircraft in Israeli territory in commercial operation, contrary to the conditions set out in the licence equivalent to an aerial operating licence or in the operating specifications associated with it, contrary to the provisions of section 173(a1)(5);
(22)a person who operated in Israeli territory an aircraft not registered in the State of Israel or in a member state and which is not a foreign state aircraft within the meaning of section 175, without the Director's approval, contrary to the provisions of section 174(a).
Financial Sanction in the Amount of 50 Per Cent of the Basic Amount§
147.

The Director may impose a financial sanction pursuant to the provisions of this Chapter in an amount equal to 50 per cent of the basic amount, on each of the following:

(1)a flight crew member who made use of the licence without meeting the requirements of professional competence, proficiency, knowledge and experience applicable to the flight crew member under an obligation, restriction or condition applying to the flight crew member pursuant to section 9;
(2)the holder of a licence as referred to in section 11 who employed a person in a function as referred to in section 2 or assigned a flight crew member to the flight crew member's function, contrary to the provisions of section 11;
(3)a crew member who is not a flight crew member who violated an obligation applying to the crew member in the performance of the crew member's function pursuant to section 12;
(4)an aerial operator who violated an obligation regarding the training and instruction of crew members who are not flight crew members, applying to the aerial operator pursuant to section 12;
(5)the holder of a licence to operate a flight crew member school who violated an obligation applying to the licence holder pursuant to sections 15 or 46(a)(1) or (2);
(6)a person who received approval from the Director for a training programme for flight crew member positions pursuant to section 16, and who conducted training for flight crew member positions contrary to an obligation, restriction or condition applying to that person pursuant to section 16;
(7)the holder of an aerial operating licence who violated an obligation applying to the licence holder pursuant to sections 19(3) or 46(a)(1) or (2);
(8)a person who performs maintenance acts who violated an obligation applying to that person pursuant to section 24(1);
(9)the holder of a licence to operate a maintenance organisation who violated an obligation applying to the licence holder pursuant to sections 24(5) or 46(a)(1) or (2);
(10)the holder of a licence to operate an ATC unit who provided ATC services not on the basis of current aeronautical information or not in accordance with coordination procedures, contrary to the provisions of section 28, or who violated an obligation applying to the licence holder pursuant to sections 29(3) or 46(a)(1) or (2);
(11)the holder of a licence to operate an aerodrome or landing site who violated an obligation or provision applying to the licence holder pursuant to sections 33(1) to (9) or 46(a)(1) or (2);
(12)the holder of an approval to operate a flight aid installation pursuant to section 35, who installed, maintained or operated a flight aid installation not in accordance with the conditions of the approval granted by the Director, or by the Director of the Meteorological Service with the consent of the Director, as the case may be, contrary to the provisions of section 35(a) or (b);
(13)a person who transferred a licence as specified in section 37, contrary to the provisions and conditions pursuant to section 43;
(14)the holder of a manufacturing licence who violated an obligation or condition regarding the manufacturing process and its stages applying to the licence holder pursuant to section 54(5)(a) to (d);
(15)a person who operated an aircraft in respect of which an airworthiness certificate exists, not in accordance with the conditions of that certificate, contrary to the provisions of section 63(a);
(16)a person who operated an aircraft without a valid noise certificate in respect of it, contrary to the provisions of section 64(a);
(17)a person who operated an aircraft rated in a noise category whose operation is prohibited pursuant to section 66, contrary to the provisions of that section;
(18)a person who operated an aircraft when the aircraft is not in an airworthy condition or contrary to the operating limitations in the flight manual or in another document prescribed by the Minister pursuant to section 63(b)(3) or pursuant to section 67(a), contrary to the provisions of section 67(a) and (b);
(19)an aerial operator who operated an aircraft contrary to the operating limitations in the maintenance manual or in another appropriate document prescribed by the Minister pursuant to section 63(b)(4), contrary to the provisions of section 67(c);
(20)an aerial operator who violated an obligation, restriction or condition applying to the aerial operator pursuant to section 67(d);
(21)a person who operated an aircraft without equipment as referred to in section 68(a), or when the equipment is not functioning in accordance with the conditions prescribed by the Minister pursuant to that section, contrary to the provisions pursuant to section 68(a) and (b);
(22)a person who operated aeronautical equipment and who is not a crew member or flight crew member authorised to do so in accordance with the conditions prescribed by the Minister pursuant to section 68(c), or an aerial operator who permitted such a person to operate aeronautical equipment, contrary to the provisions of that section;
(23)a person who operated an aircraft or aeronautical equipment not in accordance with airworthiness directives issued in respect of that aircraft or aeronautical equipment and delivered to that person, contrary to the provisions of section 69(c);
(24)a person who operated an aircraft when the crew members manning it are not of the number and in the positions as prescribed by the Minister pursuant to section 70, contrary to the provisions pursuant to that section;
(25)a person who operated an aircraft contrary to flight rules prescribed pursuant to section 72;
(26)a person who provided ATC services not in accordance with air traffic management rules prescribed pursuant to section 72, contrary to the provisions of section 28;
(27)the holder of an aerial operating licence who accepted dangerous goods for carriage contrary to the provisions of section 74(b)(2), violated provisions or obligations applying to the licence holder pursuant to section 74(c)(1) to (3), or transported on an aircraft dangerous goods whose carriage was prohibited pursuant to section 74(c)(4);
(28)a crew member who operated dangerous goods as referred to in section 74(e) or used them, contrary to the provisions pursuant to that section;
(29)a pilot in command who violated an obligation or provision applying to the pilot in connection with the operation of the aircraft pursuant to section 76(c);
(30)a person who operated a gliding craft contrary to gliding rules prescribed pursuant to section 93(a);
(30a)a person who operated a foreign aircraft in Israeli territory on which a crew member is stationed who does not hold a valid and appropriate licence or certificate equivalent to a flight crew member licence or a medical certificate, contrary to the provisions of section 173(a1)(1);
(30b)a person who operated a foreign aircraft in Israeli territory contrary to the conditions set out in the certificate equivalent to the airworthiness certificate, contrary to the provisions of section 173(a1)(3);
(30c)a person who operated a foreign aircraft in Israeli territory without a valid certificate in respect of the aircraft equivalent to a noise certificate, contrary to the provisions of section 173(a1)(4);
(31)a person who operated a civil aircraft that is not a police aircraft, in police infrastructure or in the course of using it, without the Director's approval, contrary to the provisions of section 178(e);
(32)a person who operated a civil aircraft at a military aerodrome or at a landing site that is military infrastructure, without the Director's approval, contrary to the provisions of section 179(c)(1);
(33)a person who operated a civil aircraft while using a flight aid installation that is military infrastructure, without the Director's approval, or without the approval of the Director of the Meteorological Service with the consent of the Director, as the case may be, contrary to the provisions of section 179(c)(2).
Financial Sanction in the Amount of 25 Per Cent of the Basic Amount§
148.

The Director may impose a financial sanction pursuant to the provisions of this Chapter in an amount equal to 25 per cent of the basic amount, on each of the following:

(1)a person who performs maintenance acts who violated an obligation applying to that person pursuant to section 24(2) or (3);
(2)a person who performed minor maintenance on an aircraft, contrary to the conditions prescribed pursuant to section 25;
(3)the holder of a licence under this Law who violated a condition of the licence or an obligation applying to the licence holder under this Law, which are not detailed in sections 146 and 147, including an obligation prescribed pursuant to sections 46(a)(3) and (4) or 54(5)(e) and (f);
(4)a person who operated an aircraft not registered in the register of registration or in respect of which a valid registration certificate does not exist, contrary to the provisions of section 56(a);
(5)a person who operated an aircraft not subject to the obligation of registration pursuant to section 56(a), contrary to the provisions pursuant to section 56(b);
(6)a person who took off or landed an aircraft, contrary to the provisions of section 75;
(7)a person who operated an aircraft contrary to air traffic instructions issued pursuant to section 82, or not in accordance with instructions of an ATC unit issued pursuant to section 82(g), contrary to the provisions of that section;
(8)the holder of a training licence to operate a gliding craft who violated an obligation, restriction or condition applying to the licence holder pursuant to section 87(d)(1);
(9)the holder of a licence for the commercial operation of a gliding craft who violated an obligation, restriction or condition applying to the licence holder pursuant to section 87(d)(1);
(10)a person who operated a gliding craft contrary to the air traffic instructions as referred to in section 92(a) and (b), or violated a condition of the conditions prescribed by the Minister pursuant to section 92(c), contrary to the provisions of section 92(d)(1);
(11)a person who operated a gliding craft without being proficient in the air traffic instructions applicable in the airspace adjacent to the area of activity of the gliding craft, contrary to the provisions of section 92(d)(2);
(12)a person who operated a gliding craft contrary to instructions of an ATC unit issued pursuant to section 92(e);
(13)a person who operated a gliding craft contrary to obligations, restrictions or conditions prescribed pursuant to section 93(b);
(14)a person who violated provisions prescribed pursuant to section 166;
(15)a person who violated a temporary provision prescribed by the Director pursuant to section 167 and published in Reshumot (Official Gazette);
(15a)a person who operated a foreign aircraft in Israeli territory without a valid certificate in respect of the aircraft equivalent to a registration certificate, contrary to the provisions of section 173(a1)(2);
(15b)a person who operated on a permanent basis a foreign aircraft in Israeli territory contrary to the provisions and conditions prescribed pursuant to section 173(b) on the following matters:
(1)the Director's approval for permanent operation, if required, and operation in accordance with the conditions of that approval;
(2)reporting to the Director on the permanent operation of the aircraft;
(3)maintaining the continuing airworthiness of the aircraft during its permanent operation in Israel;
(16)a person who operated a civil aircraft in airspace allocated to military aviation as referred to in section 80, including in airspace in which ATC services are provided by the Israel Defence Forces, without prior approval from the military unit managing the air traffic in that airspace or not in accordance with its instructions, contrary to the provisions of section 179(c)(3).
Financial Sanction in the Amount of 10 Per Cent of the Basic Amount§
149.

The Director may impose a financial sanction pursuant to the provisions of this Chapter in an amount equal to 10 per cent of the basic amount, on each of the following:

(1)an aerial operator who operated an aircraft not marked with its nationality and registration marks, contrary to the provisions pursuant to section 62(a), or without identification marks affixed to it, contrary to the provisions pursuant to section 62(b);
(2)a person who operated an aircraft without a document from among the documents required to be carried pursuant to section 71, contrary to the provisions of that section;
(3)a flight crew member who served as a crew member without carrying an appropriate and valid flight crew member licence and medical certificate, or an aerial operator who permitted a flight crew member to serve as a crew member without the flight crew member carrying such a licence and certificate, all contrary to the provisions of section 71(b);
(4)an aerial operator whose aircraft operated on the aerial operator's behalf caused noise exceeding the noise level or noise quota prescribed by the Minister pursuant to section 73(a), contrary to the provisions of that section.
(5)a person who operated a foreign aircraft in Israeli territory without all the documents required to be carried as referred to in section 173(a1)(6) being present on the aircraft, contrary to the provisions of that section.
Continuing Violation and Repeated Violation§
150.
(a)In the case of a continuing violation, one-fiftieth of the financial sanction shall be added thereto for each day on which the violation continues.
(b)In the case of a repeated violation, an amount equal to half the financial sanction that could have been imposed in respect of it had it been a first violation shall be added to the financial sanction; for this purpose, "repeated violation" – a violation of a provision of the provisions pursuant to this Law as referred to in this Section, within one and a half years of a previous violation of the same provision in respect of which a financial sanction was imposed on the violator or in respect of which the violator was convicted.
