Definitions§

1.

In this Law –

"family member" – a widower or widow, and in the absence of a widower or widow – a child, as the meaning of those terms in section 238 of the National Insurance Law, provided that they are resident in Israel;

"National Insurance Law" – the National Insurance Law [Consolidated Version], 5755-1995;

"Righteous Among the Nations" – a person recognised as Righteous Among the Nations by the Yad Vashem Remembrance Authority, who is resident in Israel;

"the Institute" – the National Insurance Institute operating pursuant to the National Insurance Law.

Allowance for a Righteous Among the Nations§

2.

A Righteous Among the Nations shall be entitled to a monthly allowance at a rate equal to the average wage as its meaning in section 2 of the National Insurance Law (hereinafter – monthly allowance).

Medical Insurance§

3.

A Righteous Among the Nations is entitled, without payment, to health services pursuant to the National Health Insurance Law, 5754-1994.

Recuperation Allowance§

4.

A Righteous Among the Nations and his or her spouse shall each be granted a recuperation and vacation allowance once a year, for eight days, in the amount paid in that year to a State employee.

Housing and Nursing Care§

5.

The Government, through the relevant Ministries, shall assist Righteous Among the Nations in resolving housing and nursing care problems, and with the approval of the Knesset Labour and Welfare Committee shall promulgate Regulations concerning the particulars of the assistance and its arrangements.

Allowance and Grant for a Family Member§

6.

Upon the death of a Righteous Among the Nations –

(1)the monthly allowance shall be paid to a family member of the Righteous Among the Nations; if there is more than one family member, the allowance shall be divided among them in equal parts;
(2)the recuperation and vacation allowance shall be paid to the widower or widow pursuant to the provisions of section 4;
(3)burial expenses shall be granted in accordance with the rules prescribed in the Allowances for Victims of Hostile Action (Burial Expenses) Regulations, 5738-1978, and if there is an entitlement to a grant pursuant to section 310 of the National Insurance Law in an amount exceeding the grant under regulation 1 of those Regulations, the grant pursuant to section 310 of the National Insurance Law shall be given in place of the grant under regulation 1;
(4)a family member who is a widower or widow shall be entitled to an allowance as stated in paragraph (1), for as long as he or she has not remarried.

Payment of Allowance and Submission of Application§

7.
(a)An allowance under this Law shall be paid by the Institute upon an application submitted to the Institute.
(b)A monthly allowance under this Law shall not be considered as income for the purposes of the agreement concerning the grant of special old-age and survivors' benefits as defined in the National Insurance Law.

Payment of Allowance to a Person Who Has Left Israel§

7a.
(a)A person recognised as Righteous Among the Nations by the Yad Vashem Remembrance Authority who has left Israel for the purpose of receiving medical or nursing care treatment, for himself or herself or for his or her spouse, and to whom a monthly allowance was paid for a period of at least 5 years immediately prior to his or her departure, shall be entitled, notwithstanding the provisions of section 2, to a monthly allowance at the rate prescribed in that section, subject to conditions and in accordance with rules set by the Minister of Labour and Welfare; the provisions of this subsection shall also apply to a widower or widow of a Righteous Among the Nations who are entitled to an allowance pursuant to section 6.
(b)The provisions of this section do not derogate from the provisions of section 8, provided that no more than one monthly allowance shall be paid in respect of the same month.

Application of Section 146 of the National Insurance Law§

8.

The provisions of section 324 of the National Insurance Law shall apply to a person entitled who receives a monthly allowance under this Law, and the provisions of sections 297a and 297b of that Law shall apply to a monthly allowance under this Law.

Commencement of Payment§

9.

A monthly allowance under this Law shall be paid from the first day of the month in which the application for receipt of the allowance was submitted to the Institute, provided that a monthly allowance for a family member of a Righteous Among the Nations who has died shall not be paid in respect of the month for which the allowance was paid to the Righteous Among the Nations.

Preservation of Rights§

10.

A person who received a monthly allowance pursuant to the agreement concerning the grant of allowances to a Righteous Among the Nations of the 11th of Nisan 5747 (10 April 1987), on the eve of the commencement of this Law, shall be entitled to the allowance and benefits under this Law.

Financing and Reimbursement of Expenses§

11.
(a)Benefits and payments under this Law shall be paid from the State Treasury through the Institute.
(b)The State Treasury shall transfer to the Institute, monthly, all the funds required by it in order to carry out the payments under this Law, including the administrative expenses of the Institute arising from the implementation of the Law.

Amendment of the National Insurance Law – No. 109§

12.

In section 168 of the National Insurance Law [Consolidated Version], 5728-1968, in subsection (a), after paragraph 3(g) the following shall come:

"(h) Righteous Among the Nations Allowances Law, 5755-1995;

(i)Allowances for Prisoners of Zion and Their Family Members Law, 5752-1992."

Amendment of the Income Tax Ordinance – No. 107§

13.

In section 9 of the Income Tax Ordinance [New Version], after subsection (6f) the following shall come:

"(6g) an allowance paid pursuant to the Righteous Among the Nations Allowances Law, 5755-1995".

Amendment of Consolidated Version 5755 – No. 5§

14.

Section 350 of the National Insurance Law [Consolidated Version], 5755-1995, shall be amended pursuant to section 12 of this Law.

Implementation and Regulations§

15.

The Minister of Labour and Welfare is charged with the implementation of this Law and may promulgate Regulations on any matter relating to its implementation.
