Chapter VII: Offences Against the Police

Specification of Offences§

91.

A person who does any of the following may be arrested by a police officer without a warrant, and is liable to imprisonment for six months or a fine of 750 lira:

(1)endeavours, by means of threats, bribery, gifts or other consideration, to induce a police officer to do an act that is not that officer's duty to do, or to refrain from an act that is that officer's duty to do;
(2)knowingly detains, purchases, exchanges or receives from a police officer or a deserter from Israel Police — arms, clothing, equipment or accoutrements issued for police use (all of these shall hereinafter in this section be called "police property");
(3)induces or entices a police officer or a deserter, or a person employed by a police officer or a deserter, to sell, dispose of or part with police property;
(4)knowingly has police property in that person's possession and gives no satisfactory explanation of how it came into that person's possession;
(5)a person who is not a police officer and who wears a uniform, clothing, equipment or accoutrements resembling those intended for use in Israel Police and likely to mislead the public into thinking that the person is a police officer;
(6)a person who is not a police officer and who impersonates a police officer and does an act or makes a statement likely to mislead the public into thinking that the person is a police officer.

Chapter VII-A: Examination of Police Officers' Complaints

Chapter VIII: Israel Police in Military Functions

Israel Police as a Military Force§

92.
(a)In time of war or other emergency, the Minister may, with the consent of the Government, declare that Israel Police, or part thereof, shall be a military force that may be employed in military functions for the defence of the State.
(b)The declaration shall specify the areas and the period during which the police or part thereof shall be so employed.
(c)Police officers to whom the declaration applies shall hold, in addition to their police ranks under this Ordinance, military ranks as the Minister shall determine by Order.

Administration and Discipline of Police Declared a Military Force§

93.

The Minister and the Minister of Defence may, with the approval of the Foreign Affairs and Defence Committee of the Knesset, make Regulations concerning the administration and discipline of Israel Police or part thereof declared as referred to in section 92, and may also apply to them the provisions of the Military Justice Law, 5715-1955, in whole or in part, with such modifications as shall be determined, and the provisions of this Ordinance shall continue to apply to them subject to the provisions of the Regulations under this section.

Chapter IX: Miscellaneous Provisions

Relations That Are Not Employer-Employee Relations§

93a.
(a)An action brought to contest the exercise of powers vested under this Ordinance with respect to the appointment of a senior police officer, the assignment of a police officer to a function, the transfer of a police officer from function to function or from place to place in a function, the promotion or demotion of a police officer, the suspension of a police officer from duty, the dismissal of a police officer from the force, the extension of a police officer's service on account of an emergency, the engagement of a police officer in work outside that officer's functions within the framework of the Police, or the discharge of a police officer from service — shall not be regarded as an action arising from employer-employee relations for the purposes of section 24 of the Labour Court Law, 5729-1969.
(b)In this section, "police officer" — includes a supernumerary police officer.

Prohibition on Organising§

93b.
(a)A police officer shall not be a member of a police officers' organisation and shall not take part in activities for the establishment, maintenance or management of such an organisation.
(b)A contravention of the provisions of this section shall be regarded as an offence against good order and discipline.
(c)In this section —

"police officers' organisation" — any organisation or representation, whether permanent or temporary, among whose purposes or activities is the handling of the organisation, management, regime, discipline and conditions of service of police officers, or the representation of a police officer in these matters;

"conditions of service" — including wages, labour relations, conditions of work and conditions of retirement.

Public Council§

93c.

The Minister may establish a public council to advise the Minister on matters relating to the welfare of police officers; notice of the composition of the council shall be published in Reshumot (Official Gazette).

Implementation and Regulations§

94.
(a)The Minister is responsible for the implementation of this Ordinance and may make Regulations for its implementation, provided that Regulations for the implementation of the provisions of Chapter II-A shall be made in accordance with the provisions of section 10w(b).
(b)The Minister of Police and the Minister of Justice are responsible for the implementation of Chapter IV and may make Regulations for its implementation.

Regulations with Approval of a Knesset Committee§

94a.

If the Minister considers it necessary for the proper functioning of the Police, the Minister may, with the approval of the National Security Committee of the Knesset, make Regulations concerning the organisation, management, regime and discipline of the Police, that may prohibit or restrict —

(1)the giving of interviews by police officers otherwise than in accordance with the standing orders of the Police;
(2)the participation of police officers in assemblies, demonstrations and processions;
(3)any activity relating to a police officers' organisation within its meaning in section 93b.
95.§

Commencement§

96.

This new version shall come into force on the 1st day of Nisan 5731 (27 March 1971).

First Schedule (Section 49i)

All offences except:

(1)an offence the punishment for which is imprisonment not exceeding one year, unless the State Attorney and the Inspector General have determined that the offence shall be investigated by the Department;
(2)a traffic offence as defined in section 1 of the Traffic Ordinance;
(3)an offence that another authority, other than the Police, is competent to investigate under law;
(4)an offence committed by a police officer together with another person, and the Head of the Department, in consultation with the Head of the Investigations Branch of the Police, has determined that the police officer's part in the commission of that offence is secondary;
(5)offences arising from special incidents determined by the State Attorney and the Inspector General.

Sixth Schedule (Section 10t)

Part 1: Israel Police Reporting to the Attorney General

(1)The number of stationary special cameras and the number of mobile special cameras that were activated, as well as the number of such cameras that were removed or whose operation was discontinued following the examination referred to in section 10i(d), broken down as follows:
(a)the type of stationary special camera or the type of mobile special camera;
(b)in respect of a stationary special camera — the purpose for which it was positioned and activated, and whether it was positioned for a period not exceeding three months;
(2)The number of photographs that served as evidence in an investigation file and, of those, the number of files in which an indictment was filed;
(3)The number of objects identified by a special photography system;
(4)The cases in which a special photography system was used for the purpose of urgent treatment of an incident endangering life or an incident involving a danger to state security;
(5)The number of cases in which information stored in a special photography system was used for a purpose among those listed in section 10l(a) that is not included among the purposes listed in section 10g(a);
(6)A statistical analysis regarding the period of time that elapsed between the date on which a photograph was taken by the special photography system and the date on which that photograph was produced from the system for use as evidence in a criminal investigation;
(7)The number of persons authorised to access information stored in the special photography systems, broken down by their position and with details of their access permissions;
(8)Details concerning the cases in which stationary special cameras photographing the entire public space of a locality or all access routes to and from a locality were positioned pursuant to section 10j;
(9)The types of inclusions of real-time alerts defined in a special photography system, and in respect of each such type of inclusion — details concerning the procedures for its approval, the maximum period of its validity and the number of inclusions of that type actually entered into the special photography system, all broken down by type of special photography system;
(10)The number of authorisations granted pursuant to section 10l(b) for use of information separated pursuant to the provision of section 10m(c), and details of the purposes for which each authorisation was granted;
(11)The characteristics of a technological tool belonging to a type of special photography system used by Israel Police, as well as compliance of a special photography system with the standards regarding its reliability, as prescribed in Regulations pursuant to section 10w(a)(5);
(12)Details concerning incidents of information leakage from the database or intrusion into it.
