Chapter XVIII: Temporary Provisions

Temporary provision regarding the continuation of Educational Television broadcasts until the transition date§

148.

During the period from the commencement date until the transition date as its meaning in section 120, the following provisions shall apply:

(1)the Educational Television shall broadcast educational, instructional programmes and programmes in the fields of culture, enrichment and society, and shall not broadcast news broadcasts and current affairs programmes;
(2)section 6(a)(4) of the Broadcasting Distribution via Digital Broadcasting Stations Law, 5772-2012, shall be read as if instead of "three television channels" it were stated "two television channels".

Temporary provision regarding the purchase of current affairs programmes§

149.
(a)
(1)Notwithstanding the provisions of section 3 of the Schedule, during a period of two years from the commencement date the News Division may allocate sums for the purchase of current affairs programmes, in the manner and under the conditions to be decided by the head of the News Division;
(2)the provisions of section 47(c) shall apply to the purchase of current affairs programmes by the News Division in accordance with the provisions of this subsection;
(3)an engagement for the purchase of current affairs programmes requires the approval of the Council.
(b)The provisions of subsection (a) shall not apply to the purchase of television, radio and internet news broadcasts, including the main television news edition and news flashes.
(c)Current affairs programmes as referred to in subsection (a) shall not be purchased from a broadcasting licensee, a broadcasting licence holder, an independent news producer or a newspaper, nor from a person who is a controlling shareholder or an interested party in one of them, from a person in whom one of them is a controlling shareholder or an interested party, or from a person in whom a particular person is a controlling shareholder or an interested party in one of them, and also a controlling shareholder or an interested party in that person; for this purpose –

"broadcasting licensee" – as defined in the Second Authority for Television and Radio Law, 5750-1990;

"broadcasting licence holder", "newspaper" and "independent news producer" – as defined in sections 1, 6h4 and 6t2 of the Communications Law (Telecommunications and Broadcasting), 5742-1982, respectively.

(d)Notwithstanding the provisions of subsection (a), the Council may instruct the head of the News Division to produce current affairs programmes, all or some of them, independently, before the end of the period referred to in that subsection, if it is satisfied that the News Division is prepared to do so.

Schedule (Section 64)

Definitions§

1.

In this Schedule, "high-genre (élite genre) programme" – purchased local productions of the following types:

(1)"documentary programme" – a programme dealing with the documentation of human, social, cultural or political phenomena, or with the documentation of phenomena or discoveries in nature or science, and which is not a current affairs programme;
(2)"drama programme" – a programme that tells a plot story of a comic, dramatic, melodramatic, tragic or similar character.

Financing of programmes intended for broadcast on the main broadcast channel§

2.

The annual expenditure to be incurred by the Israeli Broadcasting Corporation for the financing of production and the purchase of programmes intended for broadcast on the main broadcast channel shall be at least NIS 200 million in each year (in this section – the annual expenditure amount for programmes), to be allocated as set out below:

(1)At least NIS 180 million shall be allocated for the financing and purchase of purchased local productions and sports programmes, of which –
(a)at least NIS 90 million – for the financing of high-genre programmes, of the type of drama programmes and documentary programmes, with a distribution of at least NIS 50 million for drama programmes and at least NIS 40 million for documentary programmes; however, the Director General may decide that up to NIS 6 million of the said amounts, as the Director General shall decide, shall be allocated for the financing of Israeli cinema films as defined in the Cinema Law, 5759-1999;
(b)up to NIS 15 million, for as long as the amount specified in the opening clause has not exceeded NIS 180 million – for sports programmes;
(2)An amount of up to NIS 20 million of the annual expenditure amount for programmes shall be allocated for the purchase of programmes that are not local productions, sports programmes, news broadcasts or current affairs programmes.

Financing of news broadcasts and current affairs programmes§

3.

The annual expenditure to be incurred by the Israeli Broadcasting Corporation for the financing of production of news broadcasts and current affairs programmes, on radio, on television and over the internet, shall be at least NIS 160 million in each year; the News Division shall not allocate amounts for the purchase of news broadcasts or current affairs programmes.

Financing of programmes intended for broadcast on the children's and youth channel§

4.

The annual expenditure to be incurred by the Israeli Broadcasting Corporation for the purchase of purchased local productions intended for broadcast on the children's and youth channel shall be at least NIS 40 million in each year.

Financing of programmes intended for broadcast on the Arabic-language channel§

5.

The annual expenditure to be incurred by the Israeli Broadcasting Corporation for the purchase of purchased local productions intended for broadcast on the Arabic-language channel shall be, until 2019 – at least NIS 20 million in each year, and from 2020 onwards – at least NIS 30 million in each year.

Updating of the annual expenditure amounts§

6.

The amounts specified in this Schedule shall be updated on 1 January of each year in accordance with the rate of change in the Consumer Price Index published by the Central Bureau of Statistics, as known on that date, compared with the index that was known on 1 January of the preceding year; the said amounts shall be updated for the first time on the 3rd of Tevet 5777 (1 January 2017).
