Definitions§

1.

In this Law –

"terrorist organisation" and "act of terror" – as defined in the Counter-Terrorism Law, 5776-2016;

"family member" – a parent, brother or sister, son or daughter, and spouse;

"terrorist" – a terror operative as defined in the Law for the Freezing and Deduction of Funds Paid by the Palestinian Authority in Connection with Terrorism from the Funds Transferred to It by the Government of Israel, 5778-2018;

"the Minister" – the Minister of the Interior.

Expulsion of a Terrorist's Family Member§

2.
(a)Where the Minister is satisfied that a family member of a terrorist has done one of the following (hereinafter – grounds for expulsion), the Minister may, by Order, subject to the provisions of section 3, direct the expulsion of that family member to the territory of the Gaza Strip, or to another expulsion destination to be determined in accordance with the circumstances:
(1)the family member knew or ought to have known in advance of the terrorist's plan to commit an act of terror and did not make every effort required to prevent the commission, completion or consequences, as the case may be, of the act of terror, including by reporting to the security services or to the Israel Police;
(2)the family member expressed support for or identification with an act of terror, or published words of praise, sympathy or encouragement for an act of terror or a terrorist organisation.
(b)The validity of an expulsion Order in respect of a person who is an Israeli citizen shall be not less than seven years and not more than 15 years, and in respect of a person who holds a visa and a licence for permanent residence or temporary residence, within the meaning of those terms in the Entry into Israel Law, 5712-1952 – not less than ten years and not more than twenty years.

Duty to Hold a Hearing§

(a)Where information has come to the Minister's knowledge that is capable of indicating the existence of grounds for expulsion on the part of a family member of a terrorist, the Minister shall summon the family member to a hearing to be held within ten days of the date of the summons; in the course of the hearing the family member shall be given the opportunity to present arguments and shall be entitled to legal representation.
(b)After the hearing referred to in subsection (a) and no later than the expiry of 14 days from the date of the hearing, the Minister shall communicate the Minister's decision as referred to in section 2, and if the Minister has decided to expel the family member of the terrorist – the Minister shall sign the expulsion Order on that same date.

Ancillary Powers§

4.

For the purpose of executing an expulsion Order under this Law, the Israel Police shall have all the powers vested in it under any law, including the power to enter any place, to remove any person therefrom and to use reasonable force for that purpose.

Implementation and Regulations§

5.

The Minister is responsible for the implementation of this Law, and may, with the approval of the Knesset Committee, make Regulations for its implementation.
