Purpose§

1.

The purpose of this Law is to prescribe the grant of honorary citizenship of the State of Israel to fallen soldiers of the War of Independence, heroes of Israel, who risked their lives in battle for the homeland and fell therein before the State of Israel was established or in its early days, yet did not merit receiving Israeli citizenship.

Definitions§

In this Law –

"fallen soldier of the War of Independence" – any of the following:

(1)a person who served during the determining period in the Israel Defence Forces, in the defence organisations, in the Irgun, in the Lehi, or in another service that the Minister of Defence declared, by a declaration published in Reshumot (Official Gazette), to be military service for the purposes of this Law, and who fell in the performance of his duty during that period;
(2)a person who was killed during the determining period in the Land of Israel as a result of hostile acts by military, semi-military or irregular forces of an enemy state against the Jewish people, hostile acts of an enemy organisation, or hostile acts carried out while assisting any of the foregoing, on their behalf, at their direction, or in order to advance their objectives, and which the Minister of the Interior declared to be hostile acts for the purposes of this Law;

"the determining period" – the period from the 16th day of Kislev 5708 (29 November 1947) until the 29th day of Kislev 5709 (31 December 1948).

Grant of Honorary Citizenship§

3.
(a)The Minister of the Interior, on the recommendation of the Minister of Defence, shall grant honorary citizenship of the State of Israel to a fallen soldier of the War of Independence to whom Israeli citizenship was not granted.
(b)The Minister of the Interior shall publish in Reshumot (Official Gazette) the names of the fallen soldiers of the War of Independence to whom honorary citizenship has been granted under this Law.
(c)A spouse, child or grandchild of a fallen soldier of the War of Independence to whom honorary citizenship was granted under subsection (a) may request the Minister of the Interior to revoke it; where such a request has been submitted, the Minister of the Interior shall revoke the honorary citizenship, and it shall be deemed as if it had never been granted.

Implementation and Regulations§

4.

The Minister of the Interior is charged with the implementation of this Law and may, with the approval of the Interior and Environmental Protection Committee of the Knesset, make Regulations for its implementation, including with respect to the arrangements for delivering the honorary citizenship of a fallen soldier of the War of Independence to his family members.
