By virtue of my authority under Section 3 of the Energy Sources Law, 5750-1989 (hereinafter – the Law), after consulting with the Minister for Environmental Protection and with the approval of the Economics Committee of the Knesset, I hereby make the following Regulations:

Definitions§

1.

In these Regulations –

"energy rating" – the rating of a dwelling unit on the energy scale according to the energy consumption required for its air-conditioning, expressing the level of planning of the components of the envelope of the dwelling unit, as determined in the standard;

"dwelling unit" – a set of rooms, together with its service rooms, intended for residential purposes;

"seller" – a person who sells a dwelling unit that he built or is to build, himself or through another person, on his own land or on the land of another, for the purpose of selling it, including a person who sells a dwelling unit that he purchased for the purpose of selling it, from a person who built or is to build it as aforesaid, excluding a seller of a dwelling unit that he did not build himself and did not receive consideration from the buyer in respect of its sale;

"the Standards Institute" – as its meaning in Chapter II of the Standards Law, 5713-1953 (hereinafter – the Standards Law);

"sale" – including a long-term lease for a period of twenty-five years or more, including an undertaking to sell or to grant a long-term lease as aforesaid or to cause a sale or long-term lease as aforesaid, including a transaction in an association as defined in the Real Property Taxation (Appreciation and Acquisition) Law, 5723-1963;

"laboratory" – the Standards Institute or an approved laboratory pursuant to Section 12 of the Standards Law;

"broker" – a real property broker as its meaning in the Real Property Agents Law, 5756-1996;

"buyer" – a person who purchases or may purchase a dwelling unit as aforesaid;

"energy rating label" – a label bearing a mark reflecting the energy rating of a dwelling unit in accordance with the specimen and specification in the Schedule;

"standard" – Israeli Standard SI 5282 Part 1 "Rating of Buildings According to Energy Consumption: Residential Buildings" as in force from time to time, a copy of which is available on the Standards Institute's website.

Display of Energy Rating for a Dwelling Unit§

2.
(a)A seller shall not present to a buyer the energy rating of a dwelling unit intended for sale, nor transfer it to a broker, unless both of the following conditions have been met:
(1)a laboratory has determined an energy rating pursuant to the standard for that dwelling unit;
(2)the energy rating is presented by means of an energy rating label.
(b)A broker shall not present to a buyer the energy rating of a dwelling unit intended for sale unless the broker has received from the seller the energy rating label of that dwelling unit.

Transfer of Data to the Commissioner§

3.

An energy rating label of a dwelling unit shall not be displayed to buyers unless the seller has transferred to the Commissioner, by means of the online form to be published on the website of the Ministry of Energy at www.energy.gov.il, the data on the basis of which the laboratory determined the energy rating of that dwelling unit, and the Commissioner has given the seller an online confirmation of receipt of the data in the system.

Report to the Economics Committee of the Knesset§

4.

The Commissioner shall submit to the Economics Committee of the Knesset, once a year and for a period of four years, a report regarding the implementation of these Regulations, including regarding their effect on housing prices and the level of energy saving achieved following their implementation; the first report pursuant to this regulation shall be submitted at the end of two years from the commencement date.

Commencement and Application§

5.

These Regulations shall commence 90 days from the date of their publication (hereinafter – the commencement date), and shall apply to a dwelling unit in respect of which a building permit was granted after the commencement date; for this purpose, "building permit" – as its meaning under the Planning and Building Law, 5725-1965.
