Chapter X: Transitional Provisions

Definitions§

71.

In this Chapter, "National Parks Authority" and "Nature Reserves Authority" have the meanings assigned to them in the National Parks Law 5752.

Transitional Provisions Regarding Inspectors§

72.

A person who was appointed as an inspector by the Director of the National Parks Authority or by the Director of the Nature Reserves Authority on the eve of the commencement of this Law shall be deemed to have been appointed as an inspector, pursuant to this Law, by the Director of the Nature and Parks Authority.

Transitional Provisions Regarding Employees§

73.
(a)A person who was an employee of the National Parks Authority or an employee of the Nature Reserves Authority on the eve of the commencement of this Law shall become an employee of the Nature and Parks Authority from the day of the commencement of this Law.
(b)Notwithstanding any law, and subject to the provisions of subsection (c), an employee of the National Parks Authority or an employee of the Nature Reserves Authority who became an employee of the Nature and Parks Authority by virtue of subsection (a) shall not be entitled to retirement benefits by reason of the transfer to the Nature and Parks Authority.
(c)
(1)All rights, conditions of employment, stipulations and procedures for the resolution of disputes that an employee of the National Parks Authority or an employee of the Nature Reserves Authority had on the eve of the commencement of this Law, including rights arising from dismissal or resignation, shall be preserved for that employee and shall be regarded as rights arising from his employment with the Nature and Parks Authority;
(2)Notwithstanding the provisions of paragraph (1), if an agreement as referred to in section 20(b) has been concluded that regulates the wages and conditions of employment of those who became employees of the Nature and Parks Authority by virtue of the provisions of subsection (a), the provisions of the agreement shall apply, and upon the conclusion of the agreement the provisions of paragraph (1) shall no longer apply.

Transitional Provisions Regarding Assets and Claims§

74.

Upon the commencement of this Law the following provisions shall apply:

(1)The assets of the National Parks Authority and the assets of the Nature Reserves Authority shall be deemed to be assets of the Nature and Parks Authority; for the purposes of this section, "assets" means real property, movable property, rights and benefits, debts and liabilities, engagements or transactions of any kind;
(2)Every claim that was pending on the eve of the commencement of this Law by or against the Nature Reserves Authority or the National Parks Authority, as the case may be, and every cause of action as aforesaid that existed at that time, shall continue to subsist and shall be deemed to be by or against the Nature and Parks Authority, as the case may be.

Transitional Provisions Regarding Budget§

75.

All amounts appropriated in the Budget Law for the fiscal year 1998 for the activities of the National Parks Authority and the Nature Reserves Authority that had not been expended by the day of the commencement of this Law shall be deemed to have been appropriated for the Nature and Parks Authority.

The Commemoration Council§

76.

The Commemoration Council established pursuant to the National Parks Law 5752 shall be deemed to have been appointed pursuant to this Law.

Conveyance of Powers§

77.

Every power or right vested pursuant to any enactment in the Nature Reserves Authority or the National Parks Authority, in the Director of the Nature Reserves Authority or in the Director of the National Parks Authority, or in the Council for National Parks, Nature Reserves and National Sites, as defined in the National Parks Law 5752, and every duty imposed upon them, shall be vested in or imposed upon, as the case may be, from the day of the commencement of this Law, the Nature and Parks Authority, the Director of the Nature and Parks Authority and the Council for National Parks, Nature Reserves and National Sites, as defined pursuant to this Law, respectively.

Commencement and Qualification Regarding Prosecution§

78.

This Law shall come into force on the 19th day of Shevat 5758 (15 February 1998); however, no person shall be prosecuted for an offence or for non-compliance with an Order, as specified below, in the period between the day of the commencement of this Law and the day of its publication –

(1)an offence against a provision of sections 25 or 30(d) of this Law;
(2)an offence against Regulations or rules prescribed pursuant to section 71 of the National Parks Law 5752, or pursuant to section 66 of this Law, or against a condition of a licence or permit granted pursuant thereto;
(3)non-compliance with an Order pursuant to sections 54 or 55 of this Law.

Publication§

79.

This Law shall be published within 15 days of its adoption by the Knesset.
