Definitions§
In this Law –
"provisions of the Implementation Laws" – the provisions of Chapter V of the Law for the Implementation of the Agreement on the Gaza Strip and the Jericho Area (Economic Arrangements and Miscellaneous Provisions) (Legislative Amendments), 5755-1994, and the provisions of Chapter II of the Law for the Implementation of the Agreement on the Preparatory Transfer of Powers to the Palestinian Authority (Legislative Amendments and Miscellaneous Provisions), 5755-1995;
"security offence" – an offence listed in the definition of "suspect of a security offence" in section 35(b) of the Criminal Procedure Law (Enforcement Powers – Arrests), 5756-1996;
"the Palestinian Authority" – the Council as defined in the Emergency Regulations (Judaea and Samaria – Jurisdiction in Offences and Legal Assistance), 5727-1967, as extended in validity and amended in text by law, from time to time.
Financing of Defence Counsel and Set-Off of Funds§
Where a court has appointed defence counsel for a person who was a suspect or accused of a security offence, or who was convicted of a security offence, and the Emergency Regulations (Swords of Iron) (Extension of Detention of a Suspect of a Security Offence), 5784-2023, as extended in validity and amended in text by law, from time to time, applied to any of them, or against whom an indictment was filed pursuant to the Law for the Prosecution in respect of the Events of the Massacre of 7 October 2023 (Shemini Atzeret Massacre), 5786-2026, the Minister of Finance shall, at the end of each quarter, set off an amount equal to the fee paid from the State Treasury to the defence counsel, from the funds transferred by the Government of Israel to the Palestinian Authority in accordance with the provisions of the Implementation Laws.
Transitional Provision§
The provisions of this Law shall also apply to the fee of defence counsel appointed by a court for a suspect or accused as referred to in section 2, from the 22nd day of Tishrei 5784 (7 October 2023) until the eve of the commencement of this Law.
Implementation§
The Minister of Finance is charged with the implementation of this Law.
