Purpose of the Law§
The purpose of this Law is to combat the denial of the events of the massacre carried out in the framework of the murderous terrorist attack perpetrated by the Hamas terrorist organisation and its partners in an organised and deliberate manner against the citizens and residents of Israel on the 22nd and 23rd of Tishrei 5784 (7 and 8 October 2023), acts constituting felonies against the Jewish people and felonies against humanity.
Definition§
In this Law, "the Massacre of 7 October (Shemini Atzeret Massacre)" – the events of the massacre carried out by the Hamas terrorist organisation and its partners in an organised and deliberate manner on the 22nd and 23rd of Tishrei 5784 (7 and 8 October 2023).
Prohibition of Denial of the Massacre of 7 October (Shemini Atzeret Massacre)§
One who publishes, in writing or orally, statements denying the Massacre of 7 October (Shemini Atzeret Massacre) with intent to defend the Hamas terrorist organisation and its partners, to express sympathy towards them or to identify with them, is liable to five years' imprisonment.
Permitted Publication§
A publication shall not be regarded as an offence under this Law if it was made incidentally, in good faith or for a legitimate purpose, including for the purpose of making information available to the public or for the purpose of research, or within the framework of legal proceedings.
Filing of an Indictment§
An indictment for an offence under this Law shall not be filed except by the Attorney General or with the Attorney General's consent.
