Definitions§
In this Law –
"Pensions Law" – the Victims of Hostile Action (Pensions) Law, 5730-1970;
"act of terror" – as defined in the Counter-Terrorism Law, 5776-2016;
"terror rewarder" – a person who transfers funds in connection with an act of terror for the benefit of the perpetrator of the act of terror or of a person acting on the perpetrator's behalf, including a body of persons whether incorporated or unincorporated, as well as the Palestinian Authority, the Palestine Liberation Organisation or a person acting on their behalf;
"victim" and "family member" of a victim – as defined in the Pensions Law;
"exemplary damages" – damages that are not contingent on loss, as referred to in Section 2;
"Civil Wrongs Ordinance" – the Civil Wrongs Ordinance [New Version];
"Palestinian Authority" – the Council as defined in the Emergency Regulations (Judaea and Samaria – Jurisdiction over Offences and Legal Assistance), 5727-1967, as their validity has been extended and their text amended by law from time to time.
Exemplary Damages§
Limitation on the Application of the Victims of Hostile Action (Pensions) Law§
For the purposes of the provisions of section 17(b) of the Pensions Law, this Law shall not be regarded as another law for the purposes of the definition "compensation under another law" in section 36(b) of the Disabled Persons Law (Pensions and Rehabilitation), 5719-1959 [Consolidated Version] and in section 21a of the Families of Soldiers Killed in Action Law (Pensions and Rehabilitation), 5710-1950.
Application§
The provisions of this Law shall apply to a claim against a perpetrator of an act of terror, a terror rewarder or against a person whose liability has been determined pursuant to sections 12 to 14 of the Civil Wrongs Ordinance [New Version] in connection with an act of terror that had not become time-barred or that was pending on the eve of the commencement of this Law.
Commencement§
This Law shall commence on the 24th of Iyar 5784 (1 June 2024).
