Form of Transaction
A transaction in land requires a written document.
8.
Obligation Agreement
An undertaking to effect a transaction in land requires a written document.
9.
Priority
Where a person undertook to effect a transaction in land and before the transaction was completed by registration, undertook a conflicting transaction, the right of the first transaction holder is preferred; however, if the second party acted in good faith and for consideration and registered their right while still acting in good faith, their right is preferred.
