Chapter III-A: Regulation of Traffic

Definitions§

16a.

In this Chapter –

"trial option", "notice of fine payment" – as defined in the Criminal Procedure Law [Consolidated Version], 5742-1982 (hereinafter – the Criminal Procedure Law);

"licensed tower", "motor vehicle" – as defined in the Traffic Ordinance [New Version] (hereinafter – the Traffic Ordinance);

"traffic offence" – as defined in the Traffic Ordinance [New Version], provided that it concerns non-compliance with a traffic sign or non-compliance with directions concerning the direction of vehicle movement, its parking or its stopping.

Regulation of Traffic§

16b.

The Knesset Officer, or a person authorised for that purpose by the Speaker of the Knesset, may prescribe traffic and parking arrangements in the Knesset Precincts in accordance with the Traffic Ordinance [New Version], and for that purpose shall have all the powers conferred under that Ordinance upon a traffic supervisor, a police officer and the traffic sign authorities.

Power for the Purpose of Directing Vehicle Movement§

16c.

For the purpose of directing vehicle movement, parking or stopping in the Knesset Precincts, the Knesset Officer or a member of the Knesset Guard authorised for that purpose by the Knesset Officer, after having received appropriate training, shall have every power conferred upon a police officer under any law.

Power to Issue Notices of Fine Payment§

16d.
(a)The Knesset Officer, or a member of the Knesset Guard authorised by the Knesset Officer under section 16c, who has reasonable grounds to believe that a certain person has committed a traffic offence in the Knesset Precincts in a motor vehicle that is a trial-option offence, may issue him a notice of fine payment.
(b)A notice of fine payment issued in accordance with the provisions of subsection (a) shall have the same effect as a notice of fine payment issued by a police officer, and the provisions made under sections 228 to 230 of the Criminal Procedure Law shall apply in this regard, with such modifications as are required.

Liability for Parking§

16e.
(a)The Knesset Officer may order the towing or removal of a motor vehicle standing in the Knesset Precincts in a place where parking is prohibited, or in circumstances that constitute a breach of traffic arrangements or of traffic safety, or where removal is required for the purpose of regulating traffic or for traffic safety or for the safety of the public in the Knesset Precincts.
(b)The towing or removal of the vehicle shall be carried out by a member of the Knesset Guard or by a licensed tower, to another location, whether within the Knesset Precincts or outside them; the towing or removal shall be carried out with such reasonable precautions as are necessary to ensure the safety of the vehicle.
(c)The provisions of section 70a(d), (f) and (g) of the Traffic Ordinance [New Version] shall apply, with such modifications as are required, to the towing or removal of a vehicle under this section.

Road within the Knesset Precincts§

16f.

For the purposes of this Chapter, any place within the Knesset Precincts in which a motor vehicle may travel shall have the same status as a "road" as defined in the Traffic Ordinance [New Version].

Chapter IV: Members of the Knesset Guard

Conditions of Service§

17.

The recruitment of members of the Knesset Guard to service and their conditions of service shall be as the recruitment of police officers to service and their conditions of service, with such adaptations as the Speaker of the Knesset has prescribed.

Work and Rest Hours§

18.

The Work and Rest Hours Law, 5711-1951 shall not apply to the employment of members of the Knesset Guard.

Disciplinary Jurisdiction§

19.

For the purposes of the duty of discipline and disciplinary jurisdiction, a member of the Knesset Guard shall have the same status as a police officer under the Police Law, 5766-2005 (in this section – the Police Law) and the Police Ordinance [New Version], 5731-1971 (in this section – the Police Ordinance), however the powers of the Minister of Police shall vest in the Speaker of the Knesset and the powers of the Inspector General shall vest in the Knesset Officer, all with such modifications as are required according to the matter and with such adaptations as the Speaker of the Knesset shall prescribe, and also with the following modifications in the Police Law and, in respect of paragraph (10) – in the Police Ordinance:

(1)in section 1, in the definition "senior adjudication officer", instead of "deputy commissioner" there shall come "deputy warden";
(2)in section 27, instead of "a police officer of a rank to be determined in Israel Police orders," there shall come "a senior adjudication officer or another lawyer who is not an employee of the Legal Bureau of the Knesset,";
(3)in section 42, instead of "the Inspector General" there shall come "the Speaker of the Knesset";
(4)instead of what is stated in section 43 there shall come "the Speaker of the Knesset shall appoint as president of the disciplinary tribunal a lawyer who is an employee of the Legal Bureau of the Knesset.";
(5)in section 44 –
(a)in subsection (a), instead of "who are senior police officers, at least two of whom are jurists" there shall come "who are a lawyer who is an employee of the Legal Bureau of the Knesset and two senior adjudication officers";
(b)in subsection (b) –
(1)instead of what is stated in paragraph (1) there shall come "a lawyer who is an employee of the Legal Bureau of the Knesset and a senior adjudication officer";
(2)in paragraph (2), the words "with the consent of the Minister of Justice" – shall be deleted;
(6)for the purposes of section 55, the Legal Adviser of the Knesset shall be the president of the appeals tribunal;
(7)for the purposes of section 56, the composition of the bench of the appeals tribunal shall be the president of the tribunal, the Knesset Officer and a lawyer who is an employee of the Knesset or a pensioner of the Knesset;
(8)in section 67(a), in the preamble, instead of "prescribed by the Inspector General" there shall come "prescribed by the Knesset Officer, with the consent of the Inspector General";
(9)in section 71(b), instead of "to the general fund of the Israel Police" there shall come "to the culture fund of the Knesset Guard".
(10)in section 77j of the Police Ordinance, instead of "senior police officer" there shall come "deputy warden and above".

Pensions for Guard Members§

20.

For the purposes of entitlement to a pension under the State Service (Pensions) Law, 5715-1955, a member of the Knesset Guard shall have the same status as a police officer, with such modifications as are required according to the matter and with such adaptations as the Speaker of the Knesset has prescribed, and the powers conferred by that Law upon the Inspector General of the Police and upon the Minister for Internal Security shall vest in the Speaker of the Knesset.

Allowances for Guard Members§

21.
(a)Where a member of the Knesset Guard has suffered a qualifying injury under the rehabilitation laws, the member of the Knesset Guard shall, for the purposes of the Police Law (Disabled and Fallen), 5741-1981, have the same status as a police officer, and the members of his family, including his fiancée as defined in section 35b(a) of the Families of Soldiers Who Fell in Action (Pensions and Rehabilitation) Law, 5710-1950, of a member of the Knesset Guard who has died shall have the same status as the members of the family and the fiancée of a police officer who has died, with such modifications as are required according to the matter and with such adaptations as the Speaker of the Knesset has prescribed, and the power conferred by that Law upon the Minister of the Interior shall vest in the Speaker of the Knesset.
(b)Where a member of the Knesset Guard has suffered, in the course of and as a result of his service, an injury that is not a qualifying injury under the rehabilitation laws and is not a hostile-action injury, the provisions of Chapter V of the National Insurance Law shall apply in this regard, and the provisions of sections 295a(e) to (h) and 295b of that Law shall also apply, with such modifications as are required.
(c)In this section –

"National Insurance Law" – the National Insurance Law [Consolidated Version], 5755-1995;

"qualifying injury under the rehabilitation laws" – as defined in section 295a(a) of the National Insurance Law;

"hostile-action injury" – as defined in the Victims of Hostile Action (Pensions) Law, 5730-1970.

Additional Rights§

22.

Members of the Knesset Guard are entitled to every privilege lawfully granted to a police officer, and the same applies to every exemption or concession from tax, fee, rates or levy to which a police officer is entitled under any law.

Chapter V: Penalties

Penalty for Unlicensed Possession of a Prohibited Article and Creating a Disturbance§

23.

The following are liable to two years' imprisonment:

(1)a person who contravenes the provisions of section 5;
(2)a participant in an assembly or procession in the Knesset Precincts contrary to section 7(b), a person who forces entry into, penetrates or infiltrates the Knesset Premises;
(3)a person who enters, whether lawfully or unlawfully, the Knesset Premises or the Precincts and, while therein, performs an act in order to enable participants in an assembly or procession to force entry into, enter or infiltrate the Knesset Premises or the Precincts, whether he himself participated in the assembly or procession or did not participate in them.

Penalty for Performing a Public Function Without Authorisation and Participation in an Assembly or Procession§

24.

The following are liable to one year's imprisonment:

(1)a person who contravenes the provisions of section 6;
(2)a person who participates in an assembly or procession in the Knesset Premises or the Precincts contrary to section 7(b).

Penalty for Contravening Other Provisions§

25.

The following are liable to one month's imprisonment or a fine of 500 liras:

(1)a person who enters the Knesset Premises, the Precincts or the plenary chamber without a permit under sections 3 or 4;
(2)a person who contravenes the provisions of sections 7(a), 7(c);
(3)a person who contravenes instructions lawfully given by the Knesset Officer or by an usher or a member of the Knesset Guard;
(4)a person who contravenes instructions of the Speaker of the Knesset under section 2 for which no other penalty is prescribed in this Law.

Chapter VI: Miscellaneous

Filing of Criminal Charges§

26.

No criminal charge shall be filed against a person for an offence under this Law, and the Attorney General shall not be entitled to order the discontinuation of proceedings that have been instituted – except with the consent of the Speaker of the Knesset.

Application of the Law§

27.
(a)The provisions of this Law, except for section 5, do not apply to –
(1)the President of the State;
(2)Members of the Knesset.
(b)Notwithstanding the provisions of subsection (a), the provisions of section 7 shall also apply to Members of the Knesset, but for that purpose the provisions of Chapter V shall not apply to them; if a Member of the Knesset contravenes the provisions of section 7, the matter shall be brought by the Speaker of the Knesset before the Ethics Committee of the Members of the Knesset.
(c)The provisions of this section shall also apply to Ministers and Deputy Ministers who are not Members of the Knesset.

Conditions of Service of Ushers§

28.

Ushers, whether they were admitted to service before the commencement of this Law or thereafter, shall, with regard to admission to service and conditions of service including the right to a pension and with regard to the duty of discipline and disciplinary adjudication, have the same status as State employees.

Acting in Place of the Speaker of the Knesset§

29.

During sittings of the Knesset in the absence of the Speaker of the Knesset, the Chair of the sitting shall act in place of the Speaker of the Knesset for the purposes of this Law.

Central Elections Committee§

29a.

The Speaker of the Knesset may permit, on such conditions as he shall determine, the Central Elections Committee for the Knesset to conduct its activities, in whole or in part, in the Knesset Premises and the Precincts.

29b.§

(Repealed — תשס״ח)

Delegation of Powers§

30.
(a)The Speaker of the Knesset may delegate in writing to a Deputy Speaker of the Knesset his powers under sections 3(b), 4, 6 and 7, whether generally, or in respect of a particular matter, or for a particular time.
(b)(Repealed)

Implementation and Regulations§

31.

The Speaker of the Knesset is responsible for the implementation of this Law and may, with the approval of the Knesset Committee, make Regulations in respect of anything relating to its implementation.

Repeal§

32.

The Knesset Buildings Immunity Law, 5712-1952 – is repealed.

Transitional Provisions§

33.

A person who was appointed to be a member of the Knesset Guard under the Knesset Buildings Immunity Law, 5712-1952, and who is still in service, shall be deemed to have been appointed to be a member of the Knesset Guard under this Law, and his period of service as a guard shall be taken into account for the purposes of his right to pensions under the State Service (Pensions) Law, 5715-1955.
