Chapter I: Interpretation

Definitions§

1.

In this Law –

"Knesset Premises" – the building designated for the Knesset;

"Knesset Precincts" – the area surrounding the Knesset Premises whose boundaries are marked by a thick line on the map set out in the Schedule to this Law, including the buildings and roads within that area.

"authorised person" – any one of the following:

(1)a member of the Knesset Guard;
(2)an usher;
(3)a person authorised to conduct a search;
(4)a person authorised to demand identification;

"member of the Knesset Guard" – a person appointed to maintain security and order in the Knesset Premises and the Precincts;

"usher" – a person appointed to maintain order in the Knesset Premises and the Precincts and to provide services to Members of the Knesset and visitors to the Knesset Premises in accordance with the directions of the Speaker of the Knesset;

"person authorised to conduct a search" – a member of the Knesset Guard, an usher or a person authorised to do so by the Speaker of the Knesset, after having undergone appropriate professional training as determined by the Knesset Officer, provided that there is no impediment to his appointment on grounds of public safety, including his criminal record;

"person authorised to demand identification" – a person authorised by the Knesset Officer to demand identification and the production of documents, after having undergone appropriate professional training, provided that there is no impediment to his appointment on grounds of public safety, including his criminal record;

"prohibited article" – any one of the following:

(1)a firearm – as defined in the Firearms Law, 5709-1949;
(2)an explosive – as defined in the Explosives Law, 5714-1954;
(3)a knife or penknife – as defined in section 184 of the Penal Law, 5737-1977, and any other cold weapon;
(4)a hazardous substance – as defined in the Hazardous Substances Law, 5753-1993;
(5)an article whose possession or use constitutes an offence;
(6)any article, including an animal, other than a guide dog, which in the opinion of the Knesset Officer or a person authorised by him for that purpose is capable, by its presence or use, of harming public safety, safety or order in the Knesset Premises, the Precincts or an additional compound, and notice to that effect has been given to the person holding it;

"guide dog" – as defined in the Prohibition of Discrimination against Persons with Blindness Accompanied by Guide Dogs Law, 5753-1993;

"additional compound" – a place situated outside the Knesset Premises or the Precincts, including in an area as defined in the Law for the Extension of the Validity of Emergency Regulations (Judea and Samaria and the Gaza Strip – Jurisdiction over Offences and Legal Assistance), 5738-1977, whose boundaries have been defined by the Speaker of the Knesset as referred to in section 15a, at a time when a sitting of the Knesset or of one of its committees or an event on behalf of the Knesset is being held therein.

Chapter II: Immunity of the Knesset Premises and Precincts and Maintenance of Order therein

Directions of the Speaker of the Knesset§

2.

The Speaker of the Knesset may give any direction and take any measure that appear to him necessary for the maintenance of order and security in the Knesset Premises and the Precincts.

Entry into the Knesset§

3.
(a)The Speaker of the Knesset, after consultation with the Deputy Speakers, may designate areas within the Knesset Premises and the Precincts to which entry is permitted and areas to which entry is prohibited.
(b)A person may enter an area in the Knesset Premises or the Precincts to which entry has been prohibited under subsection (a) if he holds a permit granted by the Speaker of the Knesset or on his behalf, and the Speaker of the Knesset may grant permits of various types, whether general or special.
(c)The Speaker of the Knesset or a person whom he has authorised in the matter of permits under subsection (b) may take into account the criminal record of the permit applicant in respect of offences under –
(1)Chapter VII, Sections A, A1, B, G and I of Chapter VIII, Section C of Chapter IX, and Sections A, D, E, G and H of Chapter X of the Penal Law, 5737-1977;
(2)the Defence (Emergency) Regulations, 1945;
(3)the Prevention of Terrorism Ordinance, 5708-1948;
(4)the Law for the Prevention of Infiltration (Offences and Jurisdiction), 5714-1954;
(5)the Counter-Terrorism Law, 5776-2016, as well as offences under any other enactment that constitute an act of terrorism as defined in that Law.

Exclusive Use of the Knesset Plenary Chamber§

4.

No person shall enter the plenary chamber during its working hours except by virtue of a special permit granted by the Speaker of the Knesset or on his behalf, and in accordance with the conditions of the permit.

Prohibition on Carrying a Prohibited Article§

5.

No person shall bring a prohibited article into, or hold one within, the Knesset Premises or the Precincts except by permit from the Speaker of the Knesset.

Acts that a Public Servant Is Not Authorised to Perform§

6.

Any person or body performing a function by law (in this section – a public servant) is not authorised to perform in the Knesset Premises or the Precincts any act which he is obliged or authorised to perform in the discharge of his function, except by permit from the Speaker of the Knesset, and the fact that the public servant acted as aforesaid in accordance with instructions from his superior shall not serve as a defence.

Order in the Knesset Premises and the Precincts§

7.
(a)No person shall conduct himself in the Knesset Premises or the Precincts in a manner or form capable of disrupting the regular work of the Knesset or of disturbing visitors to the Knesset Premises.
(b)No assembly and no procession shall be held in the Knesset Premises or the Precincts except by permit, whether general or special, from the Speaker of the Knesset.
(c)No person shall erect a placard, notice or poster in the Knesset Premises or the Precincts except by permit from the Speaker of the Knesset.
(d)In this section –

"assembly" – ten persons or more who have gathered to act jointly;

"procession" – ten persons or more who are walking together, or who are gathering for the purpose of walking together, from place to place for a common purpose, whether or not they have formed into a march.

Chapter III: Ensuring Immunity and Order in the Knesset Premises, the Precincts and an Additional Compound

Knesset Officer§

8.
(a)The Speaker of the Knesset, in consultation with the Deputy Speakers and with the approval of the Knesset Committee, shall appoint the Knesset Officer.
(b)The Knesset Officer shall be in charge of maintaining security and order in the Knesset Premises and the Precincts, of safeguarding classified information of the Knesset or classified information in its possession, and, in connection with all of these, of enforcing the provisions of this Law and of directions given thereunder.
(c)The Knesset Officer shall have all the powers necessary for the performance of his functions, and for that purpose he shall also have the powers vested by any other law in a district police commander.
(c1)The Knesset Officer shall also serve as commander of the Knesset Guard.
(d)The Knesset Officer shall be accountable to the Speaker of the Knesset for the performance of his function under this Law.
(e)In the absence of the Knesset Officer, the deputy commander of the Knesset Guard shall have the powers of the Knesset Officer.

Knesset Officer, Commander of Ushers and Members of the Knesset Guard§

9.
(a)The Knesset Officer shall command the ushers and the members of the Knesset Guard.
(b)(Repealed)

Directions of an Usher and a Member of the Knesset Guard§

10.

An usher or a member of the Knesset Guard may direct any person to do an act or to refrain from doing it in order to comply with the provisions of this Law or directions given thereunder.

Removal of a Trespasser§

11.

An usher or a member of the Knesset Guard may remove from the Knesset Premises and the Precincts any person who has entered, or intends to enter, the Knesset Premises or the Precincts without a permit.

Removal of a Person Who Violates Directions§

12.

The Knesset Officer, a member of the Knesset Guard or an usher may remove a person from the Knesset Premises and the Precincts if he has not complied with directions lawfully given, or has disturbed order in the Premises or the Precincts, or if there is reasonable ground to suspect that he is likely to disturb order therein, or if he has entered a place to which entry was not permitted to him.

Power to Demand Identification and Production of Documents§

12a.

An authorised person may demand from any person who seeks to enter the Knesset Premises or the Precincts, or who is present therein, to provide his name and address and to present to him an identity card or other official document attesting to his identity, as well as an entry permit in accordance with the provisions of this Law.

Power of Detention§

12b.

If a member of the Knesset Guard or an usher has reasonable grounds to suspect that a person has committed an offence in the Knesset Premises or the Precincts, or that he is about to commit therein an offence liable to endanger the safety or security of a person, or public safety, public order or State security, he may detain him and demand that he accompany him to a police station or deliver him to a police officer; the provisions of sections 72 to 74 of the Criminal Procedure (Enforcement Powers – Arrests) Law, 5756-1996 (hereinafter – the Arrests Law), shall apply to a detention as aforesaid, with the necessary modifications.

Power of Arrest§

13.
(a)If a person has not complied with directions given to him pursuant to the powers of detention referred to in section 12b, or has obstructed a member of the Knesset Guard or an usher from exercising the powers of detention, a member of the Knesset Guard may arrest him and deliver him to a police officer as soon as possible, but no later than four hours after he was arrested.
(b)The provisions of sections 24 to 26 of the Arrests Law shall apply to a person effecting an arrest under the provisions of this section, with the necessary modifications.

Power of Search§

14.
(a)In this section –

"search" – a search without a judicial warrant;

"body search" – a search on the surface of a person's body, in his clothing or in his personal effects.

(b)For the purpose of safeguarding State security, public order, or the safety or security of a person or of the public, a person authorised to conduct a search may, in the course of performing his function, conduct a body search, a search of a vehicle, cargo or other goods, as the case may be, in respect of any of the following:
(1)upon their entry into the Knesset Premises or the Precincts;
(2)while they are present in the Knesset Premises or the Precincts, if he had reason to suspect that a person holds therein a prohibited article or something taken unlawfully from the Knesset Premises or the Precincts, or that a prohibited article or such a thing is found in the vehicle, cargo or other goods.
(c)A body search involving physical contact shall be conducted by a person of the same sex as the person being searched, unless this cannot be done in the circumstances of the matter and a delay of the search would pose an unreasonable risk to public security.

Power to Demand Deposit of Articles§

14a.

A person authorised to conduct a search may demand that a prohibited article be deposited at a place that he indicates, for as long as the person carrying it is present in the Knesset Premises or the Precincts.

Power of Seizure§

14b.
(a)A person authorised to conduct a search may seize a prohibited article that has not been deposited as referred to in section 14a, or any article in respect of which he has reasonable grounds to assume that it may serve as evidence in legal proceedings for an offence.
(b)A person who has effected a seizure of articles under subsection (a) shall draw up a list of them, and he may transfer them to the police or return them to the person from whom they were seized.

Ancillary Powers§

14c.
(a)If a person has refused a demand for identification, a demand to deposit an article, a search or a seizure under the provisions of this Law, the person authorised to exercise the said powers may act in the following ways:
(1)to prevent that person from entering the Knesset Premises or the Precincts, or to prevent the entry of a vehicle, cargo or other goods into the Knesset Premises or the Precincts, as the case may be; the provisions of section 12b shall apply to an act under this paragraph;
(2)to remove from the Knesset Premises or the Precincts the person, the vehicle, the cargo or the other goods, as the case may be.
(b)The exercise of powers under subsection (a) shall not derogate from the power to carry out the search or seizure notwithstanding the refusal, or from the other powers under this Law.

Power to Use Force§

15.

An usher or a member of the Knesset Guard may use force to the extent necessary for the performance of their functions.

Additional Compound – Its Definition and Application of Provisions Thereto§

15a.
(a)No sitting of the Knesset or of one of its committees or event on behalf of the Knesset shall be held in an additional compound, unless the additional compound has been defined in accordance with the provisions of subsection (b), the provisions of subsection (c) have been applied thereto and appropriate signage has been erected therein.
(b)The Speaker of the Knesset, in consultation with the Deputy Speakers and with the Knesset Officer, and in coordination with the Israel Police, the General Security Service and the Israel Defence Forces, shall define an additional compound in a manner that includes the minimum area necessary for the maintenance of order and security therein.
(c)For the purpose of maintaining order and security in an additional compound, the Speaker of the Knesset may, in consultation with the Knesset Officer and in coordination with the bodies referred to in subsection (b), apply the provisions of sections 3 to 5, 10 to 12, 12a, 12b, 14, 14a, 14b, 14c and 15, in whole or in part, to an additional compound; should the Speaker of the Knesset so decide, those provisions shall apply to the additional compound as if it were part of the Knesset Premises, with such modifications as are required.
(d)Notwithstanding the provisions of subsection (a), the Speaker of the Knesset may determine, in special cases, that a sitting of the Knesset or of one of its committees shall be held outside the Knesset Premises and the Precincts, at a place determined by him, even if it is not an additional compound.

Identification of an Authorised Person§

15b.
(a)An authorised person shall, while performing his duties, wear a visible identification tag bearing his given name, surname and position, and if he is not in uniform and exercises powers under this Law in relation to a person, he shall identify himself before that person, by stating his identity particulars and presenting his letter of appointment or a document attesting to his position and powers.
(b)An authorised person shall provide his identity particulars upon the request of any person, in any matter connected with his duties under this Law, whether he is in uniform or not.
(c)In this section, "identity particulars" – given name, surname and position.

Limitation of Liability§

15c.

An authorised person shall not bear criminal or civil liability for an act or omission performed in good faith and in a reasonable manner in the course of his duties and for the purpose of performing them; however, nothing in the provisions of this section shall derogate from disciplinary liability under any law.

Assault of an Authorised Person§

16.

A person who assaults an authorised person while he is lawfully performing his duties, or who obstructs or hinders an authorised person in the performance of his duties, shall be treated as if he had done so towards a police officer (within the meaning of the Police Ordinance), and the Law for the Amendment of Penal Law (Assault of Police Officers), 5712-1952 shall apply to him.
