Order of Heirs

The heirs by law are: (1) the spouse of the deceased and the descendants of the deceased, including adopted children, their spouses and descendants; (2) the parents of the deceased and their descendants; (3) the parents of the deceased's parents and their descendants.

Spouse's Share

The spouse of the deceased takes, where there are heirs of the first class — one half of the estate; where there are heirs of the second class only — two thirds of the estate; where there are heirs of the third class only — the entire estate.

Equal Division Among Descendants

The descendants of the deceased inherit in equal shares; the descendants of a descendant who died before the deceased shall divide among themselves the share that would have been due to that descendant.

State as Heir

In the absence of heirs by law pursuant to the provisions of Sections 11 to 15, the State shall inherit.
