Chapter VI: Miscellaneous Provisions

Appointment of a Registrar§

29.

The Minister shall appoint, from among the Ministry's employees, a person who shall be vested with the powers of the Registrar under this Law.

Directions of the Registrar and their publication§

30.
(a)The Registrar may publish directions intended to ensure the integrity, reliability and consistency of the information contained in the registry.
(b)The Registrar's directions in respect of the reporting format under section 3 and in respect of the optimal calculation method under section 6, as well as directions as referred to in subsection (a) and any amendment thereto, shall be published on the Ministry's website; a notice of the publication of a Registrar's direction on the Ministry's website and of the date of its entry into force, as well as of any amendment thereto, shall be published in Reshumot (Official Gazette).

Earmarking of funds§

31.

A fine and a monetary sanction imposed under this Law shall be paid into the fund for the preservation of cleanliness established under section 10 of the Cleanliness Law, 5744-1984.

Collection§

32.

The collection of a fine or a monetary sanction under this Law shall be governed by the Tax (Collection) Ordinance.

Application to the State§

33.
(a)This Law shall apply to the State.
(b)Notwithstanding the provisions of subsection (a), the Prime Minister or the Minister of Defence may determine, by Order, with the consent of the Minister, that the provisions of this Law, in whole or in part, shall not apply in respect of emissions of pollutants or transfers of pollutants or waste that are the result of security or operational activities of a body belonging to the defence establishment, on grounds of a substantial concern of harm to the security of the State or – after consultation with the Minister of Foreign Affairs – to its foreign relations; in the absence of agreement between the Ministers in respect of an Order under this subsection, the dispute shall be brought for determination by the Prime Minister.
(c)The period of validity of an Order under subsection (b) shall not exceed three years, and the person who made such an Order may, with the consent of the Minister, extend its period of validity for additional periods as aforesaid.
(d)An Order under this section shall be published in Reshumot (Official Gazette), unless the Prime Minister or the Minister of Defence, as the case may be, has directed that it shall not be published, in whole or in part, on grounds of State security.
(e)Requests, documents and any other information that a body belonging to the defence establishment is required to submit to the Registrar or to a person acting on the Registrar's behalf under the provisions of this Law (in this section – information), or information regarding such a body that is required to be submitted under section 11(c), that are classified, shall be submitted only to a person holding an appropriate security clearance and in accordance with the information security rules applied by the body required to submit the information, and if there is no person holding such a clearance – to the Director General of the Ministry, provided that the Director General holds an appropriate security clearance.
(f)In this section –

"defence establishment" – as defined in section 2 of the Packaging Arrangement Law, 5771-2011;

"appropriate security clearance" – a security clearance as that term is used in section 15 of the General Security Service Law, 5762-2002.

Savings provisions§

34.
(a)The provisions of this Law are in addition to the provisions of any other law and do not derogate therefrom; however, the provisions of section 6a of the Freedom of Information Law, 5758-1998, shall not apply in respect of information that is available for public inspection under the provisions of Chapter III.
(b)The inclusion of a substance or the specification of a threshold quantity in the First Schedule shall not authorise the emission or transfer of such a substance, or in such a quantity, if it is prohibited under any law.
(c)The inclusion of a field of activity or a type of activity in the Second Schedule shall not authorise the said activity if it is prohibited under any law.

Implementation and regulations§

35.
(a)The Minister is responsible for the implementation of this Law and may make Regulations on any matter relating to its implementation.
(b)The Minister may prescribe that a report that a person is required to submit to the Minister, to the Ministry, or to a Ministry employee, under any law or under a permit, shall be prepared and submitted in accordance with the reporting format referred to in section 3, and that the data to be submitted shall be calculated in accordance with an optimal calculation method as referred to in section 6.
(c)Where the Minister has prescribed provisions under section 4 or under subsection (b), the Minister may prescribe that what is stated therein shall apply notwithstanding what is stated in any law or permit, except for provisions prescribed in a law; where the Minister has prescribed such provisions, they shall apply only in respect of reporting to the bodies listed in subsection (b), and they shall not alter the reporting provisions prescribed in any law or permit in respect of any other body.
(d)In this section, "permit" – including an Order, a plan, a business licence or any other licence.

Amendment of Schedules§

36.

The Minister may, by Order, with the approval of the Interior and Environmental Protection Committee of the Knesset, amend the Schedules, after having published on the Ministry's website for public comments, for a period of not less than thirty days, a notice of his intention to do so and of the content of the amendment, and he may prescribe in such an Order that in respect of types of plants to be added by the Order, some of the provisions of this Law shall apply.

Amendment of Administrative Affairs Courts Law – No. 73§

37.

In the Administrative Affairs Courts Law, 5760-2000, in the First Schedule, in item 23, after paragraph (9) the following shall be inserted:

"(10) A decision of an authority under the Environmental Protection (Emissions and Transfers to the Environment – Reporting Obligations and Registry) Law, 5772-2012.".

Amendment of Environmental Protection (Inspection and Enforcement Powers) Law§

38.

In the Environmental Protection (Inspection and Enforcement Powers) Law, 5771-2011, in the Schedule, after item 23 the following shall be inserted:

"24. Environmental Protection (Emissions and Transfers to the Environment – Reporting Obligations and Registry) Law, 5772-2012.".

First Annual Report, Publication and Inventory List§

39.
(a)Notwithstanding the provisions of Section 3, a plant shall submit the first annual report in respect of the fiscal year 2012, in accordance with the provisions of that Section, by the 22nd of Tammuz 5773 (30 June 2013).
(b)Notwithstanding the provisions of Section 12(a), the registry in respect of the fiscal year 2012 shall be made available for public inspection no later than the 28th of Kislev 5774 (1 December 2013).
(c)The first inventory list under Section 11 shall be compiled by the 10th of Tevet 5775 (1 January 2015).

Second Schedule

(The definition "plant" in Section 2 and Sections 5(b) and 34(c))

In this Schedule –

(1)wherever output, production capacity, capacity, quantities or other units of measurement (hereinafter – the values) have been prescribed, these shall be calculated in accordance with the maximum values attainable by means of the installations at the plant or the plant itself, even if in practice the installation or the plant is operated at lower values;
(2)an activity shall be regarded as a type of activity included in the Schedule if the values are equal to or exceed the value prescribed for that type of activity in Column B thereof, unless expressly stated otherwise.
