Chapter VIII: Regulations and By-Laws

General Regulations

70.

The Minister of Transport may make Regulations on the following matters:

(1)The regulation of traffic and the determination of rules for the use of roads by vehicles, pedestrians and others;
(2)The lights to be fitted on vehicles;
(3)The use of horns or other warning devices on vehicles;
(4)The determination of the size, form and quality of identification markers and rules regarding their attachment to vehicles so that they may be readily distinguishable;
(5)The registration of motor vehicles and the particulars to be registered;
(6)The obligation to maintain meters in taxis and the regulation of their use and maintenance;
(7)The manner of keeping a license;
(8)The exemption of a motor vehicle registered abroad and brought into the country for a limited period, and the driver of such a vehicle, from the provisions of this Ordinance relating to registration and licensing, in whole or in part;
(9)The giving of notice of any change in the ownership of a motor vehicle and the registration of such a change;
(10)The payment of fees for registration, license, renewal of license, Permit, inspection, examination, or any other act under the Ordinance or the Regulations, as well as late payment charges for failure to pay on time;
(11)Examinations and tests for the purpose of determining the driving competence of applicants for driving licenses or of holders thereof and the categories of licenses to be issued;
(12)The inspection and examination of public vehicles, the number of persons permitted to be carried therein, the obligation to carry passengers and the scope of that obligation;
(13)The obligation to display the approved number of passengers and the approved fare tariff, including the map or plan relating to the said tariff;
(14)The safety and comfort of passengers in public vehicles and the conduct of their drivers;
(15)The empowerment of the Licensing Authority to prohibit or restrict, by notice displayed in the prescribed manner, the driving of any vehicle or of a vehicle of a special type on a particular road or any part thereof;
(16)The speed at which motor vehicles or any category thereof may be driven, whether generally or on a particular road or in a particular zone or place;
(17)The construction and weight of vehicles and the conditions for their use;

(18)The means of regulating, restricting and supervising the licensing of commercial vehicles and the licensing of private vehicles constructed to carry more than six passengers in addition to the driver, as well as the use of such commercial and private vehicles;
(19)The supervision and direction of driving instruction, driving instructors and driving schools and their training, as well as matters relating to the equipment and appliances to be used;
(20)The granting of licenses for holding driving schools and for giving driving instruction, their period of validity, their conditions, and the authority to cancel or suspend them on account of a contravention of the Regulations or of the conditions of the license, and the granting of exemptions from the obligation to hold a license to give driving instruction;
(21)The manner of submitting applications, conducting tests and examinations for the purpose of granting or renewing driving licenses, licenses to instruct and to hold driving schools and vehicle licenses, and the procedures of the licensing offices connected therewith;
(22)All matters relating to traffic safety, its planning and regulation;
(23)Making the granting or renewal of a license under this Ordinance or the Regulations made thereunder conditional upon payment of—
(a)any Fine for which the applicant for the license or its renewal has been adjudged liable in legal proceedings in respect of a traffic offence or any other offence arising from the driving of a vehicle, and which has not been paid despite its having fallen due;
(b)the taxes, customs duties, fees, levies and other compulsory payments applicable in respect of the vehicle for which the license or its renewal is sought;
(24)The implementation of the provisions of this Ordinance generally.

Regulations Regarding Public Motor Vehicles

71.

In addition to his general power under Section 70, the Minister of Transport may make Regulations in connection with public motor vehicles on the following matters:

(1)The regulation and restriction of the granting of vehicle licenses, the supervision thereof, their number in general and in each zone, route or type of service;
(2)The regulation and restriction of the use of vehicles and the supervision thereof;
(3)The regulation and restriction of the granting of licenses or Permits for the carriage of passengers or for the operation of a transport service (in this Section — service), including the conditions of licenses and Permits, their cancellation and the cessation of their validity;
(4)The determination of service routes, their consolidation and separation and any other arrangement of service routes, fare tariffs and timetables according to which vehicles shall be operated, including the manner and place of their publication, the arrangement of the issue of tickets and season tickets of all types, their printing and sale, as well as the number of vehicles to be operated, their types and all connected therewith;
(5)The determination of the obligations imposed on the vehicle, on the person operating it or working in it, on whoever has control thereof, and on whoever provides a service therein, including his employees, agents and messengers and whoever acts by virtue of his authority in the provision of the service and on the passenger or person seeking to travel therein, and any arrangement connected therewith, provided that all such obligations shall apply only in connection with the provision of the service or the use of the vehicle;
(6)The obligation to operate a vehicle or service and the prohibition on discontinuing a service or part thereof;

(7)The assignment of a vehicle to a particular route, zone or type of service, for the purpose of ensuring and efficiently planning the transport required by the public;
(8)Any other matter connected with the arrangements for operating a service and the manner of its provision that is capable of improving the carriage of passengers by vehicle or that is connected with the operation of a service for the benefit of the public.

Regulations Regarding Public Motor Vehicles — Insurance or Bond

72.

The Minister of Transport may prescribe that any person who applies, pursuant to this Ordinance or the Regulations, to the Licensing Authority for a motor vehicle license or for the renewal of such a license or for approval to transfer it, shall present an insurance certificate or a bond certificate or produce such other evidence as may be prescribed to prove one of the following two things:

(1)That on the day on which the license or its renewal comes into force, or on the day on which the approval is given, the policy or bond instrument required for the use of the motor vehicle by the applicant or by others pursuant to his direction or with his permission will be in force;
(2)That the motor vehicle is a vehicle to which Section 4 of the Motor Vehicle Insurance (Third Party Risks) Ordinance, 1947 does not apply, so long as it is driven by the owner of the vehicle or by his employee in the course of his employment, or so long as the vehicle is otherwise under the control of its owner.

Preservation of the Validity of Regulations Made Under Sections 70–72

73.

Regulations made pursuant to Sections 70–72 as amended by the Defence Regulations (Amendment of Traffic Ordinance) (No. 2), 1942,11 which were in force on the eve of the coming into force of the Defence Regulations (Revocation), 1945,12 shall be deemed to have been made pursuant to those Sections as amended by the Defence Legislation (Incorporation in Certain Ordinances) Ordinance, 1945.13

74.

The Minister of Transport may announce in the Official Gazette that the provisions of the Ordinance or the Regulations, in whole or in part, shall apply to categories of places specified in the notice to which they would not have applied but for the notice, or shall not apply to categories of places specified in the notice to which they would have applied but for the notice.

75.

The Minister of Transport may make Regulations designed to give effect to any international convention whose purpose is to facilitate the international movement of motor cars and which lays down provisions for the issuance and authentication of laissez-passer documents, certificates of approval or Permits that are of benefit to persons residing in Israel when they take their motor cars abroad temporarily or to drivers traveling abroad to drive vehicles.

76.

The Minister of Transport may make Regulations regarding the establishment, appointment and determination of the functions of any authority that he considers necessary in connection with the implementation of the Ordinance.

(a)A council of a municipality or of a local council may, with the consent of the District Commissioner and the Licensing Authority, make by-laws regarding—
(1)The fare tariffs of public vehicles within the limits of the municipality or the local council;

(2)The regulation of vehicles standing within the limits of the municipality or local council, whether by way of prohibition or otherwise;
(3)The fitness of vehicles drawn by animals, the number, fitness and harness of the animals drawing such vehicles and the removal of animals that are unfit;
(4)The licensing of bicycles and tricycles, excluding motorcycles and three-wheeled motorcycles, and the fees to be paid for the licenses, provided that they shall not exceed three pounds per year for bicycles and five pounds per year for tricycles; upon the granting of the license the local authority shall arrange for the inspection of the safety of the bicycles and tricycles.
(b)All by-laws made pursuant to subsection (a)(1) or subsection (a)(2) shall be subject to any Regulation made by the Minister of Transport pursuant to Sections 70–72.

Chapter Nine: Miscellaneous / Share of Local Authority in Fees

78.

The Minister of Transport may allocate to the councils of municipalities and of local councils a portion of the fees paid for a vehicle license by persons who, during the period of the license, were residents within the area of jurisdiction of the said local authority; the rate of the portion shall be determined by the Minister by Order and it is permitted to prescribe in the Order that the allocated amounts, in whole or in part, shall serve for the implementation of this Ordinance or for the improvement of traffic conditions.

79.

The Minister of Transport may enter into an agreement with the Government of any neighboring country regarding the registration of public and commercial vehicles registered in that country and brought into Israel for a specified period. Under such an agreement he may direct that the fees prescribed pursuant to this Ordinance be increased or reduced or that an exemption or reduction from all or part of them be granted.

80.

This Ordinance shall apply to vehicles and to persons in the service of the State, unless there is an express provision to the contrary.

1. An offence under Section 10 (except for driving a vehicle by a person who has not renewed his driving license and six months have not yet elapsed since the date of expiry of the license), or under Sections 62(3) or (7).
