Chapter IV: Miscellaneous Provisions

Financing of Discounts§

14.

The Minister of Finance shall enter into agreements with discount providers under this Law for the financing of the discount granted to a senior citizen pursuant to the provisions of this Law; however, the provisions of this section shall not apply in respect of section 9, and in respect of section 12, the Minister of Finance shall enter into agreements as aforesaid with the types of bodies or the bodies prescribed pursuant to that section.

Non-Duplication of Discount§

15.

A senior citizen who is entitled to a discount under this Law and who, in the same matter within the fields of discounts, is also entitled to a discount under any other law or agreement, shall be entitled to the higher of the two discounts; in this section, "discount" – including a full or partial exemption from payment, a reduction in price or a reduced fee.

Information Regarding Rights and Benefits§

15a.
(a)In this section, "public authority" – any of the following:
(1)a Government ministry, including its units and attached units;
(2)a municipality or local council;
(3)a corporation established by law, listed in the First Schedule;
(4)a Government company, a mixed company and a Government subsidiary as defined in the Government Companies Law, 5735-1975, and bodies as referred to in section 60 of that Law, listed in the Second Schedule;
(5)the Jewish Agency for the Land of Israel;
(6)a health fund as defined in the National Health Insurance Law, 5754-1994;
(7)another body that is an audited body within the meaning of section 9 of the State Comptroller Law, 5718-1958 [Consolidated Version], as prescribed by the Minister by Order, in consultation with the Minister concerned and with the approval of the Labour, Welfare and Health Committee of the Knesset.
(b)A public authority shall transmit to the Ministry in writing, by 31 August of each year, a summary of every right or benefit under any law or agreement that that public authority grants to senior citizens and of the conditions for receiving the right or benefit, as at 1 July of that year, by reason of their having reached the determining age or a later age; the information transmitted to the Ministry pursuant to this subsection shall be general information relating to the entire eligible public and shall also include particulars regarding the possibility of the public obtaining additional information concerning the right or benefit.
(c)The Minister, with the consent of the Minister of Finance and the Minister of Justice, in consultation with the Minister of Welfare and Social Services and with the approval of the Labour, Welfare and Health Committee of the Knesset, shall make Regulations regarding the manner of informing senior citizens by the Ministry of the information transmitted to the Ministry as referred to in subsection (b); in this subsection, "information" – excluding information transmitted pursuant to subsection (b) regarding the non-granting of a right or benefit.

The Senior Citizens (Sending and Publication of an Information Booklet) Regulations, 5773-2012, have been published.

(d)Notwithstanding the provisions of subsection (c), the Minister may prescribe in the manner referred to in that subsection that in exceptional cases, the informing of senior citizens of information transmitted to the Ministry as referred to in subsection (b) shall be carried out by the public authority concerned, in a manner to be prescribed; Regulations under this subsection also require the consent of the Minister in whose area of authority that public authority operates.

Publication of Notice of a Discount on Entrance Fees or Travel Fares in a Place Visible to the Public§

15b.

Without derogating from the provisions of section 15a, a public authority as defined in that section that grants a right or benefit as referred to in section 15a(b) which is a discount on payment of entrance fees or travel fares shall publish a notice of the discount in a place visible to the public; the Minister in whose area of authority the public authority operates, in consultation with the Minister, shall prescribe provisions regarding the publication of a notice of the said discount in a place visible to the public.

Rights Not under This Law§

16.

Subject to the provisions of section 15, nothing in this Law shall derogate from any right or benefit granted to a senior citizen under any law or agreement.

Participation in Activities on Behalf of the Ministry§

16a.
(a)The Minister may direct that a person shall not participate in an activity as detailed in the Third Schedule, on behalf of the Ministry, if that person has been convicted of an offence which, by reason of its nature, gravity or circumstances, renders that person, in the opinion of the Minister, unfit to participate in such an activity.
(b)The Minister may, by Order, in consultation with the Minister of Justice, amend the Third Schedule, provided that the Minister shall not add an activity to the said Schedule unless the Minister is of the opinion that, by reason of the nature of the activity, it is appropriate to take into account the criminal record of a person taking part therein, for the purpose of protecting the welfare and safety of senior citizens or of minors; for this purpose, "minor" – as defined in section 34x of the Penal Law, 5737-1977.

Implementation and Regulations§

17.

The Minister is responsible for the implementation of this Law and may make Regulations in respect of anything relating to its implementation.

Obligation to Make Regulations§

18.

Regulations under section 12 shall be submitted for approval by the Labour and Welfare Committee of the Knesset within 30 days of the date of publication of this Law.

Third Schedule

1.§

Participation in a senior citizens' study class at an educational institution, during study hours at that institution; for this purpose, "educational institution" – as defined in the Compulsory Education Law, 5709-1949.

2.§

Activity, whether for remuneration or not for remuneration, in the home of a senior citizen, provided that the Minister was of the opinion that, by reason of the nature of the activity, it is appropriate to take into account the criminal record of a person participating therein, including the senior citizen, for the purpose of protecting the safety and security of senior citizens or of minors participating in that activity.
