Chapter IX: Miscellaneous Provisions

Savings Provisions§

48.

Nothing in the provisions of this Law shall derogate –

(1)from the provisions under the Water Law or from the status of the Kinneret under any law;
(2)from the powers vested in a competent authority under any law, unless this Law expressly provides otherwise.

Non-Application of the Municipal Associations Law Provisions§

49.

The provisions under the Municipal Associations Law, 5715-1955, shall not apply to the Association, except to the extent expressly provided otherwise in this Law.

Observers in Planning Institutions§

50.

A representative of the Association, as determined by the Council of the Association, shall be invited to participate as an observer in all sessions of the planning institutions at which a matter relating to the area of the Association is discussed.

Implementation and Regulations§

51.

The Minister is responsible for the implementation of this Law and may make Regulations for its implementation.

Amendment of the Coastal Environment Protection Law – No. 2§

52.

In the Coastal Environment Protection Law, 5764-2004 –

(1)In section 2 –
(a)In place of the definition "commencement date" the following shall come:

""commencement date" –

(1)in respect of the Mediterranean Sea – the commencement date of this Law;
(2)in respect of the Red Sea – the commencement date of the Coastal Environment Protection (Amendment) Law, 5768-2007;
(3)in respect of the Sea of Galilee – the date of publication of the Regulation of the Treatment of the Kinneret Shores Law, 5768-2008;";
(b)In the definition "coastal environment", in place of "or from the shoreline of the Red Sea, as the case may be, towards the land" there shall come "from the shoreline of the Red Sea or from the shoreline of the Sea of Galilee, as the case may be, towards the land", and after "coastal waters," there shall come "and in respect of the Sea of Galilee – the entire area of the Sea of Galilee, and all";
(c)In the definition "shoreline", after "as the case may be" there shall come "as well as a line as aforesaid at 208.80 metres below the national zero datum along the shores of the Sea of Galilee", in place of "from the commencement of this Law" there shall come "from the commencement date", and after "shores of the Mediterranean Sea" there shall come "or the Sea of Galilee, as the case may be";
(d)In the definition "coastal zone", in place of "between them and in respect of" there shall come "between them, in respect of", and at its end there shall come "and in respect of the Sea of Galilee – the entire area of the Sea of Galilee to be measured from the shoreline";
(2)In section 3(a), in place of "or permit" there shall come "permit or instruction";
(3)In section 4, after subsection (b) the following shall come:

"(c) Notwithstanding the provisions of subsection (a), a person may carry out an act that constitutes or may constitute harm to the coastal environment of the Sea of Galilee if the act was carried out for the purpose of managing the Sea of Galilee as a water source under any law, provided that the act is carried out, as far as possible, in a manner that will serve to minimise the harm to the coastal environment.";

(4)In section 5(c), after paragraph (2) the following shall come:

"(2a) A water extraction, storage, conveyance, diversion, infiltration into the subsoil, supply, measurement, regulation and monitoring installation, as well as a wastewater conveyance installation, lawfully established within the coastal zone of the Sea of Galilee, provided that the area of such installations that is not open to pedestrian passage is the minimum essential area necessary for their operation;";

(5)In section 9(a), at its end there shall come "for the purpose of this section, 'harm to the coastal environment' has the meaning ascribed to it in section 2, including the erection of an obstacle, fence or other barrier blocking the free passage along the coastal zone, contrary to the provisions of section 5.";
(6)In section 15, the text therein shall be marked "(a)" and after it the following shall come:

"(b) In respect of the Sea of Galilee, nothing in the provisions of this Law shall derogate from the provisions under the Water Law, 5719-1959, the Water Drilling Supervision Law, 5715-1955, the Drainage and Flood Control Law, 5718-1957, the Water and Sewerage Corporations Law, 5761-2001, or from the powers under any law of the Director of the Water and Sewerage Authority, the Council of that Authority and the Water Council, within the meaning of the Water Law.".

Amendment of the Planning and Building Law – No. 83§

53.

In the Planning and Building Law, 5725-1965 –

(1)In section 1, in place of the definition "coastal environment" the following shall come:

""coastal environment" has the meaning ascribed to it in the Coastal Environment Protection Law, 5764-2004;";

(2)In the Second Schedule –
(a)In section 1 –

In place of the definitions "shoreline" and "coastal zone" the following shall come:

""the determining date" –

(1)in respect of the Mediterranean Sea – the commencement date of Amendment 69;
(2)in respect of the Red Sea – the commencement date of the Coastal Environment Protection (Amendment) Law, 5768-2007;
(3)in respect of the Sea of Galilee – the date of publication of the Regulation of the Treatment of the Kinneret Shores Law, 5768-2008;

"shoreline" and "coastal zone" have the meaning ascribed to them in the Coastal Environment Protection Law, 5764-2004;";

(b)In section 4 –
(1)In subsection (c), in place of "the date of entry into force of Amendment 69, in respect of the Mediterranean Sea, and after the date of entry into force of the Coastal Environment Protection (Amendment) Law, 5768-2007, in respect of the Red Sea" there shall come "the determining date";
(2)In subsection (d), in place of "the date of entry into force of Amendment 69, in respect of the Mediterranean Sea, and before the date of entry into force of the Coastal Environment Protection (Amendment) Law, 5768-2007, in respect of the Red Sea" there shall come "the determining date";
(c)In section 11, in place of "the commencement of Amendment 69, in respect of the Mediterranean Sea, and on the eve of the commencement of the Coastal Environment Protection (Amendment) Law, 5768-2007, in respect of the Red Sea" there shall come "the determining date";
(d)After section 11 the following shall come:

"Limitation on Application

12. (a) The provisions of this Schedule shall not apply to the areas of the following sites in the coastal environment of the Sea of Galilee in which water extraction, storage, conveyance, diversion, infiltration into the subsoil, supply, measurement, regulation and monitoring installations are located:

(1)Sapir site;
(2)Poolia site;
(3)Tiberias Institute;
(4)Kinneret outlet – Degania Dam;
(5)Yarmouk inlet;
(6)Jordan Valley station.
(b)The Minister of National Infrastructures shall prescribe by Regulations the boundaries of the areas of the sites listed in subsection (a), provided that the areas of the sites as aforesaid shall not exceed the minimum essential area necessary for their operation.".

Commencement, Application and Transitional Provisions§

54.
(a)Subject to the provisions of this section, this Law shall commence sixty days from the date of its publication (hereinafter – commencement date).
(b)The Coastal Environment Protection Law, 5764-2004, and the Planning and Building Law, as worded in this Law, shall commence on the date of publication of this Law (hereinafter – publication date).
(c)The provisions of the Planning and Building Law, as worded in this Law, shall apply to a plan and to an application for a permit for a temporary use or for a relaxation, within the coastal environment of the Sea of Galilee, that had not yet been approved on the publication date, provided that the period from the publication date until the expiry of ninety days from that date shall not be counted for the purpose of the time limits under section 6 of the Second Schedule to that Law.
(d)The Association shall commence performing its functions under this Law at the end of three months from the commencement date, and for so long as it has not commenced its activity as aforesaid, the local authorities within the area of the Association shall continue to perform these functions; the Minister may, by Order, postpone the said date by a period not exceeding three months.

Preservation of Validity§

55.

By-laws, licences and permits that applied within the area of the Association before the commencement date shall remain in force and shall continue to apply in that area, as if they had been made or granted, as the case may be, by the Association, until they expire in accordance with their terms or in accordance with the enactment under which they were granted, or until a decision of the Council of the Association to revoke or amend them in accordance with law.

First Schedule (Sections 2, 4 and 7)

1.§

In this Schedule –

"supervisory area" – the area delineated by a blue line on the map, situated between the shoreline of the Kinneret, as defined in the Coastal Environment Protection Law, 5764-2004, and roads nos. 87, 90 and 92, as well as an area of 300 metres towards the sea from that shoreline;

"area of the Association" – areas situated within the supervisory area, marked in dotted light blue on the map, as well as an area of 300 metres towards the sea from the shoreline of those areas.

The map below shall be deposited at a scale of 1:3,500 at the Ministry of the Interior and at the offices of the Association and shall be published on the website of the Ministry of the Interior, and any person may inspect it.
