Prevention of Sexual Harassment (Employer Duties) Regulations, 1998

Prevention Measures and Disciplinary Adaptation

Definitions

clause-1.

In these Regulations —

"Responsible Person" means a person appointed by the employer under Regulation 4(a);

"Representative Workers' Organisation" has the meaning assigned to it in the Collective Agreements Law, 5717–1957;

"Sexual Harassment" and "Victimisation" have the meanings assigned to them in the Law;

"The Law" means the Prevention of Sexual Harassment Law, 5758–1998;

"Candidate" means a person who has approached the employer in connection with recruitment;

"Small Employer" means an employer whose workforce does not exceed nine employees;

"Worker" includes a candidate.

Prevention Measures

clause-2.
(a)An employer shall act to promote the prevention of sexual harassment at the workplace; for this purpose the employer shall, among other things, do all of the following:
(1)inform workers and their supervisors of the prohibition on committing sexual harassment and the prohibition on victimisation, pursuant to the Law and these Regulations;
(2)clarify to workers and supervisors the employer's obligations under the Law and these Regulations;
(3)require supervisors and workers to refrain from sexual harassment and victimisation, and to take every measure to prevent such harassment;
(4)enable supervisors and workers to participate in training on matters pertaining to these Regulations;
(5)make available to workers the provisions of the Law and these Regulations.
(b)An employer whose workforce exceeds twenty-five shall discharge the obligation in sub-regulation (a)(1) and (2) by publishing an adapted bylaw in a conspicuous location; any other employer may discharge that obligation by distributing the model bylaw to each worker.

Adaptation of Disciplinary Rules

clause-3.
(a)An employer shall include in the disciplinary norms applicable to its workers, including in a collective agreement, a provision to the effect that committing sexual harassment and victimisation constitutes a serious disciplinary offence.
(b)Where this is prevented by the failure of a required party to consent to adaptation of the disciplinary norms, this obligation shall not bind the employer.
(c)Where an employer has not applied disciplinary norms as stated, the employer may conduct disciplinary proceedings pursuant to the existing disciplinary norms applicable to it.

Responsible Person and Complaint Procedures

Appointment and Duties of Responsible Person

clause-4.
(a)An employer shall appoint one or more responsible persons, who shall be in charge of receiving complaints and conducting inquiries under these Regulations.
(b)Insofar as practicable in the circumstances, a woman shall be appointed as responsible person.
(c)The duties of the responsible person are:
(1)receiving complaints concerning sexual harassment and victimisation;
(2)conducting inquiries into complaints;
(3)providing advice and guidance to workers on matters pertaining to these Regulations.
(d)A small employer may themselves serve as the responsible person.

Filing a Complaint

clause-5.
(a)A complaint shall be submitted to the responsible person in writing or orally.
(b)Where the responsible person is the respondent in the complaint, or has a personal interest in it, the complaint shall be submitted to another responsible person, or if there is no other responsible person — to the employer directly.
(c)A complaint submitted orally shall be recorded in writing by the responsible person, and a copy shall be given to the complainant.

Investigation and Case Handling

Investigation of a Complaint or Incident

clause-6.
(a)The responsible person shall hear the parties concerned and conduct a substantive inquiry.
(b)The inquiry shall be conducted efficiently, with due regard for the privacy and dignity of those involved.
(c)The employer shall protect the complainant and any witnesses from disclosure and from victimisation arising from the submission of a complaint or participation in an inquiry.
(d)Upon completion of the inquiry, the responsible person shall submit to the employer a written summary containing the main findings of the inquiry and recommendations.

Handling a Case

clause-7.
(a)Within seven working days from the date on which the inquiry summary was delivered to the employer, the employer shall decide on how to handle the matter; the employer may, among other things:
(1)issue behavioural directives to the respondent;
(2)separate the respondent from the complainant's workplace or immediate vicinity;
(3)initiate disciplinary proceedings against the respondent;
(4)take no action — if satisfied that the complaint has no basis.
(b)The employer's decision shall be communicated in writing to the parties concerned.

Adapted Bylaw and Scope of Application

Adapted Bylaw

clause-8.

An employer obliged to publish an adapted bylaw under Regulation 2(b) shall prepare a bylaw adapted to the circumstances of its workplace, display it in a conspicuous location at the workplace, and forward a copy to the workers' representatives, if any.

Application to Educational Institutions and Security Forces

clause-9.
(a)These Regulations shall apply, with the necessary modifications, to institutions of theoretical and vocational higher education and to the security forces.
(b)An institution of theoretical and vocational higher education shall apply the provisions of these Regulations also to complaints by students against members of staff of the institution.
(c)In the security forces, the commanding officer by rank shall ensure compliance with the employer's obligations under these Regulations.

Commencement and Transitional Provisions

Commencement

clause-10.

These Regulations shall come into force one month from the date of their publication.

Transitional Provision

clause-11.

During the 120 days from the commencement of these Regulations, an employer with more than twenty-five workers at the workplace may discharge the adapted bylaw obligation by distributing the model bylaw to each worker, pending preparation of an adapted bylaw.

Schedule: Model Bylaw

Part A — Definitions

schedule-1-a.

"Sexual harassment" — any of the following:

(1)extortion in circumstances of a relationship of authority, involving an explicit or implied threat;
(2)an indecent act;
(3)repeated suggestions of a sexual nature, including proposals for sexual intercourse, addressed to a person who has indicated unwillingness;
(4)repeated references focusing on a person's sexuality, including remarks, jokes or the display of images;
(5)publication of a photograph, film or recording of a person in circumstances where the publication is liable to humiliate that person on account of their sex or sexuality;
(6)a one-off suggestion in circumstances of a relationship of authority.

"Victimisation" — any harm of any kind caused to a worker as a result of filing a complaint about sexual harassment, conducting proceedings under this Law, refusing to commit an act of harassment, or preventing harassment.

Part B — Legal Consequences

Sexual harassment and victimisation constitute:

(1)a criminal offence — a complaint may be filed with the police;
(2)a civil wrong (tort) — damages may be claimed in court without need to prove actual harm;
(3)a disciplinary offence — the respondent may be subject to disciplinary proceedings.

Part C — Employer Policy

The employer is responsible for taking preventive measures, handling complaints effectively, and remedying any harm caused. Employer obligations include:

(1)requiring workers to refrain from sexual harassment and victimisation;
(2)supporting training and prevention activities;
(3)cooperating with public bodies active in this field;
(4)handling complaints efficiently and promptly, with due respect for the dignity of all parties.

Part D — Options Available to a Victim

schedule-1-d.

A worker who has suffered sexual harassment or victimisation may:

(1)file a complaint with the responsible person at the workplace under the employer's procedures;
(2)file a complaint with the police;
(3)bring a claim in court for damages.

These options are not mutually exclusive; a worker may pursue several simultaneously.

Part E — Complaint and Investigation Procedure

(1)A complaint shall be submitted to the responsible person orally or in writing.
(2)The inquiry shall be conducted efficiently, maintaining confidentiality and the dignity of the parties.
(3)The employer shall protect the complainant and witnesses from victimisation arising from their participation in the proceedings.

Part F — Miscellaneous Provisions

(1)A worker employed through a manpower contractor is treated in the same manner as a direct employee under these Regulations; the using employer also bears the obligations prescribed by the Regulations.
(2)An employer whose workforce does not exceed twenty-five may discharge the bylaw obligation by distributing this model bylaw to each worker.
(3)A small employer (up to nine workers) may themselves serve as the responsible person for receiving complaints.

(א) תלונה תוגש לאחראי בכתב או בעל פה. (ב) היה האחראי הנילון בתלונה, או שיש לו עניין אישי בה, תוגש התלונה לאחראי אחר, ואם אין אחראי אחר – למעסיק עצמו. (ג) תלונה שהוגשה בעל פה תירשם בכתב בידי האחראי, ויימסר עותק ממנה למגיש התלונה.

(ב) החלטת המעסיק תימסר בכתב לצדדים הנוגעים בדבר.

מעסיק המחויב בפרסום תקנון מותאם לפי תקנה 2(ב) יכין תקנון המותאם לנסיבות מקום עבודתו, יציגו במקום בולט לעין במקום העבודה ויעביר עותק ממנו לנציגות העובדים, אם ישנה כזו.
