First Schedule (Section 5)

1.§

Non-fulfilment of a provision of Israel Police orders or any other provision given in accordance with law, or refusal to fulfil such a provision.

2.§

Negligence in the performance of a duty.

3.§

Conduct that is unbecoming of a police officer or that is liable to harm the image of the Police.

4.§

Abuse of authority conferred by virtue of a position.

5.§

Absence from duty without reasonable justification.

6.§

Absence from service with the intention of not returning to it; absence from service for a continuous period of 21 days without authorisation shall be regarded, for this purpose, as an intention not to return to service, unless the contrary is proved.

7.§

Failure to take reasonable measures to prevent an offence that the officer knows is about to be committed, to detect an offence, or to bring a person suspected of committing an offence to justice.

8.§

Conducting a search, carrying out a stop or arrest, or entering private premises, unlawfully or not in good faith.

9.§

Failure to wear an identification tag, failure to fulfil the duty of identification, or providing false identification particulars.

10.§

Impersonating a person of a different rank or a person with different authority.

11.§

Making a false declaration, providing false reports, or concealing information or failing to submit reports that are required to be submitted, for the purpose of enlisting in the Police or in any other matter connected to service in the Police.

Performing an act that places the officer in a position of conflict of interests in accordance with the rules prescribed therefor in Israel Police orders.

12.§

Holding police equipment, using it, destroying or attempting to destroy it, or failing to safeguard it, contrary to Israel Police orders and without reasonable justification.

13.§

Possession, operation or attempted operation of a firearm, ammunition, explosive or other dangerous material, without authority, without the requisite degree of caution, or contrary to Israel Police orders; for the purpose of this item, "firearm" – as defined in the Firearms Law, 5709-1949.

14.§

Disclosure, transmission or attempted disclosure or transmission, without lawful authorisation, of any matter relating to the Police to an unauthorised person, where such disclosure or transmission is capable of harming an important public interest, the methods of operation of the Police, or the welfare or privacy of a person.

15.§

Approaching, without lawful authorisation, a body outside the Police in any matter relating to service in the Police; for the purpose of this item, "a body outside the Police" – excluding a court, the State Comptroller, the Public Complaints Commissioner, the Complaints Commissioner, the Inspector of the Ministry for Public Security, and the Department for the Investigation of Police Officers within the Ministry of Justice.

16.§

Discourteous conduct or use of coarse language towards the public whilst performing a duty or whilst the officer is in uniform.

17.§

Unjustified refusal to fulfil a reasonable request made by a member of the public by reason of the officer's being a police officer.

18.§

Exploiting the status of a police officer otherwise than for the purpose of performing a duty.

19.§
(a)Use of force against a person in the course of performing a duty, without lawful authority and without reasonable justification, beyond the required measure, or contrary to Israel Police orders or any other instruction given by lawful authority.
(b)Prosecution under this item is subject to the decision of the Attorney General or a person authorised by him therefor.
20.§

Doing any of the following in a proceeding, without reasonable justification –

(1)failure to appear or appearing late at a proceeding to which the officer was lawfully summoned;
(2)leaving the place of a proceeding without permission;
(3)failure to produce a document that was lawfully required to be produced;
(4)failure to give an answer, or giving an evasive or false answer;
(5)use of insulting or threatening language, or causing a disturbance or interruption;
(6)publication of any matter relating to a hearing that was conducted in camera, or the publication of which was prohibited, without permission;

for the purpose of this item, "proceeding" – a hearing before a court, a disciplinary trial or an investigation.

21.§

Doing any act intended to prevent, delay, hinder or disrupt in any way the lodging or transmission of a complaint to the Complaints Commissioner or a complaint to the Public Complaints Supervisor of the Israel Police.

22.§

Refraining from providing assistance requested by the Complaints Commissioner, the Public Complaints Supervisor of the Israel Police, or the Department for the Investigation of Police Officers within the Ministry of Justice, for the purpose of examining a complaint or conducting an investigation, as well as providing false information in the course of such an examination or investigation, otherwise obstructing them, or attempting to obstruct them as aforesaid.

23.§

Refraining from providing assistance requested by an examining officer or an examining committee appointed pursuant to Israel Police orders, for the purpose of examining a matter for which they were appointed, as well as providing false information in the course of such an examination, otherwise obstructing it, or attempting to obstruct it as aforesaid.

24.§

Refraining from providing assistance requested by the Inspector of the Ministry for Public Security for the purpose of conducting an inspection, as well as providing false information in the course of conducting such an inspection, otherwise obstructing it, or attempting to obstruct it as aforesaid.

25.§

Inducing or attempting to induce a police officer to commit a disciplinary offence by persuasion, encouragement, demand, entreaty, or any other means involving the exercise of pressure.

26.§

Doing an act in order to enable another police officer to commit a disciplinary offence, to facilitate its commission, or to otherwise contribute to the creation of conditions for the commission of the offence, or attempting to do an act as aforesaid.

27.§

Sexual harassment or victimisation, as defined in section 3 of the Prevention of Sexual Harassment Law, 5758-1998, whilst performing a duty or in connection therewith, or whilst the officer is in uniform, or where directed against another police officer or against another person who works or serves in or with the Israel Police.

28.§

Conducting an investigation, contrary to the provisions of any law, in a manner that causes a material infringement of the rights of the person being investigated.

29.§
(a)Driving a police vehicle, or driving another vehicle whilst the officer is in uniform, in any of the following circumstances:
(1)with negligence or recklessness;
(2)without a valid driving licence, except for the driving of a vehicle by a person who held a driving licence and did not renew it;
(3)during a period of disqualification or contrary to the conditions of the driving licence;
(4)whilst intoxicated, as defined in section 64b of the Traffic Ordinance [New Version].
(b)An offence against any other provision under the Traffic Ordinance [New Version] or any other offence connected with the driving of a vehicle, provided that it was committed whilst driving a police vehicle or whilst the officer is in uniform.
30.§

Breach of a duty under the Public Service (Asset Disclosure) Law, 5777-2016.

Second Schedule (Section 102g)

(1)the enforcement system, except for the purpose of performing a function assigned to a special unit as defined in section 74s of the Execution Law, 5727-1967, in accordance with the provisions of Chapter VII-D of that Law;
(2)a property tax collector as defined in section 305 of the Municipal Corporations Ordinance;
(3)a tax collector as defined in section 2 of the Tax Ordinance (Collection);
(4)the Courts Administration;
(5)the Israel Electric Corporation Ltd.;
