Schedule (section 3a)

Definitions§

1.

In this Schedule –

"assistants and advisers grading" – the grading of assistants and advisers in the offices of elected officials (grading 564) pursuant to the procedures of the Civil Service Commission;

"the Grants and Payments Decision" – the Knesset Members' Salary (Grants and Payments) Decision, 5761-2001;

"parliamentary adviser" – as defined in Chapter V-A of the Grants and Payments Decision.

Remuneration and Other Payments to Faction Employees§

2.
(a)The Knesset shall pay directly to faction employees basic remuneration as set out in items 5, 6 and 7.
(b)In addition to the basic remuneration referred to in sub-item (a), the Knesset shall pay directly to faction employees, or on their behalf, as the case may be, reimbursement of expenses and other payments as detailed below:
(1)pension rights at the rates customary for State employees, including full severance pay;
(2)a training fund at the rates customary for State employees, from the date of the employee's request, provided that the employee has agreed to transfer to the training fund the rates customary for State employees out of the employee's remuneration, and has delivered to the Knesset Treasurer confirmation of joining a training fund;
(3)a clothing allowance at the rates customary for parliamentary advisers, to be paid on a proportional basis monthly together with the remuneration;
(4)recreation pay at the rates customary for State employees, to be paid on a proportional basis monthly together with the remuneration;
(5)participation in travel, subsistence and accommodation expenses as paid to parliamentary advisers;
(6)monthly participation in expenses for the use of a mobile telephone as paid to parliamentary advisers;
(7)a holiday gift as paid to parliamentary advisers;
(8)a day care supplement (parental rights) as paid to State employees.

Participation in Accommodation Expenses§

3.
(a)In this item –

"sitting" – a sitting of the Knesset plenum or of a committee of the Knesset committees or a faction sitting;

"faction sitting" – a sitting held in the Knesset premises to which all members of the faction in which the faction employee is employed were invited, and in respect of which the faction chairman has notified the Knesset Treasurer that the presence of the faction employee was required thereat.

(b)The Knesset shall fund, for a faction employee whose permanent place of residence is not in Jerusalem, participation in accommodation expenses in Jerusalem, as referred to in section 3a(c)(1), to be paid according to the determination of the Knesset Treasurer against an invoice or receipt, or directly to the hotel, in an amount not exceeding the amount to which parliamentary advisers are entitled, provided that one of the following obtains:
(1)the accommodation is on the night between two days on which a sitting is held, and the employee's permanent place of residence is at least 100 km from Jerusalem;
(2)the sitting in which the faction employee participated ended after 23:00, and on the following day a sitting is held in the Knesset premises; for this purpose, the concluding time of a sitting of the Knesset plenum shall be deemed to be the time notified in advance by the Knesset Secretary to Members of the Knesset and to the Knesset Treasurer, if such notification was given, even if the sitting in fact ended before the time stated above;
(3)the employee was required to remain in the Knesset premises, on a day on which a sitting was held, until a late hour at which, according to the determination of the Knesset Treasurer, there is no regular public transport to the employee's place of residence.
(c)The entitlement to funding under this item shall be for one employee of the faction only on a given night, and if the faction comprised more than twenty Members of the Knesset – for two employees; however, on days on which the Knesset plenum deliberates on the State Budget Bill at the second reading and at the third reading, as well as on four additional days in the year of which the faction has notified the Knesset Treasurer, the entitlement to funding under this item shall be for two employees only, and if the faction comprised more than twenty Members of the Knesset – for three employees.

Essential equipment§

4.
(a)The Knesset shall provide to faction employees, in the number referred to in section 3a(a) only, the essential equipment detailed below pursuant to section 3a(c)(2):
(1)a mobile telephone handset; a faction manager shall be entitled to a handset of the type supplied to Knesset members and every other employee of the faction shall be entitled to a handset of the type supplied to a State employee of his grade pursuant to items 6 or 7, as the case may be; such a handset shall be replaced at the frequency customary in respect of Knesset members or State employees, as the case may be, unless the Knesset Comptroller has approved that it was damaged or lost in circumstances that justify the provision of another handset;
(2)one laptop computer from the equipment held in the Knesset store only; a faction manager shall be entitled to a computer of the type supplied to Knesset members, and every other employee of the faction shall be entitled to a computer of the type supplied to a State employee of his grade pursuant to items 6 or 7, as the case may be; such a computer shall be provided to the faction employee once every three years or for a longer period, as the Knesset Comptroller shall determine, unless the Knesset Comptroller has approved that it was damaged or lost in circumstances that justify the provision of another laptop computer;
(3)basic office supplies from the equipment held in the Knesset store only; the annual amount for such equipment shall be NIS 1,500 for a faction entitled to financing in respect of one employee pursuant to section 3a(a), and it shall increase by NIS 500 per year for each additional employee in respect of whom the faction is entitled to receive financing pursuant to that section; the said amounts shall be updated on 1 January of each year in the manner referred to in section 1c(c).
(b)If there is a change in the number of the faction's members during the term of the Knesset, the annual entitlement under sub-item (a)(3) shall change accordingly and shall apply in that year on a proportional basis.
(c)Equipment provided pursuant to sub-items (a)(1) and (2) is the property of the Knesset; upon the termination of employment of a faction employee, the equipment shall be returned to the Knesset or transferred to another employee of the faction and the provisions of this item shall apply, or it shall be purchased by the faction employee or by the faction in accordance with the practice for the purchase of equipment by Knesset members pursuant to the Grants and Payments Decision.
(d)If the employment of a faction employee has ended or the faction has ceased to exist and the provisions of sub-item (c) have not been complied with, or the faction has not returned to the Knesset equipment that it was required to return for any other reason, the cost of the equipment shall be deducted from any amount due to the faction under this Law.
(e)Equipment provided pursuant to sub-item (a)(3) is the property of the faction.

Faction manager§

5.
(a)One of the faction employees of whom the faction has notified the Knesset Comptroller shall be the faction manager; if the faction has not notified the Knesset Comptroller of the identity of the faction manager, the amounts under this item shall be paid to the employee with the longest seniority, and among employees with equal seniority – to the most senior in age.
(b)The basic salary of a faction manager shall be equivalent to the salary of a senior adviser in the office of a Minister in the assistants and advisers grading, grading code 145 or 150; the salary range for the position shall be grades 42 to 44 in that grading, and promotion in grade shall take place after four years of seniority have been accumulated.
(c)Work in the capacity of faction manager shall be deemed to be work conferring managerial experience for the purposes of tenders conducted in the State service pursuant to the criteria customary in the State service in respect of a senior adviser in the office of a Minister.

Deputy faction manager§

6.
(a)One of the faction employees of whom the faction has notified the Knesset Comptroller shall be the deputy faction manager; if the faction has not notified the Knesset Comptroller of the identity of the deputy faction manager, the amounts under this item shall be paid to the employee with the second-longest seniority, and among employees with equal seniority – to the most senior in age.
(b)The basic salary of a deputy faction manager shall be equivalent to the salary of a professional adviser in the office of a Minister in the assistants and advisers grading, grading code 148 or 250; the salary range for the position shall be grades 41 to 43 in that grading, and promotion in grade shall take place after three years of seniority have been accumulated.

Faction employee§

7.

The basic salary of a faction employee who is neither a faction manager nor a deputy faction manager shall be equivalent to the salary of an adviser in the office of a Minister in the assistants and advisers grading, grading code 124, 140 or 146; the salary range for the position shall be grades 40 to 42 in that grading; the first promotion in grade shall take place after two years of seniority have been accumulated and a further promotion shall take place after an additional year of seniority has been accumulated.

Calculation of seniority§

8.
(a)For the purposes of calculating the years of seniority as referred to in items 5, 6 and 7, account shall be taken of periods of employment as a faction employee, a parliamentary adviser, a State employee in the capacity of assistant or adviser to a Minister, Deputy Minister, Director General of a government ministry or head of an agency unit, an employee of a corporation established by law in the capacity of assistant or adviser to the head of the corporation, and a Knesset employee who, by virtue of his actual work, dealt with professional matters whose substance is parliamentary work.
(b)In addition to that stated in sub-item (a), for the purposes of calculating the years of seniority as referred to in that sub-item, every four complete years of work in which the faction employee was engaged, during a period other than a period in which he was engaged in an occupation listed in sub-item (a), in an occupation counted for seniority purposes in accordance with the seniority recognition rules customary in the State service in the administrative grading or in the university-educated grading for persons holding an academic degree or for a person who holds rabbinic ordination pursuant to approval of the Chief Rabbinate of Israel or who completed a full programme in a yeshiva gedola or kollel for at least six years after reaching the age of 18, shall be counted as one year of seniority.

Change in assistants and advisers grading§

9.

If a change occurs in the assistants and advisers grading with respect to the gradings or grades referred to in items 5, 6 and 7, the salary of faction employees shall continue to be paid as it was paid to them before the change, for as long as those items have not been amended.

Employment agreement and condition for making payments§

10.
(a)The employment agreement between the faction or the party and a faction employee shall be in the form that the Knesset Comptroller shall transmit to the factions in accordance with the provisions of this Law.
(b)A precondition for making payments to a faction employee is that the faction has delivered to the Knesset Comptroller all of the following in respect of each of its employees:
(1)a signed employment agreement as referred to in sub-item (a); the faction shall notify the Knesset Comptroller without delay of any change in the particulars specified in the agreement, including a change in the permanent place of residence of the faction employee;
(2)a notice by the faction and by the employee to the effect that they request that the Knesset serve as a service bureau for the purpose of making payments to the employee, and that no employment relations exist between him and the Knesset;
(3)a declaration by the faction and by the employee to the effect that the employee is regularly employed on a full-time basis in the faction's offices in the Knesset and that his principal occupation is the parliamentary activity of the faction in the Knesset, as referred to in the definition of "faction employees" in section 1; such declarations shall be delivered to the Knesset Comptroller in each month of January and the Knesset Comptroller shall transmit them to the attention of the Knesset Secretariat and the Legal Bureau of the Knesset; the faction and the employee shall notify the Knesset Comptroller without delay of any change in this matter.
