Definitions§

1.

In this Law –

"Compulsory Education Law" – Compulsory Education Law, 5709-1949;

"non-formal education" – education for children and youth in a local education authority, outside the activity hours of an educational institution, including social, values-based and community education, and intended for the achievement of the purposes referred to in section 2 of the State Education Law, 5713-1953;

"youth unit in a local education authority" – an administration, division, department or any other body in a local education authority charged with the affairs of non-formal education in the local education authority;

"child", "youth", "educational institution" and "local education authority" – as defined in the Compulsory Education Law;

"head of the youth unit" – a person appointed as head of a youth unit in a local education authority as referred to in section 2;

"local education authority" – (Repealed);

"the Minister" – the Minister of Education.

Appointment of head of youth unit in a local education authority§

2.
(a)In every local education authority a head of the youth unit shall be appointed.
(b)The head of the youth unit shall be responsible for non-formal education in the local education authority and for its advancement.

Terms of employment of head of youth unit§

3.
(a)A head of a youth unit shall be an employee of a local authority, and the provisions applicable to employees of that local authority shall apply to his appointment and conditions of employment, unless another provision in that regard has been prescribed by law; the head of the youth unit shall be employed at a full-time position in the management of the youth unit.
(b)Notwithstanding the provisions of subsection (a), a local education authority within whose area there are fewer than 1,000 children and youth may employ a head of the youth unit in one of the following:
(1)at a scope of at least half a position in the management of the youth unit;
(2)at a scope of at least one-third of a position in the management of the youth unit, provided that he is employed in the authority at a full-time position and the remaining portion of the position is intended for work in the fields of education, welfare or leisure.

Qualifications§

4.
(a)A person shall not be appointed or serve as head of a youth unit unless all of the following conditions are fulfilled in respect of him:
(1)he is of full age;
(2)he is an Israeli citizen or a resident of Israel;
(3)he meets the conditions regarding academic education, professional training, professional experience and passing of examinations, as prescribed by the Minister, with the approval of the Education, Culture and Sport Committee of the Knesset, to the extent prescribed;

(4)he has not been convicted in Israel or outside Israel of a criminal offence which, by reason of its nature, severity or circumstances, renders him unfit to serve as head of a youth unit in a local education authority.
(b)With respect to the provision of information from the criminal record regarding the provisions of subsection (a)(4), the provisions under section 170(b1)(1) and (3) of the Municipalities Ordinance shall apply, in relation to a local education authority, whether within the area of a municipality or within the area of a local council, with the necessary modifications.

Students and youth council in a local education authority§

5.
(a)In every local education authority a students and youth council shall be established (hereinafter – the Council).
(b)The Council shall have between 15 and 61 members, in accordance with the discretion of the head of the youth unit in that local education authority.
(c)The Council shall include representatives from educational institutions, community centres, youth movements, youth organisations and the like, provided that they are students or youth residing within the area of that local education authority.
(d)The representatives of the Council shall be elected by students and youth residing within the area of the local education authority, once a year.
(e)In this section, "student" – a person studying at an educational institution in grades 7 through 12.

Functions of the Council§

6.
(a)The Council may advise various bodies in the local authority on matters connected, directly or indirectly, with children and youth, including the head of the local authority, his deputy, the education committee, the committee for the advancement of the status of the child, the head of the education department and the head of the youth unit.
(b)The Council shall represent the interests of children and youth before the local authority and shall act to transmit their requests to the relevant bodies in local authorities or in State authorities, to follow up on the receipt of responses to requests, to appear before those bodies and to transmit the responses to the applicants.

Procedures for the work of the Council§

7.
(a)The Council shall convene at least once a month.
(b)The head of the youth unit shall meet with the Council at least once every two months.
(c)The Minister may, with the approval of the Education, Culture and Sport Committee of the Knesset, prescribe provisions regarding the procedures for the work of councils.

Procedures regarding the election of the Council and its working methods§

8.

A head of a youth unit shall regulate by procedures to be published on the internet site of the local education authority the matters set out below, to the extent not prescribed under this Law: the procedures for the election of the Council, publication of the names of its members, the dates of its convening and the place of its convening, the procedures for the convening of the Council and the organisation of its activity.

Budget§

9.
(a)An annual budget for the partial participation of the Ministry of Education in the salary costs of heads of youth units in local authorities shall be determined in a separate activity area, under the budget item of the Ministry of Education in the annual budget law; in this section, "activity area" and "budget item" – as defined in the annual budget law, within the meaning of the Budget Foundations Law, 5745-1985.
(b)The participation of the Ministry of Education in the salary costs of a head of a youth unit as referred to in subsection (a) shall be partial, according to the social and economic situation of the local authority, as prescribed by the Minister by Order.

Implementation and regulations§

10.

The Minister is charged with the implementation of this Law and may, with the approval of the Education, Culture and Sport Committee of the Knesset, make Regulations on any matter relating to its implementation.

Commencement, application and transitional provisions§

13.
(a)This Law shall commence three months from the day of its publication (hereinafter – the commencement day).
(b)The provisions of section 9 shall apply to local education authorities in which a head of a youth unit who was appointed pursuant to the provisions of section 2 and in respect of whom the provisions of sections 3 and 4 are fulfilled is serving, or who is deemed to have been appointed pursuant to section 2, as referred to in subsection (e), and in respect of whom the provisions of section 3 are fulfilled.
(c)Where a head of a youth unit has been appointed or is serving in a local education authority as referred to in subsection (b), the provisions of sections 5 to 8 shall apply, from the day of his appointment or from the commencement day, as the case may be, in respect of that local education authority.
(d)Within three years from the commencement day, a head of a youth unit shall be appointed in every local education authority pursuant to the provisions of this Law.
(e)A person who served as head of a youth unit in a local education authority on the eve of the commencement day shall be deemed a head of a youth unit appointed pursuant to section 2, provided that at the end of three years from the commencement day the provisions of sections 3 and 4 are fulfilled in respect of him.
(f)A person who served as head of a youth unit in a local education authority within whose area there are fewer than 1,000 children and youth on the eve of the publication of the Local Authorities (Head of Youth Unit and Students and Youth Council) (Amendment) Law, 5778-2018, shall be deemed a head of a youth unit appointed pursuant to section 2, provided that at the end of three years from the day of publication of that Law the provisions of sections 3 and 4 are fulfilled in respect of him.
