Chapter I: Interpretation

Purpose§

1.
(a)The purpose of this Law is to protect the wellbeing of toddlers staying in a day care centre for toddlers from harm to them, by means of the installation of cameras, while preserving, as far as possible, the dignity and privacy of the toddlers, of the workers at the day care centre and of any other person present at the day care centre.
(b)The installation and operation of any camera or camera system in a day care centre for toddlers, as well as viewing and use of recordings pursuant to this Law, shall be carried out in accordance with the provisions of this Law alone and for the purpose of realising its objective as set out in subsection (a).

Definitions§

2.

In this Law –

"the Committee" – the Education, Culture and Sports Committee of the Knesset;

"parent" – including a guardian of the toddler, but excluding a guardian for property matters only;

"Rehabilitative Day Care Centres Law" – Rehabilitative Day Care Centres Law, 5760-2000;

"Day Care Centres for Toddlers Supervision Law" – Day Care Centres for Toddlers Supervision Law, 5779-2018;

"education and care", "the Commissioner" and "toddler" – as defined in the Day Care Centres for Toddlers Supervision Law;

"pre-approved device" – an electronic device that has a unique technological identifier which has been pre-defined in the authorisation system for real-time viewing or remote viewing and is under the exclusive control of the parent, and which an operator of a day care centre for toddlers has approved as a device from which real-time viewing or remote viewing shall be conducted;

"system administrator" – a person who operates, on behalf of an operator of a day care centre for toddlers, the real-time viewing or remote viewing system, including managing the information security and cyber protection mechanism of the camera system, creating passwords for the purpose of granting viewing authorisations as aforesaid, managing controls over users and the manner of use, and technological monitoring for the purpose of cyber protection, all as required under this Law;

"day care centre for toddlers" – as defined in the Day Care Centres for Toddlers Supervision Law, and also a rehabilitative day care centre;

"rehabilitative day care centre" – as defined in the Rehabilitative Day Care Centres Law;

"camera system" – the cameras, the recording system and the supporting infrastructure;

"operator of a day care centre for toddlers" – the holder of an operating licence of a day care centre for toddlers within the meaning of Chapter III of the Day Care Centres for Toddlers Supervision Law, or an operator of a rehabilitative day care centre by virtue of the Rehabilitative Day Care Centres Law;

"inspector under the Rehabilitative Day Care Centres Law" – an inspector appointed under section 8 of the Rehabilitative Day Care Centres Law;

"inspector under the Day Care Centres for Toddlers Supervision Law" – an inspector authorised under section 28(b)(1) and (2) of the Day Care Centres for Toddlers Supervision Law;

"real-time viewing" – viewing, by means of a pre-approved device, through a secure communication channel (VPN), of a live and continuous broadcast of recordings, or a broadcast at another frequency as agreed between an operator of a day care centre for toddlers and a parent of a toddler, of a camera system installed pursuant to the provisions of this Law, while maintaining the information security and cyber protection mechanism referred to in section 7a(b)(1), including the use of a dedicated and personal password for viewing authorisation only that the operator of the day care centre for toddlers has transmitted to the parent who has been authorised to do so, without the possibility of downloading the recordings from the camera system, storing them or restoring them;

"on-site viewing" – as its meaning in section 7b(b)(1);

"remote viewing" – as its meaning in section 7b(b)(2);

"periodic viewing" – on-site viewing or remote viewing;

"the Minister" – the Minister of Education.

Chapter II: Installation of Cameras

Obligation to Install Cameras§

3.
(a)An operator of a day care centre for toddlers is responsible for installing cameras that shall document what takes place in the day care centre for toddlers, during all hours in which toddlers are present at the day care centre, by video recording without sound.
(b)The cameras shall document all that takes place in the classrooms of the day care centre, in the yard and in all other places where education and care are provided to toddlers in the day care centre for toddlers, except for bathrooms and lavatories.

Obligation to Give Notice of Camera Operation§

4.
(a)An operator of a day care centre for toddlers shall place a clear and legible sign, at the entrance to the day care centre and in every area of the day care centre in which cameras are operated, giving notice of the operation of cameras at the day care centre.
(b)The sign referred to in subsection (a) shall include a symbol and words, in the Hebrew language, and where necessary – in an additional language understood by the majority of the parents of the toddlers and the workers at the day care centre for toddlers.
(c)An operator of a day care centre for toddlers shall notify all workers at the day care centre and every job applicant at the day care centre, before the commencement of their employment, in writing and orally, in a language understood by them, of the operation of cameras at the day care centre, the purpose of their operation, their location, the areas of recording, and also of the provisions of section 7 regarding viewing and use of recordings.
(d)An operator of a day care centre for toddlers shall bring to the attention of the parents of toddlers at the day care centre, by written notice to be delivered to each parent and to be displayed in a prominent place at the day care centre, the fact of the operation of cameras at the day care centre and their right to object to the operation of cameras as set out in section 11(3).
(e)An operator of a day care centre for toddlers who permits real-time viewing or periodic viewing shall state this on the sign referred to in subsection (a) to be posted at the day care centre, including during the registration period for the day care centre; an operator of a day care centre for toddlers shall notify, in writing and orally, all workers at the day care centre and every job applicant at the day care centre, as well as all persons who provide a service at the day care centre and who visit it on a regular basis, even if no employment relationship exists with them, of the possibility of viewing as aforesaid and of the operator's intention to permit such viewing subject to the receipt of parental consent, where such consent is required under this Law, and the provisions of subsection (c) shall apply in this regard, with the necessary modifications.

Manner of Installing and Operating the Cameras§

5.
(a)An operator of a day care centre for toddlers shall install a camera system in such a manner that the number of cameras, their location, their angles of recording, the choice of technological means of recording, the times of recording and the type and quality of the recording shall enable documentation as referred to in section 3 and the use of recordings as referred to in section 7, while preserving as far as possible the dignity and privacy of the toddlers, the workers at the day care centre and any other person present at the day care centre.
(b)An operator of a day care centre for toddlers shall place the camera system in an open manner and shall not conceal it.

Retention of Recordings§

6.
(a)An operator of a day care centre for toddlers shall retain the recordings pursuant to this Law for 30 days from the date of recording, unless a longer period has been prescribed in Regulations under section 10(b)(4), and upon the expiry of that period the recordings shall be deleted automatically.
(b)An operator of a day care centre for toddlers shall take reasonable measures to prevent unauthorised access to the recordings, including preventing the cameras and any computer or device on which the recordings are stored from being connected to a communications network.

Authority to Install a Functionality Indicator System§

6a.

An expert or inspector whom the Minister has authorised under section 22 of the Day Care Centres for Toddlers Supervision Law may, in coordination within a reasonable time with an operator of a day care centre for toddlers, enter the premises of a day care centre for toddlers in which a camera system has been installed pursuant to this Law and install a functionality indicator system for the camera system, as well as carry out repairs or maintenance operations on it; in this section, "functionality indicator system" – a system external to the camera system, with appropriate cyber protection, that includes a component enabling the transmission of an indicator to a central system, alerting to a malfunction in the performance of the camera system including the recording component, as required under this Law.

Chapter III: Viewing and Use of Recordings

Viewing and Use of Recordings§

7.
(a)No person shall view recordings pursuant to this Law, copy them, transfer to another person the recordings or other information enabling viewing thereof, permit another person to view them, or make any use of them or of information revealed to that person from them, except pursuant to a court Order.
(b)Notwithstanding the provisions of subsection (a) –
(1)the Israel Police and the prosecution authorities may use the recordings for the purpose of preventing the commission of an offence, investigating an offence or conducting criminal proceedings only, subject to the provisions of any law;
(2)the Israel Police shall report information revealed to it from the recordings to the Commissioner or to the inspector under the Rehabilitative Day Care Centres Law, as the case may be, in order to prevent harm to the physical or mental wellbeing of toddlers staying in a day care centre for toddlers, and also to a social worker under the Youth (Care and Supervision) Law, 5720-1960, for the purpose of fulfilling that person's duties under that Law, all provided that doing so will not result in obstruction of investigation or judicial proceedings; where the Commissioner or an inspector under the Rehabilitative Day Care Centres Law receives information as aforesaid, that person shall notify the manager of the day care centre accordingly;
(3)the Commissioner, an inspector under the Day Care Centres for Toddlers Supervision Law and an inspector under the Rehabilitative Day Care Centres Law may use the recordings, in a case of suspicion of harm to the physical or mental wellbeing of toddlers in a day care centre for toddlers, solely for the purpose of preventing harm to the physical or mental wellbeing of the toddlers staying at the day care centre;
(4)the Israel Police shall permit a parent of a toddler to view recordings in which harm to that toddler is documented, provided that doing so will not result in obstruction of investigation or judicial proceedings.
(5)Viewing by parents of toddlers at the day care centre and viewing by an operator of a day care centre for toddlers shall be permitted in accordance with the provisions of sections 7a and 7b.

Real-Time Viewing§

7a.
(a)Notwithstanding the provisions of section 7(a), an operator of a day care centre for toddlers, other than a rehabilitative day care centre, may permit a parent of a toddler registered at the day care centre, and that parent alone, to view recordings pursuant to this Law in real time, where all of the following conditions are met:
(1)the operator notified the parent of a toddler who requested to register the toddler at the day care centre, at the time of registration, of the operator's intention to permit real-time viewing in the school year for which the toddler was registered;
(2)the operator notified the worker at the day care centre and a job applicant at the day care centre of the decision referred to in paragraph (1) at the earliest registration date for the day care centre and at least 60 days before the commencement of real-time viewing;
(3)the operator informed the parents of toddlers registered at the day care centre, in writing and orally, of the prohibitions applicable with respect to real-time viewing as referred to in subsection (d);
(4)the operator fulfilled the obligation to give notice of camera operation pursuant to the provisions of section 4(e).
(b)
(1)An operator of a day care centre for toddlers who has permitted real-time viewing shall ensure the existence of adequate mechanisms for information security and cyber protection of the camera system in a manner that ensures that real-time viewing is conducted in accordance with the provisions of this Law and that the camera system is protected against leakage or breach and the recordings are protected against deletion, alteration or copying without lawful authorisation;
(2)mechanisms as referred to in paragraph (1) shall include, inter alia, strong authentication for access to the system, including by means of a strong and complex password whose validity shall be limited in time and an additional identification means that ensures access by authorised persons only, rotating passwords, user management with definition of user validity periods, a secure communication channel for connection, control over the manner of use of the authorisation and monitoring for the detection of cyber attacks; in this paragraph, "strong authentication" – identification of the user by means of verification through at least two independent factors of different types, in chronological sequence.
(c)An operator of a day care centre for toddlers who permits real-time viewing after the end of the registration period for the day care centre shall do so in accordance with the provisions of subsection (b) and subject to all of the following:
(1)the operator notified, in writing and orally, the parents of toddlers staying at the day care centre of the operator's intention to activate real-time viewing at least 60 days before the planned date for the activation of real-time viewing, and received the written consent of all parents of toddlers staying at the day care centre; a parent who has expressed consent as aforesaid may withdraw such consent, in writing, within 30 days from the date of giving the consent;
(2)the operator notified, in writing and orally, the worker at the day care centre and a job applicant at the day care centre of the operator's intention to permit real-time viewing subject to the consent of all parents of toddlers staying at the day care centre, at least 60 days before approaching the parents as referred to in paragraph (1);
(3)the operator fulfilled the provisions of paragraphs (3) and (4) of subsection (a).
(d)A parent who has been permitted real-time viewing pursuant to this Law shall act in accordance with the provisions of this Law, including the instructions of the system administrator regarding information security and cyber protection, and in particular shall not transfer the password received to another person, shall not copy recordings, shall not publish recordings or information revealed from them and shall not permit another person to view the recordings, directly or indirectly, except to a person who has authorisation to view the recordings under this section; the provisions applicable to parents of toddlers at the day care centre under this subsection shall apply to the system administrator.
(e)A parent who has been given access to real-time viewing pursuant to this Law by means of a pre-approved device, and whose exclusive control over access to that device no longer exists, shall notify the operator of the day care centre for toddlers accordingly, and the operator of the day care centre shall update the system administrator thereof, for the purpose of blocking such access.

Periodic Viewing§

7b.
(a)Notwithstanding the provisions of section 7(a), an operator of a day care centre for toddlers, other than a rehabilitative day care centre, may permit the parents of toddlers registered at the day care centre or the parents' representative committee to view, from time to time, as agreed between the operator of the day care centre and the parents of the toddlers, recordings pursuant to this Law that have been stored in the camera system installed at the day care centre up to the time of viewing, provided that all of the following have been met:
(1)the operator notified the parent of a toddler who requested to register the toddler at the day care centre, at the time of registration, of the operator's intention to permit periodic viewing as aforesaid in the school year for which the toddler was registered;
(2)the operator informed the parents of toddlers registered at the day care centre, in writing and orally, of the prohibitions applicable with respect to viewing of recordings as referred to in subsection (d), and with regard to remote viewing – also pursuant to subsection (e);
(3)the operator fulfilled the obligation to give notice of camera operation pursuant to the provisions of section 4(e).
(b)Periodic viewing may be conducted in one of the following two ways:
(1)on-site viewing – viewing on the premises of the day care centre, by the parents' representative committee, at a frequency not exceeding once a week, at a date to be coordinated in advance between the parents' representative committee and the operator of the day care centre for toddlers; the viewing shall be conducted by means of external connection to a viewing screen and neither the operator of the day care centre for toddlers nor the parents' representative committee shall be permitted access to the component within the body of the cameras by means of which recording and filming are conducted; the operator of the day care centre for toddlers shall document the viewing by noting the day and hour of viewing and the names of the members of the parents' representative committee who viewed the recordings;
(2)remote viewing – online viewing, by the parents of toddlers at the day care centre, as shall be agreed between the operator of the day care centre for toddlers and the parents of the toddlers, at a frequency not exceeding once a month, for a period not exceeding 48 hours; the viewing shall be conducted by means of a pre-approved device, through a secure communication channel (VPN), using a dedicated and personal password for viewing authorisation only that the operator of the day care centre for toddlers has transmitted to the parent who has been authorised to do so, without the possibility of downloading the recordings from the camera system, storing them or restoring them; all provisions regarding information security and cyber protection applicable to real-time viewing as referred to in section 7a(b) shall apply to remote viewing.
(c)Where an operator of a day care centre for toddlers decides to permit periodic viewing after the end of the registration period for the day care centre, the operator shall do so subject to the following provisions:
(1)the operator notified, in writing and orally, the parents of toddlers staying at the day care centre of the operator's intention to activate periodic viewing at least 60 days before the planned date for the activation of such viewing and received the written consent of all parents of toddlers staying at the day care centre; a parent who has expressed consent as aforesaid may withdraw such consent, in writing, within 30 days from the date of giving the consent;
(2)the operator notified, in writing and orally, the worker at the day care centre and a job applicant at the day care centre of the operator's intention to permit periodic viewing subject to the consent of all parents of toddlers staying at the day care centre, at least 60 days before approaching the parents as referred to in paragraph (1);
(3)the operator fulfilled the provisions of paragraphs (2) and (3) of subsection (a).
(d)A parent who has been permitted periodic viewing pursuant to this Law shall not copy recordings, shall not publish recordings or information revealed from them and shall not permit another person to view the recordings, directly or indirectly, except to a person who has authorisation to view the recordings under this section.
(e)A parent who has been permitted remote viewing pursuant to subsection (b)(2) shall act in accordance with the provisions of this Law, including the instructions of the system administrator regarding information security and cyber protection, and in particular shall not transfer the password received to another person.
(f)An operator of a day care centre for toddlers who has permitted on-site viewing pursuant to subsection (b)(1) may view recordings pursuant to this Law, personally or through the manager of the day care centre, during the on-site viewing together with the parents' representative committee, and all obligations applicable to a parent as referred to in subsection (d) shall apply to the operator.
(g)A parent of a toddler who has been elected to the parents' representative committee shall not bear liability for damage caused to a toddler as a result of failure to identify, during the viewing, harm to that toddler.
(h)In this section, "parents' representative committee" – no more than five of the parents of toddlers registered at the day care centre, to whom all parents of toddlers staying at the day care centre have agreed that on-site viewing shall be permitted.

Choice of Viewing Method§

7c.

An operator of a day care centre for toddlers may permit only one viewing method from among the viewing methods enumerated in sections 7a or 7b, as the operator shall choose; where an operator wishes to change the viewing method, the provisions applicable with respect to that method shall apply, including the provisions regarding the requirement for parental consent.

Notices to the Commissioner§

7d.
(a)An operator of a day care centre for toddlers who has chosen to permit the parents of toddlers at the day care centre to view recordings by one of the methods enumerated in sections 7a or 7b shall notify the Commissioner thereof, in the manner to be determined by the Commissioner, within six months from the date of activating the viewing as aforesaid.
(b)An operator of a day care centre for toddlers who has permitted real-time viewing pursuant to section 7a or remote viewing pursuant to section 7b(b)(2) shall transmit to the Commissioner, within six months from the date of activating the viewing, and thereafter annually, a confirmation from the system administrator that all conditions required with regard to information security and cyber protection pursuant to the provisions of this Law are being met in the camera system at the day care centre (in this Law – system administrator confirmation); the Commissioner may prescribe provisions regarding system administrator confirmation; a copy of the system administrator confirmation shall also be transmitted to the parents of toddlers registered at the day care centre.

Guidelines of the Privacy Protection Authority§

7e.

The Privacy Protection Authority shall publish guidelines for operators of day care centres for toddlers, for system administrators and for parents of toddlers registered at a day care centre that permits real-time viewing or periodic viewing, regarding information security and cyber protection and the preservation of privacy when operating real-time viewing or periodic viewing, and compliance with the provisions of the Privacy Protection Law, 5741-1981, and the provisions of this Law in the said matters.
