Chapter V: Miscellaneous Provisions

Judicial Review§

6.

A decision of a public authority or competent authority, pursuant to sections 2(c) or 4(d), may be the subject of a petition or an appeal to the competent instance pursuant to the law under which the regulatory approval was granted or in which the power to impose a financial sanction or civil fine is anchored, as the case may be.

Savings Provisions§

7.

Nothing in the provisions of this Law shall derogate –

(1)from a power vested in a public authority pursuant to law to amend the period of validity of a regulatory approval, to renew it, to refuse to renew it, to suspend it, to revoke it or to prescribe conditions therein;
(2)from a power vested in a competent authority pursuant to law to amend a date in proceedings for the imposition of a financial sanction or civil fine.

First Schedule (paragraph (3) of the definition of "regulatory approval" in Section 1)

(1)A certificate of an accredited laboratory for a periodic inspection of a tanker or a vehicle on which a container is installed, for the transport of a hazardous substance, regarding fitness and compliance with the requirements as stated in regulation 3(c)(3) of the Transportation Services Regulations, 5761-2001, pursuant to Israeli Standard SI 819 or in accordance with the Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) – the inspector as defined in the Transportation Services Law, 5757-1997;
(2)a training certificate granted by a training institution pursuant to regulation 51 of the Work Safety (Work at Height) Regulations, 5767-2007, and an approval granted to a worker at height in accordance with regulation 6(b) and (c) of those Regulations – the Chief Labour Inspector as defined in the Work Safety Ordinance [New Version], 5730-1970 (hereinafter – the Work Safety Ordinance);
(3)an accreditation granted by an accreditation authority pursuant to regulation 6(a) of the Work Safety (Crane Operators, Operators of Other Lifting Machines and Slingers) Regulations, 5753-1992, to a slinger or crane operator, in respect of the operation of a type C or D crane – the Chief Labour Inspector as defined in the Work Safety Ordinance;
(4)an occupational environmental inspection in accordance with the provisions pursuant to the Work Safety Ordinance – the Chief Labour Inspector as defined in the Work Safety Ordinance;
(5)a report on an inspection granted by an authorised inspector pursuant to the Work Safety Ordinance, provided that no improvement order or safety order pursuant to the Labour Inspection (Organisation) Law, 5714-1954 has been issued in the last year in respect of the device to which the report relates – the Chief Labour Inspector as defined in the Work Safety Ordinance;
(6)permit information delivered to an applicant pursuant to section 145(a1) of the Planning and Building Law, 5725-1965 (hereinafter – the Planning and Building Law);
(7)a decision of a licensing authority pursuant to section 145(b1) of the Planning and Building Law and a decision of a local committee to permit a use or a non-conforming use or to grant a relaxation pursuant to sections 146, 147, 147a and 151b of the Planning and Building Law;
(8)the survey map submitted as part of a consolidation and subdivision plan pursuant to the Planning and Building Regulations (Consolidation and Subdivision Plan), 5769-2009;
(9)the survey map submitted as part of an application for permit information and an application for a permit pursuant to the Planning and Building Regulations (Building Licensing), 5776-2016;
(10)a certificate of mental fitness from a clinical, medical, rehabilitative or occupational expert psychologist pursuant to section 11b1(a) of the Firearms Law, 5709-1949 – the Head of the Firearms Licensing Division in the Ministry for National Security.

Second Schedule (section 2(f))

(4)an import licence exempt from customs duty under section 2(d) of the Free Import Order;
(5)a goods import licence granted by a competent authority in the Ministry of Agriculture and Rural Development, under the Free Import Order;
(6)a permit certificate to import into Israel or export from it waste of hazardous materials under the Hazardous Materials Regulations (Import and Export of Hazardous Materials Waste), 5754-1994;
(7)a licence to import animals under regulation 2 of the Animal Diseases Regulations (Import of Animals), 5734-1974;
(8)an import licence or a quarantine-condition import licence granted for a period of less than one year, under regulation 2 of the Plant Protection Regulations (Import of Plants, Plant Products, Pests and Auxiliary Means), 5769-2009;
(9)a permit under regulation 2 of the Animal Diseases Regulations (Import and Export of Animal Products), 5748-1988;
