Chapter VII: Transitional Provisions

Transitional Provisions§

34.
(a)In the compilation of the trustee list for the first time after the publication of these Regulations, the Commissioner and the Director of the Enforcement and Collection System may refrain from submitting an opinion as referred to in regulation 25.
(b)In the compilation of the trustee list for the first time after the publication of these Regulations, candidates who, in the five years preceding the submission of candidacy, held tenure in a role in at least 50 insolvency proceedings of individuals or in at least ten insolvency proceedings of corporations shall be deemed as if they are on a district trustee list for individuals or on a district trustee list for corporations, as the case may be, for the purpose of receiving an invitation to a personal interview without the need for a professional examination.
(c)In the compilation of a trustee list for complex proceedings for the first time after the publication of these Regulations, candidates who are accountants and who meet the conditions set out in regulation 17(a)(4) in respect of a joint operating trustee list shall be deemed to meet the threshold conditions set out in regulation 17(a)(5) for the purpose of their inclusion in a trustee list for complex proceedings, provided that the court shall direct the appointment of a trustee from this list only together with an additional trustee who is on a trustee list for complex proceedings and who is a lawyer, pursuant to Section 33(e) of the Law.
