Second Schedule (Section 87(a)): Cases in Which an Estate Administrator Is Required to Report to the General Guardian

(1).

One of the following is among the heirs:

(a)an absentee;
(b)a person who is permanently or temporarily unable to attend to his affairs, in whole or in part, provided there is no party legally authorized to attend to his affairs;
(c)a minor who has a guardian who is not one of his parents;
(2).

The Will contains a provision for the establishment of a public trust, or one that dedicates the assets of the Estate, in whole or in part, to the advancement of a public purpose, as referred to in Section 26 of the Trust Law, 5739–1979, and all of the foregoing for so long as the public trust has not been registered and no trustee has been appointed for it as provided in that Law;

(3).

Six months have elapsed from the date of appointment of an estate administrator, no Inheritance order or order for the execution of a Will has yet been granted, and no objection to the application for an Inheritance order or an order for execution has been filed;

(4).

The court has found, upon application by the General Guardian or a person acting on his behalf, that the submission of documents to the General Guardian is required for the purpose of protecting the right of an heir in the proceedings.
