Definitions§

1.

In this Law –

"Galei Tzahal" – radio broadcasts of the Israel Defence Forces;

"public body" – any of the following:

(1)a Government ministry and a State institution;
(2)a local authority;
(3)a body performing a public function by law;
(4)a corporation established by law;
(5)a body operating on a not-for-profit basis;

"security forces pensioner" – any of the following:

(1)a person who retired on a pension under the State Service (Pensions) Law [Consolidated Version], 5730-1970, as an employee of the security services as defined in section 63a of that Law;
(2)a person who retired on a pension under the Regular Service in the Israel Defence Forces (Pensions) Law [Consolidated Version], 5745-1985;

"Supervision Committee" – the committee appointed pursuant to the provisions of section 5;

"Broadcasting Authority Law" – (deleted);

"Public Broadcasting Law" – the Israeli Public Broadcasting Law, 5774-2014;

"Security Service Law" – the Security Service Law [Consolidated Version], 5746-1986;

"security forces" – any of the following:

(1)the Israel Defence Forces;
(2)the General Security Service;
(3)the Institute for Intelligence and Special Operations;

"Broadcasting Authority plenum", "Broadcasting Authority" – (deleted);

"Israeli Broadcasting Corporation Council", "Israeli Broadcasting Corporation" – as defined in the Public Broadcasting Law;

"quarter" – (deleted);

"sponsorship broadcast" – acknowledgement of the participation of an external party in the financing of a broadcast, including by citing the names of the funder's products and describing their main characteristics, but excluding a qualitative or comparative description thereof;

"service spot" – a spot that is one of the following:

(1)a spot on behalf of a public body whose purpose is the provision of a service to the public, whether by way of providing information and guidance regarding public services or for the promotion of branches of the economy, or by way of direction or the provision of advice on matters in the public interest, all without citing the name of a specific manufacturer;
(2)a spot providing information to those serving in the security forces and to security forces pensioners, in respect of institutions of higher education as defined in the Council for Higher Education Law, 5718-1958, or in respect of cultural and artistic enterprises operated by a public body, provided that it contains no qualitative or comparative description of the said institutions and enterprises;
(3)a spot providing information in respect of special promotions and benefits intended for those who are members of the regular forces of the Israel Defence Forces on compulsory service or on regular service and for security forces pensioners as referred to in paragraph (2) of the definition of "security forces pensioner", provided that it contains no qualitative or comparative description of a specific product or service;

"the Minister" – the Minister of Defence.

Sponsorship Broadcasts and Service Spots on Galei Tzahal§

2.

Sponsorship broadcasts and service spots shall be broadcast on Galei Tzahal in accordance with the provisions of this Law.

Scope of Spots§

3.

The maximum broadcasting time for sponsorship broadcasts and service spots on Galei Tzahal shall not exceed four and a half minutes per hour of broadcasting.

Restriction of Spots§

4.
(a)The Minister, in consultation with the Minister of Communications and with the Supervision Committee, shall prescribe provisions regarding the conditions for the broadcasting of sponsorship broadcasts and service spots on Galei Tzahal, including prohibitions and restrictions that shall apply in respect of such broadcasting.
(b)Galei Tzahal shall not broadcast a sponsorship broadcast, a service spot or a trailer at a volume level exceeding the range of volume levels customary in a broadcast that is not such a broadcast, as prescribed by the Minister in consultation with the Supervision Committee; in this subsection, "trailer" – any of the following:
(1)a spot announcing the broadcast schedule or one or more broadcasts to be broadcast in the future, whether immediately after its broadcasting or later on the same day or at another time;
(2)a spot intended to promote the broadcasts of Galei Tzahal.

Integration of Sponsorship Broadcasts and Service Spots by Other Technological Means – Temporary Provision§

4a.
(a)Galei Tzahal may integrate sponsorship broadcasts and service spots in other technological means used for the transmission of content of Galei Tzahal, including on the Galei Tzahal website or in a mobile radio telephone system as defined in the Communications Law (Telecommunications and Broadcasting), 5742-1982, provided that the sponsorship broadcasts and service spots are separated from the content transmitted by Galei Tzahal by means of the said technological medium.
(b)The provisions under section 4(a) and (b) shall apply, with the necessary modifications, in respect of sponsorship broadcasts and service spots as referred to in subsection (a).
(c)This section shall remain in force for 18 months from the day on which both of the following have occurred: Regulations have been promulgated under section 4 and the Supervision Committee has been appointed pursuant to the provisions of section 5; the Minister shall publish a notice of the appointment of the Committee in Reshumot (Official Gazette).

Supervision Committee§

5.
(a)The Minister and the Minister of Communications shall appoint a committee whose function is to supervise the broadcasting of sponsorship broadcasts and service spots on Galei Tzahal and their integration in other technological means used for the transmission of content of Galei Tzahal as referred to in section 4a, pursuant to the provisions of this Law.
(b)The Supervision Committee shall comprise three to five members, who shall be appointed from among the members of the Israeli Broadcasting Corporation Council, provided that no person who is a member of a sub-committee appointed pursuant to section 20 of the Public Broadcasting Law whose function is to deal with the field of radio in the Israeli Broadcasting Corporation shall be appointed to the Supervision Committee.
(c)The Minister, in consultation with the Minister of Communications, shall prescribe the rules of procedure of the Supervision Committee.

Duty of Reporting§

6.

The Minister shall report to the Economics Committee of the Knesset, in the month of March of each year, on the revenues received from the broadcasting of sponsorship broadcasts and service spots up to 31 December of the year preceding the date of the report, and on the estimate of the revenues expected from the broadcasting of the sponsorship broadcasts and service spots commencing on 1 January of the year of the report.

Implementation and Regulations§

7.
(a)The Minister is responsible for the implementation of the provisions of this Law and may promulgate Regulations on any matter relating to its implementation.
(b)Regulations under this Law shall require the approval of the Economics Committee of the Knesset.

Commencement and Transitional Provision§

8.
(a)The commencement of this Law is three months from the day of its publication.
(b)(Repealed).
(c)So long as the Supervision Committee has not been appointed pursuant to the provisions of section 5, the Minister shall prescribe the Regulations under section 4 in consultation with the Minister of Communications and with the sub-committee appointed by the Israeli Broadcasting Corporation Council pursuant to section 20 of the Public Broadcasting Law whose function is to supervise the programmes of Galei Tzahal that are not military programmes as defined in section 78 of that Law.
