Chapter V: General Provisions

Summons to Produce an Object§

43.

Where a judge considers that the production of an object is necessary or desirable for the purposes of an investigation or trial, the judge may summon any person who is presumed to have the object in his possession or control to appear and produce the object, or to deliver it, at the time and place specified in the summons.

Exemption of Police Officer from Liability§

44.

A police officer shall not bear civil or criminal liability in respect of an arrest or detention which the court considers was carried out in good faith and for the preservation of public peace, provided that nothing in this section shall derogate from the power of those in authority over him to take such disciplinary measures as they may consider necessary.

Entry into a Place§

45.

A person residing in a house or place that may be entered pursuant to authority to arrest or search, or the person in charge of such a house or place, shall, upon demand, permit free entry and afford every reasonable facility; if, upon being required to do so, such person refuses to permit entry as aforesaid, the person entitled to enter may effect entry by force.

Search of a Woman§

46.

A search of a woman under this Ordinance shall be conducted only by a woman.

Offences§

47.
(a)A person who uses force or threats in order to prevent or obstruct a lawful arrest, of himself or of another person, or in order to obstruct a lawful search, is liable to imprisonment of six months or a fine of 750 pounds.
(b)(Repealed)
(c)The provisions of this section are in addition to, and not in derogation of, the provisions of the Criminal Law Ordinance, 1936.

Commencement§

48.

This New Version shall come into force on the 13th day of Iyar 5729 (1 May 1969).
