Chapter IV: Miscellaneous Provisions

Transfer of Powers [b/45]§

107.
(a)Every administrative power and every power to make procedural regulations that were conferred on the Chief Justice are vested in the Minister of Justice.
(b)Every judicial power conferred on the Chief Justice is vested in the President of the Supreme Court and the Deputy President of the Supreme Court.

Procedural Regulations [b/46, b/8(d), b/9(d)]§

108.
(a)The Minister of Justice may, by procedural regulations, regulate procedure and practice before courts, registrars and execution offices, to the extent not prescribed by law, including —
(1)all matters relating to appeals, further hearings and retrials under Chapter II, including the procedures for applications for a further hearing and a retrial and the time limits for their submission;
(2)the extension of time limits for doing anything in procedure or practice, even if prescribed by legislation;
(3)the imposition of costs, their assessment and the determination of a scale of legal fees that a court or registrar may award for acts performed before it;
(4)the determination of the rates of payments that a court or registrar may impose on a party to civil proceedings for the recording of the transcript of the hearing, whether manually or by recording device or by other means (hereinafter — the payments), including —
(1)the categories of proceedings in which the payments may be imposed;
(2)the methods of collecting the payments;
(3)the times of imposition of the payments, with the possibility of imposing them before the proceedings, during the proceedings or upon their conclusion, and also of varying, upon the conclusion of the proceedings, a decision previously given in this regard;
(4)taking into account the financial means of the party;
(5)the determination of a special fee to be designated for the funding of the recording of transcripts as referred to in paragraph (4), to be paid by a party to civil proceedings in the manner to be prescribed by regulations.
(b)Regulations under subsection (a)(4) and (5) require the approval of the Constitution, Law and Justice Committee of the Knesset.

Appointment of an Expert on Behalf of the Court§

108a.
(a)In regulations under section 108, the Minister of Justice may, with the approval of the Constitution, Law and Justice Committee of the Knesset, prescribe provisions regarding the appointment of an expert on behalf of the court at the request of the plaintiff, for the purpose of providing a written opinion on the medical condition of a plaintiff in a civil action arising from a sexual offence committed against him by the defendant in respect of which the defendant was convicted.
(b)Where the court has appointed an expert on its behalf in accordance with regulations under subsection (a), no party shall be entitled to adduce additional expert evidence on the matter in question except with the leave of the court for special reasons to be recorded.
(c)In this section —

"sexual offence" means an offence listed in Section E of Chapter X of the Penal Law, 5737-1977, except for an offence under section 352 of that Law;

"civil action" means a civil action ancillary to a criminal conviction as referred to in section 77, or a civil proceeding in which a final judgment in criminal proceedings has been admitted in evidence under section 42a of the Evidence Ordinance [New Version], 5731-1971.

Implementation and Regulations [sh/28 opening b/47 opening r/22 opening t/10]§

109.

The Minister of Justice is charged with the implementation of this Law and may make regulations for its implementation.

Savings Provisions [b/49]§

110.

This Law does not derogate from any other law —

(1)dealing with other courts or other tribunals;
(2)excluding certain matters from the jurisdiction of the courts dealt with in this Law, or conferring additional matters on their jurisdiction;
(3)prescribing for a court a particular composition or particular procedure for hearing certain matters;
(4)denying a right of appeal or making it subject to conditions.

Transitional Provisions [sh/27(a), b/50(c)]§

111.
(a)A person who served as a judge on the eve of the commencement of the Judges Law, 5713-1953, shall be deemed to have been appointed under this Law.
(b)A registrar who served on the eve of the commencement of the Courts Law, 5717-1957, shall be deemed to have been appointed under this Law.
