Chapter IX: Indirect Amendments

Amendment No. 21 to the Civil Defence Law§

88.

In the Civil Defence Law, 5711-1951, in section 1, in the definition of "volunteer in an auxiliary organisation", the words "national service or civic service" shall be replaced by "civic service as defined in the Civic Service Law, 5777-2017".

Repeal of the National Service Law§

89.

The National Service Law, 5713-1953 – is repealed.

Amendment No. 31 to the Severance Pay Law§

90.

In the Severance Pay Law, 5723-1963, in section 11(c) –

(1)in place of paragraph (2) the following shall come:

"(2) he or she has commenced service in civic service as defined in the Civic Service Law, 5777-2017, provided that he or she has served in civic service for at least six months;";

(2)paragraph (3) – shall be deleted.

Amendment No. 10 to the Emergency Work Service Law§

91.

In the Emergency Work Service Law, 5727-1967 –

(1)in section 3, after subsection (c) the following shall come:

"(c1) In a call-up for work service of a volunteer as defined in the Civic Service Law, 5777-2017 (hereinafter – the Civic Service Law), account shall be taken of the operation of the volunteer due to a decision on an emergency under section 20 of that Law.";

(2)in section 25, after subsection (b) the following shall come:

"(c) If the conscript was, at the time of his or her call-up for work service under this Chapter, a volunteer as defined in the Civic Service Law or a person performing national civic service as defined in the National Civic Service Law, 5774-2014, the national service or community volunteering of the volunteer, or the national civic service of the person performing it, as the case may be, shall be suspended during the work service; however, the period of work service as aforesaid shall be counted towards the service period of the volunteer as defined in section 7 of the Civic Service Law, or towards the service period of the person performing it as defined in the National Civic Service Law, 5774-2014, as the case may be.".

Amendment No. 51 to the Labour Court Law§

92.

In the Labour Court Law, 5729-1969, in the Second Schedule, the words "National Service Law, 5713-1953" – shall be deleted.

Amendment No. 61 to the State Service (Pensions) Law§

93.

In the State Service (Pensions) Law [Consolidated Version], 5730-1970, in section 1, in the definition of "self-supporting", after "under the Defence Service Law, 5719-1959 [Consolidated Version]" the following shall come: "or in national service or community volunteering under the Civic Service Law, 5777-2017".

Amendment No. 18 to the Discharged Soldiers Absorption Law§

94.

In the Discharged Soldiers Absorption Law, 5754-1994 –

(1)in section 1, in place of the definition of "national service" the following shall come:

""national service" – national service or community volunteering, as defined in the Civic Service Law, 5777-2017 (hereinafter – the Civic Service Law);";

(2)(Repealed)

Amendment of National Insurance Law – No. 194§

95.

In the National Insurance Law [Consolidated Version], 5755-1995 –

(1)In section 1 –
(a)In place of the definition "volunteer in national service" the following shall come:

""volunteer in national service or in community volunteering" – a volunteer as defined in the Civic Service Law;";

(b)After the definition "Severance Pay Law" the following shall come:

""Civic Service Law" – Civic Service Law, 5777-2017;";

(c)After the definition "rate of compensation" the following shall come:

""national service", "community volunteering" and "civic service" – as defined in the Civic Service Law;";

(2)In section 158, in the definition "insured person", in paragraph (3), wherever appearing, in place of "in national service" there shall come "in national service or in community volunteering" and in place of "the national service" there shall come "the national service or the community volunteering";
(3)In section 160(e), in place of "in national service" there shall come "in national service or in community volunteering";
(4)In section 163(e), after "volunteer in national service" there shall come "or in community volunteering";
(5)In section 238, in the definition "child", in paragraph (3)(b), in place of sub-paragraphs (1) and (2) the following shall come:

"(1) a volunteer in national service or in community volunteering;";

(6)In section 287, in the definition "volunteer", after paragraph (11) the following shall come:

"(12) a volunteer in national service or in community volunteering.";

(7)In section 348(e), in place of "in national service" there shall come "in national service or in community volunteering";
(8)In section 351(k) –
(a)In paragraph (2a), in place of "in voluntary national service" there shall come "in national service or in community volunteering" and the definition "voluntary national service" – shall be deleted;
(b)In paragraph (2b), in place of "in volunteering as its meaning under paragraph 3(b) of the definition "child" in section 238" there shall come "or in community volunteering";
(c)In paragraph (2c) –
(1)In sub-paragraph (b), after "in national service" there shall come "or in community volunteering";
(2)In sub-paragraph (c), in place of "and the Ministry responsible for the area of activity of the \"civil-national service\"" there shall come "and the Ministry as defined in the Civic Service Law".

Amendment of Prevention of Sexual Harassment Law – No. 14§

96.

In the Prevention of Sexual Harassment Law, 5758-1998, in section 2 –

(1)In the definition "in service", in place of "in national service" there shall come "in civic service as defined in the Civic Service Law, 5777-2017";
(2)The definition "national service" – shall be deleted.

Repeal of National Service Law (Conditions of Service for a Volunteer in National Service)§

97.

The National Service Law (Conditions of Service for a Volunteer in National Service), 5758-1998 – is repealed.

Amendment of Administrative Courts Law – No. 109§

98.

In the Administrative Courts Law, 5760-2000, in the First Schedule, in place of item 49 the following shall come:

"49. Civic service – a decision of an authority under the National Civic Service Law, 5774-2014, or under the Civic Service Law, 5777-2017, except a decision of the Government under those Laws."

Amendment of Law on Restrictions on the Return of a Sex Offender to the Vicinity of an Offence Victim – No. 7§

99.

In the Law on Restrictions on the Return of a Sex Offender to the Vicinity of an Offence Victim, 5765-2004, in section 2, in the definition "work", in place of "and national service" there shall come "and civic service as defined in the Civic Service Law, 5777-2017".

Amendment of Law for Assistance to Sderot and the Western Negev Communities (Temporary Provision) – No. 5§

100.

In the Law for Assistance to Sderot and the Western Negev Communities (Temporary Provision), 5767-2007, in section 3 –

(1)In the definition "teachers", in place of "volunteer in national service" there shall come "volunteer as defined in the Civic Service Law, 5777-2017";
(2)The definition "volunteer in national service" – shall be deleted.

Amendment of Health Professions Practice Regulation Law – No. 6§

101.

In the Health Professions Practice Regulation Law, 5768-2008, in section 58(e1)(4), after "in national service" there shall come "or in community volunteering".

Amendment of National Fire and Rescue Authority Law – No. 6§

102.

In the National Fire and Rescue Authority Law, 5772-2012 –

(1)In section 2, after the definition "volunteer" the following shall come:

""volunteer in national service or in community volunteering" – a person who serves in the Fire and Rescue Authority in national service or in community volunteering as defined in the Civic Service Law, 5777-2017;";

(2)In section 20a, after "civil-security" there shall come "and on a volunteer in national service or in community volunteering".

Amendment of Law on Payments to Soldiers in Regular Service (Protection of Payments)§

103.

In the Law on Payments to Soldiers in Regular Service (Protection of Payments), 5774-2014, in section 2(a), the words "who is entitled to economic assistance, due to family or economic circumstances" – shall be deleted.

Amendment of National Civic Service Law – No. 3§

104.

In the National Civic Service Law, 5774-2014 –

(1)In section 1, after the definition "Environmental Protection Law" the following shall come:

""Civic Service Law" – Civic Service Law, 5777-2017;";

(2)In section 8 –
(a)After subsection (c) the following shall come:

"(c1) The Authority shall pay, in respect of a person serving in national civic service, national insurance contributions under Chapter XV of the National Insurance Law [Consolidated Version], 5755-1995, and health insurance contributions under section 14 of the National Health Insurance Law, 5754-1994, except in respect of a person serving of whom the National Insurance Institute has notified that there is no liability for contributions as aforesaid, during the period in which there is no such liability.";

(b)In subsection (h)(1), after "paid" there shall come "under this Law" and the words "who is entitled to economic assistance, due to family circumstances" – shall be deleted;
(3)After section 13 the following shall come:

"Deployment of persons serving in national civic service due to a decision on an emergency

13a. The provisions of section 20 of the Civic Service Law, regarding the deployment of volunteers due to a decision on an emergency, shall apply also regarding the deployment of persons serving in national civic service, with the necessary modifications.";

(4)In section 19, after subsection (e) the following shall come:

"(f) The provisions of sections 23 to 28 of the Civic Service Law shall apply regarding the Authority and regarding persons serving in national civic service, with the necessary modifications, and the provisions of Chapter V of that Law regarding the Council as defined in that Law shall apply also regarding this Law.";

(5)In section 22(e), after "the inspector" there shall come "or the employee as aforesaid".

Chapter X: Miscellaneous Provisions

Implementation and Regulations§

105.
(a)The Minister is responsible for the implementation of this Law, and may make Regulations on any matter relating to its implementation, including on the following matters:
(1)the rights of volunteers, subject to the provisions of section 9;
(2)binding standards for service apartments and for ensuring suitable accommodation therein, including with respect to safety, sanitation and accessibility conditions, and the Minister may prescribe different standards and conditions for different service apartments, according to types of volunteers;
(3)timetables for the submission of reports by an operating body and the manner of submitting the reports;
(4)conditions with respect to education, professional experience and training required of employees of a recognised body who serve in managerial roles, in roles of identifying candidates for service or in roles of accompanying volunteers.
(b)The Minister, with the approval of the Committee, may prescribe provisions on the following matters:
(1)conditions of service of volunteers, in addition to those prescribed in the First Schedule, and the Minister may prescribe such provisions with respect to categories of volunteers, including new immigrant volunteers who are alone, in accordance with their special characteristics as the Minister shall prescribe;
(2)fees that recognised bodies and operating bodies are required to pay for the submission of applications under this Law, including applications for recognition, approval or review.
(c)Regulations under this Law shall be made in consultation with the Council, after the Director has been given the opportunity to submit the Director's opinion on the matter to the Minister; however, if the consultation process with the Council has not been completed within 100 days of the day on which the Minister approached it on the matter, the duty of consultation with it shall be deemed to have been fulfilled.

Amendment of Schedules§

106.
(a)The Minister, in consultation with the Minister of Labour, Welfare and Social Services and with the approval of the Committee, may, by Order, amend the First Schedule and the Second Schedule.
(b)The Minister, with the approval of the Committee, may, by Order, amend the Third Schedule.

Commencement and Application§

107.
(a)The commencement of this Law, except for the provisions set out in subsection (b), is on the 16th of Nisan 5778 (1 April 2018) (hereinafter – the commencement day), and it shall apply with respect to national service or community volunteering performed by volunteers from the 21st of Elul 5778 (1 September 2018) onwards.
(b)The commencement of the provisions set out below is on the date specified alongside them:
(1)Section 19 – on the date of entry into force of Regulations under section 19(d);
(2)Chapter VIII – on the date of commencement of Regulations under section 78(b).
(3)Section 71 – on the 23rd of Heshvan 5779 (1 November 2018), and it shall apply, notwithstanding the provisions of subsection (a), with respect to national service or community volunteering performed by volunteers from the 1st of Elul 5779 (1 September 2019) onwards.

Savings Provisions§

108.

In the event of a conflict between a provision under this Law and a provision under the National Civic Service Law on the same matter, the provision under the National Civic Service Law shall prevail.

First Regulations and Procedures§

109.
(a)The first procedure under section 31(h) shall be determined within six months of the commencement day.
(b)The first Regulations under sections 16, 17, 19(d)(1) and 65(a)(1) shall be brought for the approval of the Committee by the commencement day.

Appointment of First Council§

110.
(a)A first Council under section 34 shall be appointed by the commencement day, and it shall be entitled to convene from the time two thirds of its members have been appointed.
(b)Notwithstanding the provisions of section 105(c), the making of the first Regulations under section 109(b) does not require consultation with the Council.

First Government Decision§

111.

The first Government decision regarding national order of priorities as referred to in section 24 shall be adopted within two years of the day of publication of this Law.

Transitional Provisions§

112.
(a)A person who, prior to the commencement day, served in volunteering in national service as referred to in paragraph (3)(b) of the definition "child" in section 238 of the National Insurance Law, as worded on the eve of the commencement day, shall be deemed to have served, during the period in which the person so served, in national service or in community volunteering under the provisions of this Law.
(b)The National Civic Service Authority established under the National Civic Service Law shall be deemed to be the Authority established under section 21 of this Law.
(c)The Director of the National Civic Service Authority appointed under the National Civic Service Law shall be deemed to have been appointed as Director under section 22 of this Law.
(d)
(1)Notwithstanding the provisions of section 48, a body that received recognition as a recognised body on the eve of the commencement day under the National Insurance (Girls in Voluntary National Service) Regulations, 5762-2002, shall be deemed to be a body recognised under section 48 of this Law, during the period from the commencement day until the 28th of Av 5787 (31 August 2027); however, from the 24th of Tevet 5779 (1 January 2019) onwards that body shall maintain a separate accounting system in accordance with the provisions of section 48(b)(1)(c);
(2)If during the period referred to in paragraph (1) a body as referred to in that paragraph (in this paragraph – a transferring body) transferred the whole of its activity relating to national service or community volunteering to another body (in this paragraph – the other body) by reason of its failure to meet the requirements of section 48(b)(1), the Minister, the Authority, or an operating body, as the case may be, may take into account, with respect to engagements with the other body, the previous activity of the transferring body relating to national service or community volunteering, provided that the other body has been recognised as a recognised body under the provisions of this Law.
(e)Notwithstanding the provisions of Chapter VII, an operating body that deployed volunteers on the eve of the commencement day, in accordance with the provisions under paragraph (3)(b) of the definition "child" in section 238 of the National Insurance Law, as worded on the eve of the commencement day, shall be deemed to be a body approved under Chapter VII, from the commencement day until the 1st of Elul 5779 (1 September 2019).
(f)
(1)A tariff for the deployment of a volunteer in national service that applied on the eve of the commencement day shall be deemed to be a tariff determined under section 10;
(2)Until Regulations are made under section 10(b) with respect to the updating of the tariff, the tariff referred to in paragraph (1) shall be updated on 1 January of each year, according to the rate of change in the Consumer Price Index published by the Central Bureau of Statistics compared to the said Index last published on the eve of the commencement day.
(g)So long as Regulations have not been made under section 16(d)(2), the rate of representation of persons with disabilities among all volunteers in national service and in community volunteering shall not be less than the rate of positions designated for persons with disabilities out of all volunteers on the eve of the day of publication of this Law, and so long as Regulations have not been made under section 17(a)(2), the rate of representation of at-risk youth among all volunteers in national service and in community volunteering shall not be less than the rate of their representation on the eve of the day of publication of this Law.

Report to the Knesset§

113.

From the commencement day until the 21st of Elul 5778 (1 September 2018), the Minister shall report to the Committee, at least once every four months, on the preparations for the implementation of this Law.
