By virtue of my authority under Sections 8c(d) and 23(a) of the Aviation Services Licensing Law, 5723-1963 (hereinafter – the Law), and pursuant to the proposal of the Civil Aviation Authority under Section 23(a) of the Law, I hereby promulgate the following Regulations:

Exemption from the Obligation to Hold an Operating Permit – Regulations 5783-2023§

1.
(a)The types of commercial operations for the purpose of carrying passengers or transporting goods for remuneration in respect of which an operating permit is not required under Section 8c of the Law are:
(1)a charter flight for own use, as defined in the Aviation Services Licensing Regulations (Charter Flights), 5783-2023, whose capacity includes seats for the carriage of passengers;
(2)passenger flights operated by means of an aircraft whose authorised passenger seat configuration is 9 seats or fewer;
(3)cargo transportation flights operated by means of a small aircraft as defined in the Aviation Regulations (Operation of Aircraft and Flight Rules), 5742-1981, or by means of a medium aircraft as defined in Section 231 of those Regulations;
(4)carriage of passengers for any purpose other than transportation between at least two geographic points.
(b)Notwithstanding the provisions of sub-regulation (a), flights as referred to in sub-regulation (a)(1) to (3) in which use is made of the rights of the seventh freedom, the eighth freedom or the ninth freedom require an operating permit under Section 8c of the Law, unless they are operated for the purpose of performing the functions of the Institute for Intelligence and Special Operations; for this purpose, "seventh freedom", "eighth freedom" and "ninth freedom" – as their meaning in the document (Doc 9626) entitled "Manual on the regulation of international air transport", published by the International Civil Aviation Organization, a copy of which is deposited for public inspection at the offices of the Civil Aviation Authority, free of charge; the Director shall publish on the Authority's website on the internet the main features of the said freedoms.

These Regulations shall come into force three months from the date of their publication.
