Chapter V: Commencement

Commencement§

21.
(a)These Regulations shall commence 30 days from the date of their publication (in these Regulations – the commencement date).
(b)Notwithstanding the provisions of sub-regulation (a) –
(1)regulations 7(a)(2), 14 and 15 shall commence on the 6th of Shevat 5783 (28 January 2023);
(2)regulations 7(a)(6) and (9) shall commence on the 10th of Av 5783 (28 July 2023);
(3)regulation 13 shall commence on the 22nd of Tammuz 5784 (28 July 2024);
(4)regulation 12 shall commence on the 3rd of Av 5785 (28 July 2025);
(5)with respect to a cage-free coop that is an existing coop –
(a)regulation 9(b)(2) shall commence on the 6th of Shevat 5783 (28 January 2023);
(b)regulations 5(6), 7(a)(3), (4) and (8) and 8(4) shall commence on the 10th of Av 5783 (28 July 2023);
(c)regulations 5(5), 6(b)(2) and 9(a)(5) with respect to a coop in which there was no litter on the eve of the commencement date, and regulation 9(a)(6) with respect to a coop in which the perches therein did not meet the conditions set out in that regulation on the eve of the commencement date – on the later of the following:
(1)six months from the commencement date;
(2)if on the eve of the commencement date there were laying hens in the coop – on the date of restocking of the coop, and no later than two years from the commencement date.

Chapter VI: Temporary Provisions concerning a Caged Coop

Definition§

22.

In this Chapter, "cell" – a cage or part thereof that is not divided by internal partitions.

Validity§

23.

This Chapter shall remain in force until the 23rd of Tevet 5798 (31 December 2037).

Limitation on Application§

24.

The provisions of regulations 3(b), 5(5), 6(b), 7(a)(3), (4) and (8) and (d)(1), (2) and (4), 8(3) and (4), 9(a)(2) to (6) and 10(c) shall not apply to a caged coop that is an existing coop.

Prohibition on Expanding a Caged Coop§

25.

A person shall not expand a caged coop and shall not add cages thereto.

Prohibition on Introduction of Laying Hens into a Caged Coop§

26.

A person shall not introduce laying hens into a caged coop after the 23rd of Iyyar 5795 (1 June 2035).

Density in a Caged Coop§

27.
(a)A coop owner shall not keep laying hens in a caged coop unless the average area of the usable area is at least 750 square centimetres per laying hen in a cell; if the size of the cell is less than 1,500 square centimetres, the said average area shall not be less than 600 square centimetres.
(b)Notwithstanding the provisions of sub-regulation (a), in a laying coop in which laying hens were kept, on the eve of the commencement date, at a density greater than the density permitted under that sub-regulation (in this sub-regulation – the existing density), the coop owner may introduce laying hens into the coop at the existing density until the 7th of Av 5788 (30 July 2028) and keep laying hens therein at such density until no later than the 25th of Adar II 5790 (30 March 2030), provided that the average area of the usable area is at least 350 square centimetres per laying hen in a cell; the Director General of the Ministry may, at the request of a coop owner, in special cases and by a reasoned written decision, extend, with respect to the coop that is the subject of the request, the said dates by an additional period not exceeding two years.

Equipment in a Caged Coop§

28.
(a)A coop owner shall not keep laying hens in a caged coop unless all of the following exist in every cell:
(1)drinking installations, of one or more of the following types:
(a)nipple drinkers or cup drinkers whose number is not less than one nipple drinker or cup drinker per ten laying hens, provided that the nipple drinkers or cup drinkers shall be in a quantity and position enabling every laying hen to have access to at least two nipple drinkers or cup drinkers;
(b)troughs whose length, in centimetres, is not less than the number obtained by multiplying the number of laying hens in the cell by twelve;
(2)feeders whose length, in centimetres, is not less than the number obtained by multiplying the number of laying hens in the cell by ten;
(3)if there is a nest box in the cell whose floor is made of concrete or metal – a bedding of thermally insulating material that can be disinfected or replaced, placed on the floor of the nest box.
(b)A coop owner shall not keep laying hens in a caged coop, in a cell that has perches, except when the following conditions are met:
(1)the perches are parallel to one another;
(2)the width of the perches is not less than two centimetres and their total length, in centimetres, is not less than the number obtained by multiplying the number of laying hens in the cell by fifteen;
(3)the distance between a perch and the ceiling of the cell is not less than 20 centimetres.

Special Provisions concerning Penalties§

29.

Regulation 20(a) shall be read, with respect to caged coops, as follows:

(1)instead of paragraph (1) there shall come:

"(1) a person who established a coop contrary to regulation 3(a);";

(2)after paragraph (1) there shall come:

"(1a) a person who expanded a caged coop or added cages thereto contrary to regulation 25;

(1b)a person who introduced laying hens into a caged coop after the 23rd of Iyyar 5795 (1 June 2035), contrary to regulation 26;";
(3)instead of paragraph (2) there shall come:

"(2) a coop owner who restocked a coop otherwise than in accordance with the conditions set out in regulation 5;";

(4)instead of paragraph (3) there shall come:

"(3) a coop owner who kept laying hens in a caged coop at a density exceeding that referred to in regulation 27;";

(5)instead of paragraph (4) there shall come:

"(4) a coop owner who kept laying hens in a coop without the conditions set out in regulation 7(a)(1), (2), (4)(a), (5) and (7), (c) and (d)(3) being met with respect to the infrastructure and equipment therein;";

(6)instead of paragraph (6) there shall come:

"(6) a coop owner who kept laying hens in a laying coop without the conditions set out in regulations 9(a)(1) and 28 being met with respect to the infrastructure and equipment therein;".
