Chapter IV-A: Benefits

Benefits Grant§

17a.

A Prisoner of Zion who has been recognised as a disabled person is entitled, once a year, in addition to the allowances under this Law, to a benefits grant in an amount equal to 18% of the average wage calculated under section 2 of the Insurance Law; the benefits grant shall be paid in August of each year; in this section, "benefits grant" means a payment made to a Prisoner of Zion who has been recognised as a disabled person as a contribution towards expenses as referred to in the Regulations made by the Minister of Finance under section 27 of the Nazi War Disabled Law, 5714-1954.

Property Tax Payments§

17c.
(a)A Prisoner of Zion is entitled to a discount of 100% on property tax payments applicable to the apartment serving as his place of residence; where the area of the residential apartment exceeds 100 square metres, the discount shall be granted only in respect of 100 square metres.
(b)The discount under this section shall be granted even where only one of the spouses residing in the same residential unit that is liable for property tax payments is a Prisoner of Zion.
(c)In this section, "Prisoner of Zion" means a Prisoner of Zion in respect of whom all of the following apply:
(1)he is entitled to an income-based allowance within its meaning in section 11;
(2)immediately before the submission of the claim for the allowance referred to in paragraph (1), a benefit under the Income Assurance Law was paid to him for a period of at least six months.

Purchase of Medicines§

17d.
(a)A Prisoner of Zion is entitled to a discount on medicines included in the health services basket as referred to in section 8(g)(3) of the National Health Insurance Law, 5754-1994.
(b)In this section, "Prisoner of Zion" means a Prisoner of Zion as defined in section 17c(c) who is a senior citizen as defined in the Senior Citizens Law, 5750-1989.

Prevention of Duplication of Benefits§

17e.

A Prisoner of Zion who is entitled to a benefit under sections 17c and 17d, and who is also entitled to a benefit in the same matter within the scope of the benefit under any other law, shall be entitled to one benefit only, at the higher rate among them.

Grant for Dependants of a Prisoner of Zion who Died before the 13th of Tevet 5759 (1 January 1999)§

17f.
(a)The widow, at the time of his death, of a Prisoner of Zion who was recognised under the provisions of this Law and who died before the 13th of Tevet 5759 (1 January 1999) shall be entitled to a grant in an amount equal to twice the grant payable under section 310 of the Insurance Law.
(b)
(1)Where a Prisoner of Zion in respect of whom the provision of subsection (a) applies has died and there is no widow entitled to this grant under this section, all of his children at the time of his death shall be entitled together to a grant as referred to in subsection (a);
(2)For the purpose of payments under this section, a widower shall be treated in the same manner as a widow.
(c)Where a grant under section 310 of the Insurance Law or under section 15 of the Income Assurance Law was paid to the children or widow of a Prisoner of Zion in respect of his death, the amount of the grant so paid shall be deducted from the amount of the grant payable under this section.

Chapter V: Miscellaneous

Applicant's Obligations§

18.

A person applying for an allowance shall furnish the Institute with documents concerning his income and other particulars required for the determination of entitlement to the allowance; a recipient of an allowance shall notify the Institute of his departure abroad and of any change in his income and in the composition of his family that is likely to affect the rate of the allowance.

Payment§

19.
(a)Where an application for an allowance under this Law has been approved, the allowance shall be paid from the first day of the month in which the application was submitted, and for as long as the entitled person is an Israeli citizen and a resident of Israel.
(b)Where the entitlement to an allowance has lapsed or a change in the amount of the allowance has occurred during any given month, the payment of the allowance shall be discontinued or the amount shall be changed, as the case may be, from the first day of the following month.
(c)Where a person entitled to an allowance has left Israel for a period exceeding six months, he shall not be entitled to an allowance in respect of the period of his stay outside Israel beyond the said six months, unless he left Israel on a state or public mission or for the purpose of receiving medical treatment, and in all cases only for a period approved by the Institute.
(d)A Prisoner of Zion who is entitled to an allowance and has no dependants within their meaning in section 247 of the Insurance Law, and whose maintenance is at the expense of a public body determined pursuant to section 307 of the Insurance Law, shall be paid the allowance in an amount equal to 25% of the amount of the allowance due to him, commencing from the fourth month of his maintenance in the institution and for as long as he is maintained therein.

Income for the Purpose of Special Old-Age and Survivors' Benefits§

19a.

An allowance paid under the provisions of this Law shall not be regarded as income for the purpose of the agreement concerning the provision of special old-age and survivors' benefits as defined in the Insurance Law.

Allowance Debt§

20.
(a)Where a person entitled to an allowance has died without having collected the full allowance due to him, the allowance debt shall be paid to his spouse, and in the absence of a spouse — to his heirs at law.
(b)A person entitled to an allowance who has not collected it within one year from the date on which it was offered for payment shall forfeit his right to receive it, unless the Institute has determined otherwise.

Prevention of Double Payments§

21.
(a)Where there exists entitlement to different allowances under sections 10, 14 and 15, only one allowance shall be paid to the entitled person, at his choice.
(b)A spouse and child of a Prisoner of Zion who are entitled to a pension shall have the option of choosing between the pension and an allowance under section 17; in this section, "pension" means one of the following, as the case may be:
(1)a survivors' pension under Chapter XI of the Insurance Law;
(2)a dependants' pension under Chapter V of the Insurance Law;
(3)a survivors' benefit paid under the agreement concerning the provision of special old-age and survivors' benefits as defined in the Insurance Law.
(c)A disability in respect of which an allowance is paid under this Law and in respect of which no allowance was paid under the agreement within its meaning in section 27 shall not be taken into account for the purpose of a disability pension under Chapter IX of the Insurance Law.

Medical Treatment§

22.
(a)The Minister shall prescribe rules concerning medical treatment and vocational rehabilitation to be provided to persons entitled to allowances in respect of their disability determined under this Law.
(b)A Prisoner of Zion who is a disabled person and is entitled to an allowance shall be paid, annually, recuperation pay for seven days in amounts to be prescribed by the Minister.

Application of Sections of the Insurance Law§

23.

Sections 297a, 297b, 303, 304, 311, 315 and 396 of the Insurance Law shall apply, with the necessary modifications, for the purposes of this Law.

Labour Court§

24.

A regional court, within its meaning in the Labour Court Law, shall have exclusive jurisdiction to hear and determine any action under this Law, except in matters within the jurisdiction of the appeals committee as referred to in section 4 or within the jurisdiction of the Administrative Affairs Court as referred to in section 4a.

Financing§

25.
(a)Allowances under this Law shall be paid from the State Treasury through the Institute.
(b)The State Treasury shall transfer to the Institute, every month, all the funds required by it in order to carry out the payments under the Law, including the administrative expenses of the Institute arising from the implementation of the Law.

Benefit Not to Be Paid§

25a.

A benefit below a rate or amount to be prescribed by the Minister by Regulations shall not be paid.

Day of Commemoration of the Activities of Prisoners of Zion§

25b.
(a)The activities of Prisoners of Zion shall be commemorated on a fixed date every year, in accordance with instructions to be determined by the Government (in this section — the Day of Commemoration of the Activities of Prisoners of Zion).
(b)The Day of Commemoration of the Activities of Prisoners of Zion shall fall on the 5th of Tammuz; however, if the Day of Commemoration of the Activities of Prisoners of Zion falls on a holiday, day of rest or day of cessation of work, or on a state memorial or commemoration day, or on the day preceding any of the said days, the Government may determine that the Day of Commemoration of the Activities of Prisoners of Zion shall fall close to the 5th of Tammuz.

Implementation§

26.
(a)The Minister is responsible for the implementation of this Law and may make Regulations on any matter relating to its implementation.
(b)The Minister, with the approval of the Immigration, Absorption and Diaspora Affairs Committee of the Knesset, may prescribe —
(1)rules concerning the calculation of amounts to be regarded as income from an asset as defined in section 1(a), including circumstances in which an asset of a child in the custody of a person recognised as a Prisoner of Zion shall also be taken into account for the purpose of calculating that person's income;
(2)circumstances in which an asset transferred to another shall be regarded as belonging to the transferor of the asset, and the methods of calculating income from a transferred asset.

Validation§

27.
(a)The authorities and bodies established or appointed under the agreement concerning the provision of allowances to Prisoners of Zion, their family members and the family members of martyrs (hereinafter — the agreement) shall continue to act as if they had been established or appointed under this Law, for as long as they have not been newly established or appointed under the Law.
(b)The decisions taken by the authorities and bodies referred to in subsection (a) before the commencement of this Law under the agreement shall continue to be in force as if they had been taken under the Law and with the necessary modifications arising therefrom.

Commencement§

28.

This Law shall commence sixty days from the date of its publication.

Publication§

29.

This Law shall be published within thirty days from the date of its adoption.
