Definitions§

1.

In this Law –

"digital content service" – an online service designed or used principally for the sharing, distribution, saving or storage of personal content;

"personal content" – content that a user of the service created, edited or saved and which is found in that user's account, provided that it is not found in an account allocated to the user in the framework of the user's employment.

Determination of policy and granting of access to personal content after a person's death§

2.
(a)A provider who gives or offers a digital content service shall determine and publish rules concerning the manner of handling personal content and the possibility of access thereto after the death of a user of the service; the rules shall be published in a clear and accessible manner and in the language in which the service is provided.
(b)
(1)In the rules referred to in subsection (a), the service provider shall determine provisions that will enable a user, by means of a notice to the provider, to choose that after the user's death another person shall be entitled to receive access to the user's personal content in the possession of the provider, in whole or in part, or to choose that no access to the user's personal content shall be given to another person, and the provider may determine that access to part of such content shall not be given;
(2)The obligation to determine provisions as referred to in paragraph (1) shall not apply to a provider in respect of an interpersonal communication service or a component of such a service, and in respect of another service listed in the Schedule; the Minister of Justice, with the approval of the Constitution, Law and Justice Committee of the Knesset, may, by Order, amend the Schedule.
(c)A service provider shall from time to time again inform the user of the rules it has determined pursuant to this Section and of the user's choice pursuant to subsection (b).
(d)The provisions of this Law shall also apply to a service provider outside Israel when it gives or offers a digital content service to users in Israel, if it directs the service to such users.
(e)Nothing in the provisions of this Section shall derogate from the provisions of any law, including the provisions of the Privacy Protection Law, 5741-1981, and the provisions of the Succession Law, 5725-1965.

Implementation and Regulations§

3.

The Minister of Justice is charged with the implementation of this Law, and may, with the approval of the Constitution, Law and Justice Committee of the Knesset, make Regulations on any matter relating to its implementation.

Commencement§

4.

This Law shall come into force one year from the date of its publication.
