By virtue of my authority under Sections 7(c), 9, 13(b), 130(b), 135(b), 142, 238(a) and 239 of the Vehicle Industry Services and Professions Licensing Law, 5776-2016 (hereinafter – the Law), after consultation with the Advisory Council for Professional Managers of Garages in respect of regulations 7 and 8, with the consent of the Minister of Finance in respect of regulation 9, and with the approval of the Economics Committee of the Knesset, I hereby make the following Regulations:

Definitions§

1.
(a)In these Regulations –

"safety defect" – a defect in one or more of the following systems in a vehicle: steering, brakes, tyres or electronic safety, which is liable to impair the proper functioning of that system;

"Garage Licensing Regulations" – the Vehicle Industry Services and Professions Licensing (Conditions for the Licensing of Garages and Professional Managers of Garages and for the Certification of Examiners in Examinations for the Licensing of Professional Managers and Miscellaneous Provisions) Regulations, 5782-2022;

"Traffic Regulations" – the Traffic Regulations, 5721-1961.

(b)Terms used in these Regulations that are not defined in the Law shall have the meaning assigned to them in the Traffic Ordinance [New Version] or in the Traffic Regulations.

Services of a mobile garage§

2.
(a)The holder of a licence to operate a mobile garage may provide only the following services, according to the types of vehicle set out below:
(1)for a vehicle, other than a tractor or mobile machine –
(a)emergency repairs to one or more of the following:
(1)the ignition system;
(2)the fuel system;
(3)the cooling system;
(4)the electrical system;
(b)recovery of a vehicle until it reaches a garage;
(c)tyre maintenance services for a vehicle operated by a plant as defined in regulation 579 of the Traffic Regulations, provided that the said service is provided in an enclosed area in the possession of that plant, between 17:00 and 07:00;
(2)for a vehicle of the type of a tractor or mobile machine – all the services referred to in Section 135(b) of the Law.
(b)Notwithstanding the provisions of sub-regulation (a), the Director may grant a licence to operate a mobile garage that does not include tyre maintenance services as referred to in sub-regulation (a)(1)(c) (hereinafter – tyre maintenance services) or such a licence that includes tyre maintenance services only.

Period of Validity of a Licence to Operate a Garage§

3.

The Director may grant a licence to operate a garage whose period of validity is less than six years, or renew a licence to operate a garage for such a period, if the said licence was granted or renewed after 1 January; the period of validity of such a licence shall end on 31 December of the sixth year following the year in which it was granted or renewed, as the case may be.

Exemption from Conditions for Obtaining a Licence to Operate a Garage§

4.

The Director, by a reasoned decision in writing, may grant an exemption from the conditions for obtaining a licence to operate a garage that were prescribed pursuant to Section 127(2) to (4) of the Law, to the holder of a commercial importer's licence who applies to obtain a licence of the types set out below:

(1)a licence to operate a garage for the initial registration of a new vehicle (code 187), as defined in the Schedule to the Garage Licensing Regulations;
(2)a licence to operate a garage for the registration and licensing of a new vehicle (code 188), as defined in the Schedule referred to in paragraph (1).

Signage of a Garage§

5.
(a)The size of the sign that the holder of a licence to operate a garage shall erect at the garage as referred to in Section 130 of the Law shall not be less than the following: length 50 cm and width 70 cm.
(b)The size of the letters that appear on a sign as referred to in sub-regulation (a) shall not be less than the following: height 4 cm and width 3 cm.
(c)A sign as referred to in this regulation of a specialist garage shall be in the form set out in the First Schedule.

Reporting on Defects in a Vehicle§

6.
(a)The professional manager of a garage shall report to the Licensing Authority on safety defects as referred to in Section 142 of the Law that were not repaired before the vehicle was delivered to the customer, in accordance with the form in the Second Schedule.
(b)A form as aforesaid shall be prepared shortly before the delivery of the vehicle to the customer and a copy thereof shall be provided to the customer; the form shall be sent to the Licensing Authority immediately upon the delivery of the vehicle as aforesaid, and no later than one business day after the delivery of the vehicle.

Circumstances that Are Evidence of a Concern of a Conflict of Interests of a Professional Manager§

7.

Where one or more of the following circumstances apply to a professional manager of a garage, they shall be regarded as evidence of a concern of a conflict of interests of the said professional manager:

(1)serving in the role of vehicle appraiser, vehicle inspector or traffic safety officer;
(2)receiving income from an insurer, insurance agent or anyone on their behalf, in exchange for services that are not vehicle operations as defined in Section 128(a) of the Law;

In this paragraph –

"Insurance Supervision Law" – the Financial Services Supervision Law (Insurance), 5741-1981;

"insurer" – the holder of an insurer's licence pursuant to Section 15 of the Insurance Supervision Law;

"insurance agent" – the holder of an agent's licence as defined in Section 25 of the Insurance Supervision Law.

Rules of Professional Ethics for a Professional Manager of a Garage§

8.

A professional manager of a garage –

(1)shall not perform a vehicle operation that is not required according to his sole professional discretion, shall not instruct and shall not authorise an employee of a garage to perform such an operation, all subject to the provisions concerning the performance of vehicle operations pursuant to Section 139 of the Law;
(2)shall not perform a vehicle operation that was not included in an initial price quote or an updated price quote provided to the customer pursuant to Section 132 of the Law, and shall not instruct and shall not authorise an employee of a garage to perform such an operation.

Fees§

9.
(a)For an application for the grant of a licence pursuant to Sections 127, 129, 135 or 136 of the Law, the receipt of an original copy or a copy of such a licence and for participation in an examination for the grant of a licence, the following fees shall be paid:
(b)The amount of the fee pursuant to paragraphs (1) to (4) of sub-regulation (a), in respect of a licence as referred to in those paragraphs that was granted or renewed after 1 January, in the year in which it was granted or renewed as aforesaid, shall be one-twelfth of the fee pursuant to the said paragraphs, for each month of the licence period or part thereof, and shall be rounded as referred to in sub-regulation (e).
(c)The amount of the fee for an objection to the results of an examination, theoretical or practical, shall be half of the fee paid for the examination as referred to in sub-regulation (a), as the case may be, and shall be rounded as referred to in sub-regulation (e).
(d)Where a licence has been returned or cancelled at the request of the licence holder, the Director shall refund to the licence holder the amount of the fee paid, on a proportional basis, for each complete month remaining until the end of the year in which the licence was returned or cancelled as aforesaid; the amount of the refund shall be rounded as referred to in sub-regulation (e); in this sub-regulation, "licence" – a licence as referred to in sub-regulation (a)(1) to (3), including a type of garage included therein, or a licence as referred to in sub-regulation (a)(4).
(e)The amounts specified in sub-regulation (a) shall be updated on 1 April of each year (hereinafter – the update date) in accordance with the rate of change of the new index compared with the base index, and the first update date shall be on 1 April following the expiry of one year from the date of commencement of these Regulations; an amount updated as aforesaid shall be rounded to the nearest whole new shekel, and an amount of half a new shekel shall be rounded upwards; the update of the amount as aforesaid shall be carried out on the basis of the amount set for the previous update date, before it was rounded as aforesaid; for this purpose –

"index" – the Consumer Price Index published by the Central Bureau of Statistics;

"new index" – the index published in the month of November preceding the update date;

"base index" – the index published in the month of November preceding the previous update date, and for the first update date following the commencement of these Regulations – the index published in November 2021.

(f)The Director General of the Ministry shall publish in a notice in Reshumot (Official Gazette) and on the Ministry's website the text of sub-regulation (a) as amended pursuant to sub-regulation (e).

Commencement§

10.

These Regulations shall commence 90 days from the date of their publication.

Notice of a Safety Defect Liable to Endanger Traffic or Safety

Pursuant to Section 142 of the Vehicle Industry Services and Professions Licensing Law, 5776-2016

I hereby give notice that upon an inspection conducted on __________ of a vehicle bearing registration number __________ of the type _____________ manufactured by __________, a defect was found that is liable to endanger traffic or safety, and was not repaired before the delivery of the vehicle to the customer.
