Definitions§

1.

In this Law –

"model" means a person who has been photographed for the purpose of using his or her image for the advertising, promotion or representation of a product, service or brand;

"body mass index" (BMI – Body Mass Index) means the ratio between a person's body weight in kilograms and the square of his or her height in metres;

"brand" means a trade name, trade mark or symbol;

"advertiser" means a person who initiates an advertisement for a product that he or she supplies, a service that he or she provides, or a brand of his or her own;

"advertising producer" means a person who produces an advertisement for an advertiser for remuneration;

"advertisement" means a photographed advertisement for a product, service or brand, in print, by electronic means or by other technological means, that is intended or available to the public;

"underweight" means a body mass index value lower than 18.5 in the case of an adult, or lower than the values set out in the Schedule in the case of a minor;

"the Minister" means the Minister of Industry, Trade and Employment.

Submission of a Valid Certificate as a Condition for an Advertisement§

2.
(a)An advertising producer shall not produce an advertisement in which a model appears, and an advertiser shall not display such an advertisement, unless the model has submitted to them a physician's certificate stating that he or she is not underweight, based on the calculation of the body mass index pursuant to an examination performed by the physician within the three months preceding the date on which the model was photographed for the advertisement (in this Law – a valid certificate).
(b)A person to whom a valid certificate has been submitted shall retain a copy thereof for the period prescribed in section 5 of the Limitation Law, 5718-1958.

Obligation to Disclose the Use of Graphic Editing to Slim Body Proportions§

3.
(a)An advertising producer who produces an advertisement presenting a human figure in respect of which graphic editing has been used, including by means of computer software, for the purpose of slimming body proportions, shall include in the advertisement a disclosure stating that in its preparation graphic editing was used for the purpose of slimming body proportions; an advertiser shall not display such an advertisement unless the disclosure has been included therein.
(b)A disclosure referred to in subsection (a) shall appear in the advertisement in a prominent place and in a colour and size that are clearly visible to the eye, over an area of no less than 7% of the total advertising surface of the advertisement.
(c)An advertising producer who has produced an advertisement referred to in subsection (a) shall retain the original photographs on the basis of which the graphic editing was performed, for the period referred to in section 2(b).

Exceptions§

4.
(a)The provisions of sections 2 and 3 shall not apply to an advertisement whose purpose is non-commercial, where the advertiser has proved that there is a clear public interest in its publication, provided that the publication is carried out to the extent required and in accordance with the provisions of any law.
(b)An advertisement shall not be regarded as a prohibited advertisement under the provisions of sections 2 or 3 if it is apparent from the advertisement and from the manner in which it is broadcast or published, as the case may be, that it is not intended for the public in Israel.

Savings Provisions§

5.

The provisions of this Law are in addition to the provisions of any law and do not derogate therefrom.

Implementation and Regulations§

6.
(a)The Minister is responsible for the implementation of this Law and may make Regulations on any matter relating to its implementation.
(b)Regulations on the matters listed below require the approval of the Health Committee of the Knesset:
(1)the text of the valid certificate;
(2)the text of the disclosure referred to in section 3 and the manner of its presentation, including its size, location, colour, and the size and form of the lettering;
(3)the performance of an examination for the calculation of the body mass index.

Commencement, Application and Transitional Provisions§

7.
(a)This Law shall commence on the 19th day of Tevet 5773 (1 January 2013) (hereinafter – the commencement date), and shall apply to an advertisement photographed from the commencement date onwards, and in respect of section 3 – to an advertisement in the preparation of which graphic editing was used to slim body proportions, from the commencement date onwards.
(b)Notwithstanding the provisions of subsection (a), in respect of an advertisement for which an agreement for its photography was concluded before the date of publication of this Law, the provisions of section 2 shall apply from the expiry of one year from the date of conclusion of the agreement or from the commencement date, whichever is the later.
