Definitions§

1.

In this Law –

"equipment" – a machine intended or used for construction, engineering construction, public works, earthworks, quarrying, lifting, loading or unloading, including a tractor, all as prescribed in Regulations, including auxiliary equipment therefor and accessories thereof;

"owner", in relation to equipment – including a person holding equipment under a hire-purchase contract.

Appointment of Registrar and Inspectors§

2.

The Minister of Labour shall appoint a Registrar of Engineering Equipment (hereinafter – the Registrar), and inspectors of engineering equipment (hereinafter – inspector); notice of the appointments shall be published in Reshumot (Official Gazette).

Registration of Existing Equipment§

3.

A person who is an owner of equipment on the day on which that equipment is prescribed in Regulations under Section 1 shall register the equipment with the Registrar within forty days in the manner prescribed therefor.

Registration of Future Equipment§

4.

A person who becomes an owner of equipment after that equipment has been prescribed in Regulations under Section 1 shall register the equipment with the Registrar within fourteen days in the manner prescribed therefor.

Annual Notification§

5.

No later than the last day of the month of March of each year, an owner of equipment shall furnish the Registrar with particulars of the equipment in his ownership, as prescribed in Regulations.

Notification of Changes§

6.

A person who transfers equipment out of his ownership shall notify the Registrar thereof within seven days; likewise, an owner of equipment shall notify the Registrar within the said period of any change in his address.

Registration Number§

7.

Equipment registered under Section 3 or 4 shall be assigned a number by the Registrar; the number shall be indicated on a plate to be provided by the Registrar to the owner of the equipment, and the plate shall at all times be affixed to the equipment in a visible place.

Use of Unregistered Equipment§

8.

No person shall use equipment or operate it unless the provisions of Sections 3, 4, 5 and 7 have been complied with in respect thereof.

Disclosure of Personal Information from a Database§

8a.

The Registrar of Engineering Equipment may disclose to the bodies listed in the Fifth Schedule to the Traffic Ordinance [New Version] personal information from a database as defined in the Privacy Protection Law, 5741-1981, managed by the Registrar, as detailed in that Schedule.

Notification of Location of Equipment§

9.

An owner of equipment shall notify the inspector, in accordance with the inspector's direction, of the place at which the equipment will be found on the date specified in the notification, in order to enable the inspector to inspect it; a direction under this Section may be general or specific, for a particular type of equipment or for a particular owner of equipment, and if it is general or specific to a type of equipment it shall be published in Reshumot (Official Gazette) and in at least one daily newspaper.

Powers of an Inspector§

10.

An inspector may inspect the condition of equipment and may interrogate any person in connection with the implementation of this Law, and may enter any place, other than a place used solely as a dwelling, where the inspector has reasonable grounds to believe that equipment is to be found.

Offences§

11.

A person who contravenes Sections 3, 4, 5, 6, 7, 8 or 9, or who obstructs an inspector in the exercise of the inspector's powers under Section 10, is liable to a fine of three hundred pounds or to imprisonment of one month, or to both penalties, in respect of each piece of equipment in connection with which the offence was committed.

Offence by a Corporation§

12.

Where an offence under this Law is committed by a body of persons, whether incorporated or unincorporated, every person who, at the time of the commission of the offence, was a member of the management, a director, a partner or a responsible officer of that body shall also be guilty of the offence, unless that person proves one of the following:

(1)that he did not know of the commission of the offence;
(2)that he took all reasonable measures to prevent the commission of the offence.

Implementation and Regulations§

13.

The Minister of Labour is charged with the implementation of this Law, and may make Regulations on any matter relating to its implementation, and, with the approval of the Labour Committee of the Knesset – Regulations concerning fees in connection with registration under Sections 3 or 4 and the furnishing of particulars under Section 5.
