By virtue of my authority under Sections 19(b)(1) and (d) and 105 of the Civil Service Law, 5777-2017 (hereinafter – the Law), in consultation with the Council, and with the approval of the Labour, Welfare and Health Committee of the Knesset in respect of regulations 2 and 4 to 6, I hereby make the following Regulations:

Chapter I: General

Definitions§

1.

In these Regulations –

"responsible person" – a contact person at the foreign operating body who is responsible for the volunteer;

"application" – an application for the approval of a foreign operating body;

"foreign operating body" – a person who has received approval under the Law and these Regulations to serve as an operating body in the service state;

"service state" – the state outside Israel and the Region in which the service is intended to be performed;

"the supervisor" – the supervisor of service outside Israel appointed under regulation 5;

"contact details" – an address, an e-mail address and a telephone number;

"service" – national service or community volunteering;

"service outside Israel" – the period of service performed outside Israel and the Region;

"foreign corporation" – a body incorporated outside Israel whose place of activity is outside Israel;

"Operating Body Regulations" – the Civil Service (Operating Body) Regulations, 5778-2018.

Chapter II: Service Outside Israel

Maximum Quota for Posts§

2.

The maximum quota of posts for operating volunteers in service outside Israel is 250 posts per year.

Application for Approval of a Foreign Operating Body§

3.
(a)Chapter III of the Operating Body Regulations shall apply to a foreign corporation seeking to receive approval to serve as a foreign operating body; an application may be submitted by the foreign corporation or by a recognised body with which the foreign corporation has entered into an agreement.
(b)Notwithstanding the provisions of Section 63(a)(2) of the Law, the foreign corporation shall not be required to satisfy the condition set out in that Section, provided that it operates on a not-for-profit basis; the application shall be accompanied by a legal opinion from an advocate stating that the foreign corporation operates on a not-for-profit basis under the law applicable in the state in which it operates; the advocate signing the opinion shall attach to the opinion a declaration stating that he or she is proficient in the law of that state.
(c)The application shall be accompanied by an undertaking, signed by the authorised signatories of the foreign operating body, whereby the foreign corporation undertakes to comply with the requirements under the law and with the agreement with the recognised body; the undertaking shall include the consent of the foreign operating body that any legal proceedings in connection with a volunteer in service outside Israel shall be heard in Israel, under Israeli law; a sample undertaking shall be published on the website of the Authority.
(d)Documents under this regulation shall be submitted in Hebrew or English, as far as possible, or in another language spoken in the state in which the foreign operating body operates.

Grant of Approval to a Recognised Body to Refer Volunteers to Service at a Foreign Operating Body§

4.
(a)The Director may approve a recognised body to refer volunteers to service at a foreign operating body, if the recognised body has requested this, provided that its application satisfies the conditions under Section 19(a) and (b) of the Law; in its application, the recognised body shall set out, among other things, the supervisory framework it intends to operate for the purpose of supervising the foreign operating body as referred to in regulation 6.
(b)Where the Director has approved a recognised body to refer volunteers to service at a foreign operating body as referred to in sub-regulation (a), the recognised body shall submit to the Director an application for individual approval to operate a volunteer in service outside Israel, before the commencement of the service of that volunteer; such an application shall include the following details in respect of the volunteer included in the application:
(1)details of the operating body in Israel at which the volunteer has completed or is expected to complete at least 12 months of service, and an undertaking by the recognised body that the volunteer will not commence service outside Israel before completing the said 12 months;
(2)the name of the foreign operating body and its contact details;
(3)the full address of the place of service in the service state;
(4)the responsible person and his or her contact details;
(5)the contact details of the volunteer outside Israel and of a contact person on behalf of the volunteer who resides in Israel;
(6)a copy of the volunteer's medical insurance policy;
(7)copies of entry and residence visas for the service state, if required under the law applicable in that state;
(8)a contact person at the recognised body who will maintain ongoing contact with the volunteer in the service state, and his or her contact details.

Supervision of Service Outside Israel§

5.
(a)The Director shall appoint, from among the inspectors appointed under Section 29 of the Law, a supervisor of service outside Israel; the supervisor shall supervise recognised bodies, foreign operating bodies and volunteers, in all matters relating to service outside Israel, with the aim of ensuring that service outside Israel is performed in accordance with the law.
(b)A foreign operating body shall submit to the supervisor, once every six months, a report on all of the following:
(1)the volunteer's compliance with his or her obligations;
(2)the securing of the volunteer's rights under the law;
(3)details of the activities performed by the volunteer in the half-year preceding the report;

the report under this sub-regulation shall be signed by the responsible person at the foreign operating body and submitted to the supervisor through the recognised body; a sample report form shall be published on the website of the Authority.

Obligations of a Recognised Body to Secure the Rights of Volunteers in Service Outside Israel§

6.
(a)In addition to the provisions of Section B of Chapter VI of the Law, a recognised body shall act to secure the protection of the rights of volunteers it has referred to service outside Israel, and for this purpose shall perform, among other things, the following actions:
(1)hold conversations with the responsible person at the foreign operating body, at least once a month;
(2)approve in advance the accommodation assigned to the volunteer, having satisfied itself that the place is appropriate and suitable for housing volunteers, as well as the arrangement for the volunteer's travel from the said accommodation to the place of service and back;
(3)verify the transfer of payments and the provision of benefits and conditions of service to which the volunteer is entitled under the law;
(4)enter into a written agreement with the foreign operating body in respect of the operation of the volunteer outside Israel and the securing of his or her rights under the law;
(5)hold a video call with the volunteer at a frequency of at least once a fortnight;
(6)transmit to the volunteer, on a monthly basis, a feedback form relating to the service and its conditions; the Authority shall publish a sample feedback form on its website; the volunteer shall complete and sign the feedback form, and the recognised body shall retain the signed feedback form until the end of one year from the date of completion of service outside Israel;
(7)submit to the supervisor a report on the conditions of the volunteer's service and on the volunteer's attendance, once every six months.
(b)In a case where a volunteer operates within the framework of two or more foreign operating bodies, the recognised body shall be responsible for ensuring that the volunteer's rights are protected and shall ensure that the said operating bodies agree on the division of responsibility between them in accordance with the law.

Commencement§

7.

These Regulations shall commence on the 1st day of Elul 5779 (1 September 2019).
