By virtue of my authority under Section 8d(b)(1) and (d) of the Business Licensing Law, 5728-1968 (hereinafter – the Law), I make these Regulations:

Definitions§

1.

In these Regulations –

"complex business" – a business requiring a licence that is any of the following:

(1)it is of the types of businesses marked with "+" in column 1 in Column C of the Schedule to the Order and with the number "1" in Column E of that Schedule;
(2)it is of the types of businesses listed in the Schedule;

"the Order" – the Business Licensing Order (Businesses Requiring a Licence), 5773-2013.

Time for Delivery of a Defect Correction Report§

2.

A defects report as referred to in Section 8d(a) of the Law, in respect of conditions and instructions under the Law concerning the maintenance of adequate environmental quality and the prevention of hazards or nuisances, shall be delivered to the owner of a complex business at the following times:

(1)in respect of conducting an inspection of the business to determine conditions for the grant of a licence or permit for the business or for the purpose of examining its compliance with the conditions required for the grant of a licence or permit under the Law – within 75 days of the first date on which an inspection visit was conducted at the business for the purpose of conducting the inspection;
(2)in respect of conducting an inspection for the purpose of supervising instructions under the Law – within 90 days of the date on which the inspection visit was conducted at the business for the purpose of such supervision.

Conducting a Repeat Inspection and Reliance on a Declaration§

3.
(a)Where an instruction was given in a defects report delivered pursuant to regulation 2 that proof of correction of defects shall be effected by means of conducting a repeat inspection, the inspection may be conducted within 60 days of the date on which the business owner gave notice of the correction of the defects.
(b)Where an instruction as referred to in sub-regulation (a) was given, it shall not be possible to rely on a declaration in lieu of conducting a repeat inspection for the purpose of proving correction of the defect.

Schedule (regulation 1)

(1)fuel of all types – a fuel and refuelling station, designated as item 2.2a in the Schedule to the Order;
(2)fuel of all types – its storage in the quantities specified in the Business Licensing (Petroleum Storage) Regulations, 5737-1976, designated as item 2.2d in the Schedule to the Order;
(3)fuel of all types – fuel terminals, designated as item 2.2e in the Schedule to the Order;
(4)an abattoir, slaughterhouse, slaughter facility, designated as item 3.1 in the Schedule to the Order;
(5)pest control – agricultural pest control whether by aircraft or by other means, and their cleaning, designated as item 3.3b in the Schedule to the Order;
(6)meat, poultry, fish, marine animals or parts thereof – treatment of raw meat – at a production capacity exceeding 5 tonnes per day, designated as item 4.4b in the Schedule to the Order;
(7)refuse and waste – a transfer and sorting station, designated as item 5.1a in the Schedule to the Order;
(8)refuse and waste – a site for the disposal of mixed waste, including carcasses, designated as item 5.1e in the Schedule to the Order;
(9)watercraft – a marina, designated as item 8.8c in the Schedule to the Order;
(10)watercraft – their manufacture, repair, renovation, designated as item 8.8d in the Schedule to the Order;
(11)hazardous materials, as defined in the Hazardous Materials Law, 5753-1993, including radioactive materials and hazardous materials waste – a transfer station for hazardous materials waste, designated as item 10.10g in the Schedule to the Order.
